Two Dog Bite Cases Against Kim Richards Have Very Different Results

August 14, 2018 by tamaratattles 58 Comments

Kim Richard’s Twitter

Kim Richards dog bite cases are taking forever to work through the court system. Kyle just recently settled the most egregious of the numerous dog bite cases for an undermined amount. She was on the hook because she owns the apartment that Kim lives in. The horrific details of that case can be found here. It happened AFTER the case I am about to discuss. I believe this was the FIFTH dog bite. Kyle has to be pissed about this. Especially since Kingsley bit her kid.

Yesterday, this case was ruled on by a judge finally.  Here are the details of that case that I posted on June 3, 2015.

A fourth person has joined the list of people who are suing Kim Richards over a dog attack by Kingsley. Kelly Crossley has filed documents with the court, obtained by TamaraTattles.com that allege that on September 1, 2014 she visited Kim Richards house at the time of her visit Kim referred to Kingsley as “her dog;” however, after the attack, one of Kim’s lawyers sent a letter saying that the dog belonged to Monty Brinson.

The documents state that the plaintiffs were well aware the dog’s history of biting others unprovoked and that neither took any measures to keep the dog from biting again. She is suing for medical expenses including psychological expenses, general, specific and punitive damages.

She is also suing for loss of income as well as future loss of income and seems to indicate she has been unable to work since the incident due to the severity of her injuries which the document refers to as “grave bodily injuries ” resulting in “great physical and nervous pain and suffering.”

The suit is also asking for damages related to permanent physical disfigurement. They suit does not set a specific amount that they are seeking in damages. They are asking for a jury trial and estimate the trial will take about five days. I would think that a jury would be willing to award Crossley a lot more that Kay Rosario got from her trial by judge.  So far in this motion I have not seen any graphic photos like these from Kay’s attack included in the paperwork. The motion also gives no specific details of how exactly the attack occurred or her relationship with Kim and/or Monty.

Do you think Kim or Monty will respond to the suit? I expect that a default judgment will be filed after 30 days of the filing on June 2,2015.  Stay tuned.

Well I was right about the default judgement, but it took over three years for the victim to get an award. Kim never responded to the case at all. Last week a judge issued   a default judgment in the amount of $266,092.39, along with costs in the amount of $865.

Sadly, you can’t get blood from a turnip. As far as I know Kim is not working and her family is supporting her and paying her living expenses.

Damn, what a day this has been.

So will Kyle have to fork out the $266,957.39, or is Kim’s legal melodrama about to hit bankruptcy court next?

Kyle is not on the hook for this one. It happened at Kim’s house when she still had a house. I can’t recall if the homeowner was a defendant on this one I believe Kim was actually renting her house. So if the home owner was named they may be on the hook.

If the homeowner was foolish enough not to demand a renter have a renter’s insurance policy- then it would be on the homeowners insurance. And that policy and homeowner will be on the hook. Fortunately for the plaintiff. Again, Kim Richards skates free. The insurance company could sue KR, but with no $$$, what would be the point?

Doubtful the insurance carrier would pay. Most homeowner’s insurance has a “Canine Exclusion” clause (w/ pit bulls the top dog excluded from coverage). This is why most (informed) landlords will absolutely not allow pit bull type dogs. And homeowners with half a brain ditch the pit as well.

I don’t think Kim is communicating much with Kyle at least according to Kyle’s Instagram account.

Kim is mentally a five year old. I’m sure Kathy and Rick will be responsible for this.

I started thinking about this after I posted my initial comment. Generally Kyle’s been on the hook for Kim’s fuck-ups, but what if the last court filing was some kind of message that she’s done bailing Kim out? I still have a hard time seeing Kyle leaving Kim high and dry, but what if Kathy agrees to step in and save the day this time?

Whatever the case, it’s a very hard situation to be in. We want to help the ones we love, yet there come times when our “help” might actually do more harm in the long run.

Here here! I concur! And she is one bad dog owner who isn’t recognizing the training her dog needs! Or the dog owner responsibilities she needs to possess! I feel badly for that dog, because this situation is out of control and it’s the dog that will lose in the end. Comment from a Rottie owner who understand how to train and live with a big dog.

Also, I am perplexed by your last sentence. Banjo has me trained and I basically live with him. He made me walk him today and his 80 pound ass fell into a ditch that was obstructed by overgrowth. That was fun for one and all…

I feel your Banjo pain, Glorious Leader. Henry the Beagle not only has me trained, he’s given me some kind of canine-generated Stockholm Syndrome. Most of the time he is a) actively trying to murder me by nipping in front of my feet as I toddle down the stairs; b) actively trying to give me thrombosis by going into a visitor’s purse and removing and consuming 60 grams of cannabis edibles; or c) actively trying to stun me with his butt taser; but at all other times I worship at his velvet-earred altar. Plus he earned some jingle cake this summer when a video of him poaching my coffee went moderately viral (see Rumble’s “Beagle drinking owner’s coffee caught on hidden camera”). I am a responsible dog owner to Henry. I am also utterly in his nefarious thrall, as perhaps you are in Banjo’s.

TT – you got me good! I know it’s hear hear, and yet i think i was typing while thinking 3 or 4 sentences ahead, thus the error. Sorry about the ditch incident, that’s awful. With our dog being around 120 lbs, as you know with Banjo, it’s a matter of situational awareness and sometimes just common sense on behalf of the owner….neither ability KR seems to possess. And though we all feel as it it’s our dog’s world and we are just living in it, give yourself some credit, surely you have taught Banjo a thing or two. 🙂

Dogs and alcoholics are mix no better than guns and alcoholics. I recently moved from quarters with two dying alcoholics. Their dog bit 4 people. Courts only know about two. The dog is a GENTLE GIANT. He has bitten only when he thinks he is protecting those two wetbrains. They flap their arms around and act the fools and the dog is confused. A friend who trained military canines tested him and said he is one of the smartest he’s seen. What a waste. The dog deserves better.

dog’s read and work off energy, as we all know, they sense when you’re scared, authoritative, anxious, sick, fearful, happy, all that. They do not like it when you’re chaotic, and addicts/alcoholics give off precisely that vibe. I know, because my dog steered clear of me when I was still using and would be sedated out of my mind. He gave me a wide berth and did not want to obey me. they know, he knew I was not myself. Yet that was different from when I was sober and just anxious or scared, then he knew to stay close to me and comfort. they are such wonderful little creatures.

they do deserve better than owners with substance abuse problems, but thankfully mine has forgiven me for that time and now has a sober mama for 6+ years lol

Kim is a tornado of chaos, even having sent Kingsley to obedience school it won’t matter if the person in charge of the dog does not maintain the standards and the training taught by the school. The dog responds to her, it’s no surprise the poor thing has lashed out and attacked so often, it knows nothing but chaos and instability.

The dog is suffering, and innocent people have suffered attacks, because Kim will not get her shit together and her family refuses to stop enabling. Saving her from consequences is not help, much as their intentions may be good.

To DalaiMama and Shea: How wonderful is it that Shae’s dog was so loyal and so smart. My dog is an important part of my continued sobriety and reason to live. The alcoholics I lived with were MEAN AND TOXIC, not just a sad mess. I wonder if my hero, Brandon McMillan (CBS Lucky Dog) could work his magic on Kingsley. I would like to know when or if he ever has had to make THAT AWFUL DECISION. As Alison pointed out, there is a time when a human life takes precedence, but I think in the case if the dog we lived with, just getting him away from chaos could work. Kingsley SEEMS so sweet at times. And then …

Animal owners are supposed to love and take care of their animals…What I don’t understand from certain animal lovers is: some of you seem to put the welfare and safe-keeping of your animal ahead of the welfare and safe-keeping of humans! I don’t care how much you love your animal, or how much a part of your family it is…If you have a vicious dog, YOU know it..do not then make excuses for it!…this woman knows her dog is vicious(no matter how it got that way), so to then allow it to be around other humans is criminal. Any animal has the potential to hurt, so put it in another room and shut the door when people it is unfamiliar with come over! Do we have to hear on the news again how these vicious dogs kill innocent people! And in case you’re wondering: I am a dog owner and lover, but NO animal life is more precious than an innocent human life.

I don’t have much experience with dogs and I definitely don’t know how to train one but I was scared of her dog when he was on the show. He seemed very aggressive and she would allow him to be the leader of the pack. I assume, with a bully breed, you have to control all situations and be the one in charge. Clearly, that is not Kim.

This dog should be put down. He’s bitten several people. He’s aggressive, and there is no excuse for not euthanizing him. I don’t give a shit about whose responsibility it is to ensure he is trained when it comes to making a decision on whether this dog should live or die. The fact is that he’s dangerous and shouldn’t be allowed to live one more day because he may just kill someone during his next attack.

Is it the dog’s fault? No, it’s Kim’s, but that doesn’t change what needs to be done. Kim should be punished for allowing her dog to attack others. The very first punishment should be having the dog removed from her home. If there was a way to bar her from owning any more animals, it should apply to Kim.

I pray she never has a small child around this dog. If the dog injures or kills a child, both Kim and the city should be held legally responsible for not immediately euthanizing the animal. I’m baffled as to why he is still alive.

Potentially dangerous dogs like Kingsley do not belong with people like Kim. It’s a shame he couldn’t stay with the dog handler or be re-homed to people who would actually keep up with his training. She relied on the dog as an emotional crutch, let him think he’s boss and this is the result. I feel sorry for the Kingsley who didn’t know any better and the poor people that suffered due to her irresponsibility. As uncaring as it sounds I hope the award stands, she’s not allowed to wriggle out of it by claiming bankruptcy and they take every last cent owed to them, regardless of whatever financial mess she’s got herself into… sell any assets she has if need be. She’s been given every opportunity to act like a responsible adult and can’t continue to bury her head in the sand or blame her shit on her past or Kyle.

In the county I lived it was USUALLY three strikes, you’re out. They WOULD examine each case — if your dog bit a person trying to rape you, if your dog bit a burglar who entered your home, etc. The animal control officer said that with chips, it is easier to keep track of a dog’s “criminal record.” They automatically pick them up and “jail” them after the first incident. It cost my former friend a $1,500 fine to get him out of the pound and $500 for the next three years for license and admin. fees. She was required to attend a dog obedience class for $100. AC put up a sign “Potentially dangerous dog” in the front yard, he must be muzzled at all times outdoors, even in his fenced yard. Animal control came out twice before they allowed him back to ensure the fence was secure and high enough. And guess what? Our former neighbors said the dog escapes from THE SAME HOLE in the fence several times a week, then sneaks back in. And she never completed the class. She is in contempt of court and I have a mind to go and rehome the dog — but the dog loves her. Aminal control promised me they will not put him down automatically, but I wish they would JAIL THE OWNERS FOR CONTEMPT.
