Felons By Bravo: Erika Jayne Named In Racketeering Lawsuit

RHOBH RecapSo the other day, I received a 66 page court document regarding a l$55 million lawsuit where several people were being sued by victims lawyers Edelson PC. The suit is against multiple people. Erika Girardi is named in two of the accusations, Racketeering, and Receipt of Stolen property. The second one is a slam dunk. The first one basically has to show that her companies were receiving illegally gained money to fund her business, namely EJ Global.

Then it gets more complicated than my brain can register at the moment. It’s usually my favorite thing to do but I’m in the bad place. Please forgive me for delayed responses on email. So, I’m going to rely on this very understandable report from Too Fab.

The lawsuit refers to the Girardi Keese law firm as a criminal enterprise disguised as a law firm that stole over $100 MILLION from law firms and victims. Well that is certainly to the point. Also, Girardi & Keese is also accused of specifically “siphoning off millions to fund a lifestyle so lavish that Erika was a cast member of ‘The Real Housewives of Beverly Hills,'” where she and Tom “certainly played up the part of flaunting their wealth and the fact that Tom was a powerful attorney who wooed celebrities, judges, and politicians alike.”

But wait! There’s more! The suit alleges that Erika Jayne acted as the “frontwoman” for the scheme, “selling to the world (and unsuspecting clients)” that the firm was successful. It’s a job Edelson PC says she “was exceptionally good” at. The suit alleges Erika “shamelessly displayed a nationwide showroom of the money they stole on ‘Real Housewives,’ famously spending $40,000 per month on her ‘look,’ and releasing a song called ‘XXPEN$IVE’ featuring the refrain ‘It’s expensive to be me.'” Erika allegedly “used her significant public platform” to “lie about her own involvement” in the scheme and says she even tried “to assist Tom and the others in getting away with it” on the show.

The Crazy Car Crash Story Was Planted By Erika

Erika’s story about Tom’s car crash also plays a big role in the suit, with Edelson PC claiming she “began parroting a story about Tom’s supposed mental decline that his attorneys were advancing” as part of his defense. Edelson accuses Erika of “attempting to explain away the decade-long” scheme “by blaming Tom’s supposed mental decline” and even claims her story changed between Seasons 8, when the accident actually happened, and Season 11.

In 2018, she claimed Tom simply broke his ankle and was fine, before changing her account “dramatically after the scheme was uncovered.” In a 2021 episode, she said Tom actually “had a head injury, he broke his shoulder, snapped his ankle and broke his clavicle” after he “drove off a cliff” behind their home. But Tom is on camera on Season eight with no visible injuries. Edelson goes on to question the timing of Erika’s story, saying her new account was filmed “on the same day that Tom’s lawyers raised a mental incompetency defense for the first time.” They believe this coincidence “shows that Erika is colluding with Tom and likely coordinating directly with his lawyers to assist with his defense

“On the same day that her involvement in the scheme was exposed in court filings, Erika tweeted a picture of herself on to her nearly 500,000 Twitter followers captioned ‘High Drama,'” reads the suit. “When a federal judge found that Tom had ‘misappropriated’ at least $2 million from his Lion Air Clients, she posted a scantily clad picture of herself on Instagram for her 2.5 million followers captioned, ‘Got buffoons eatin’ my pu$$y while I watch cartoons.'”

Edelson posits that “Erika knows that public response to her posts is negative, but she is leveraging even the negative press to continue her career as a reality television star” — before accusing her of using her platform to “attack [the victims’] credibility and portray herself as the only true victim.” The law firm is requesting a trial by jury and an award of punitive or exemplary damages in an amount no less than $55,000,000. More victims of Girardi Keese continue to come forward.

So um thoughts? Could criminal charges follow?

    I hope she can be charged criminally as there aren’t enough assets left to pay the victims. It was all spent on people paid to blow smoke up her ass about how great she is, crappy hair extensions, c u next Tuesday necklaces, tacky makeup and more clothes than anyone could wear in a lifetime. So gross.

    We all knew she was being extremely stupid by continuing to film the show and try to lie her way out of her involvement. Looking forward to seeing her try to wiggle her way out of this one.

      I know right? I was watching her after the charges came out thinking to myself girl, what are you doing talking about legal stuff on a reality show?? Makes me think she is so over-the-top arrogant she probably insisted staying on TV against her attorneys advice.

        Arrogant is the word I’ve been trying to find to describe her – good call! I also think that she stayed on the show because she needs the money. Her main source of income (embezzlement) dried up and the show pays her pretty good.

    I keep thinking about the scene with Mauricio and PK. Maybe they can do a re-enactment for the jury. “He’s an attorney, not Pele … but fix the ankle” 🙄. The stoners could tell how ridiculous the story was!

    I kindof love this. She was so happy and excited that the original lawsuit (s) against her were “dismissed” – crowing about how she’s been exonerated – forgetting of course that it was just procedural and that the suit would be refiled in the proper jurisdiction. Glad to finally see this is back on track.

    and this lawsuit happened AFTER filming
    maybe bravo is filming this?? and if they arnt THEY SHOULD
    its a great lawsuiit we’ll see what happens

    I am at a loss …..those poor people swindled by these entitled jerks. I do hope Bravo starts cleaning up their acts and stops giving these liars and criminals and morally corrupt individuals a platform and a paycheck.

    TT, I am sending prayers and positive thoughts to you and Banjo. I feel so bad that you are having a bad time. I understand that darkness and it just decends on your soul like a vicious storm.

    Great write up Tamara. It is a long, detailed document of 64 pages or so and goes into great detail identifying checks paid to Tom, his firm for employee payroll and to EJ Global as well as 14 million in charges Erika’s Amex credit card all traced directly from the firm’s trust account for client settlement funds.

    The car accident story was so unbelievable and just plain stupid. Did she really think people would believe her especially after he was on camera not too long after the accident? I also love that you use the most unflattering photos of her hope you can find more

    I originally was thinking that MAYBE she did not know that Tom was doing anything wrong, so no criminal charges. it was her reprehensible behavior afterward that I find/found appalling.

    Then I started thinking … even IF she didn’t know Tom was ALLEGEDLY defrauding clients, SHE DID KNOW that using that Girardi Keese card to fund her crap is TAX FRAUD. And … you don’t want to fuck with the IRS.

      I.Am.Dying. Orange is the new Pink Latex!!! :))))) I really don’t understand why she would be filming videos of how Expensive it is to be her if she knew- It makes no sense to me. I do not doubt she is capable of what she is being charged with, but why bring attention to it by going on a major show? MAKE IT MAKE SENSE!!!!

    I really hope she gets charged or found guilty of some of these crimes. I don’t really want to see her serve jail time because I do not think that she committed the actual crime of theft. However I would like to see financial reparations be made in the form of selling some of her clothes, handbags, shoes, etc. That would be fair to me.

    Erika tried to fool everyone and claim total innocence and be the victim. I think in the beginning if she said “I had suspicions that something was wrong but I was scared to leave. I am going to sell XYZ or hand over some of my belongings to the court until this case is settled so the money can go to the victims.” Then she would have come out as the peoples champ on the high road. Hell she may not have been sued if she said that but her web of lies would never work in the age of social media.

    I know Erika was parroting the same talking points as Tom’s lawyers but for them to have the same new story on the same day shows a high likelihood of cooperation which could be corroborated. “The truth will set you free”

    Remember when Denise was dealing with child support drama with Charlie Sheen and Erika eagerly offered Tom up as a resource, even though Denise seemed keen to handle it outside of court? Certainly doesn’t mitigate the claims that Erika was somehow involved or an accessory to Tom’s crimes.

    The thing with civil trials versus criminals trials, a guilty verdict is easier to obtain in a civil trial for couple reasons: One of the most significant differences between civil and criminal cases is the standard of proof.

    For a defendant to be found guilty in a criminal case, the state must prove its case beyond a reasonable doubt. Even the slightest bit of uncertainty can prevent a guilty verdict. There are 12 jurors.
    In civil cases the punishment is generally financial, so there’s no risk that the defendant will be denied his or her liberty. That allows the court to lower the standard of proof necessary for the conviction to only “a preponderance of the evidence.” There are typically 6 jurors, but can be more depending on State requirements and case sensitivity.
    Pat The Puss could end up having to give up her baubles long before she has to worry about a criminal conviction and jail time.
