Erika Jayne was in court today trying to avoid charges of embezzlement for not turning over the $750,000 diamond earrings to the trustee. The Trustee won the case. The judge basically found Erika Girardi complicit in the embezzlement. Could she be facing jail time? It would seem so. I love how Erika was crying about her life on Bravo while WEARING THE EARRINGS!
The judge said the facts are straightforward. The judge said there was fraud and embezzlement. The time, these were funds in trust. It wasn’t taken out for costs or fees, it was taken out for embezzlement, the $750,000 was made out of the trust which was improper. Erika’s attorney tried to say that she didn’t know the were purchased with stolen money. That is irrelevant. She was in possession of goods that were purchased with stolen money. THE EARRINGS ARE GONE. The Trustee already has possession of the earrings and they will go toward the victims fund.
This post is the highlights from Ronald Richards Twitter account. He was live tweeting from the trial. It seems likely to me that Erika Girardi could be criminally charged. The Twitter updates are a bit hard to follow but I didn’t see mention of that in the ones that I read. Also, with this verdict, I would think they could come after her again for other assets that were purchased with stolen funds.
Stay tuned I imagine there are worse things coming down the pike for Erika. She may be the only one to go to jail. I wonder how Tom’s health is?

I saw a document with tax info (I think on R Richards) and it had how she claimed her business made $1million, but claimed deductions of more than $2million for expenses for her and Tom. When the FTB reviewed it, it was determined that it wasn’t a real business, (Unless you count money laundering). But there still are years after that to be vetted. If she owes the Calif. FTB $2+ million for 2019, think of 2020 and 2021, plus, the board can go back before 2019 and levee fines and penalties for ALL OF THE YEARS. 👏👏👏👏👏🍾🍾🍾🍾🍾
She makes my blood boil. I wanted to throw something through the tv this season when she tried to act like it was proven, there was info out there, that she was innocent of any wrongdoing. She’s delusional. By her thinking, if my husband robs a bank, I can claim not to know anything about it and I get to keep the stolen money. She is so full of shit and so arrogant at the same time. RHOBH has been one of my favorites, but I’m sick of the way the group supports her, with the exception of Sutton and Garcelle. Those two are what is keeping me watching right now. The other day she was claiming that the earrings bought with the (allegedly) stolen money had been stolen. (Either karma or a lie!) THESE were the replacement earrings, so they were hers to keep. Like if I take a stack of stolen $100 bills to the bank and swap them for $50 bills, then nothing I buy with it is stolen money!

It really feels like “what next” every damn day when I wake up.

She deserves everything she gets. She has no sympathy for victims who are truly struggling. She still makes $600,000 a year on RHOBH. She simply traded a very rich life funded by a criminal, for a a less rich life. Her salary should be garnished. Can’t that be done? No more glam squad, no cute little million dollar bungalow (or whatever she calls it), no trips, and NO jewelry! Oh and she’d have to go completely without makeup. An then she’d go to jail. Her salary probably will be garnished. And she only has glam for the show that films for 2 months a year, three tops. I think the rent on her bungalow is $10K a month IIRC. She should be able to survive just fine. But she should have had a yard sale before all the lawyers came for her money. She doesn’t seem smart enough to save for a rainy day.

One of my hopes is that the trustees scour all of that Bravo footage (including the unaired that the courts awarded them) to log ALL of the jewelry in the “Girardi vault,” as Mikey called it. I have a sneaking hunch much of it was stashed/hidden at the outset of legal problems.
There was that necklace with 30+karats of graduated diamonds that she wore with some honker diamond earrings. The Bulgari stuff … I THINK when Tom gave her one as a gift, she said she collected them.
I really hope that $40k a month in glam claims from the past are explored. Looking at her “going about unglammed,” I can see that the team was doing a lot of work, but how many of the team were added “casual labor” aka money laundering/money stashing/tax evasion?

Do we know why just the earrings were singled out? Seems like EVERYTHING she owns came from stolen/embezzled funds. Obviously they are a big-ticket item, but i’m sure there are plenty of other things, especially jewelry that would be surrendered and given back to the Trust.

The house was given over to the trustees to auction, I AM PRETTY SURE. NEED to check Ronald Richards again. For sure, the trustees want to do that, maybe no ruling yet.
The earrings were purchased directly from the trust account for the Reslelin victims. That is why they are able to take them back to be sold and the proceeds to go to those particular clients.
I would guess most of her jewelry and belongings would and should be part of their joint assets. It all should be sold and auctioned off to pay as many other victims that didn’t receive their settlement money.
They auctioned off items from the office and they are still trying to sell the house before it goes into foreclosure. Hopefully they will come looking for the paintings, jewelry and any other high ticket items next. Maybe these items weren’t purchased directly from a client trust account but they surely were purchased with money that should have gone to the victims and not taken by the lawyers instead.

This story is funny. The damn earrings were going to be the hill Erika died on, and now they’re gone. Very slowly all the big ticket purchases made with money belonging to widows and orphans will be reclaimed. I hope those legal people find them all. Shouldn’t be hard, just rewatch old seasons. Even we could start compiling our own list here.
I just wish we could see it all play out on camera. It was sickening to see how Erika was convinced she was exonerated. She’s so smug and smarmy this season. Her little drunken escapades on the boat/yacht just show us who she is as a person. She literally had one job, to film on a boat, and she was too good for that.

With all the bad things happening to good people, finally reading about karma snatching those earrings from a bad person makes me feel all warm and fuzzy inside.
