Since Luann got out of rehab, she has done a ton of things. She’s filmed with RHONY and finally made it to South America, she she’s done her cabaret show, she’s released a song with James Kennedy, she’s gotten a new boyfriend, she’s been sued by her family, and she’s relapsed and gone back to rehab.
As soon as she was out of rehab her attorney moved forward with a plea deal. The Florida state attorney declined to prosecute two counts of corruption by threat and battery on a law enforcement officer that the arresting officer initially charged her with. She was then formally charged with resisting an officer with violence, trespassing an occupied structure and disorderly intoxication. The first charge is a felony and the other two are misdemeanors. This was a step in the right direction.
The plea deal has her pleading guilty to one of the misdemeanors, I’d presume it is the disorderly intoxication charge although Duncan didn’t specify. The other charges will be dropped.
But here is the interesting part. On July 25th, Duncan will appear in court on Luann’s behalf to officially enter the plea. Then the judge will WITHHOLD ADJUDICATION of the charges. This basically means that she will not be convicted on the misdemeanor charge either. She will be put on probation and as long as she keeps her nose clean, she will have no convictions on her record and the entire thing will be forgotten about.
Today TMZ is reporting that she’ll be placed on probation for a year. She’ll have to complete 50 hours of community service and attend two AA meetings a week in NY, where she lives. Luann cannot consume alcohol or drugs and must submit to random testing. She also had to write an apology letter to the cop she hit. This is a bit weird since her court date was not supposed to be until Wednesday. Supposedly, the judge had not signed off on it yet. But everything seems to be going according to plan.
I wonder if her family tried to resolve this situation before actually sueing her. Money can change the love in a family to greed quickly. On all sides
Well, at least Luann has been forthcoming about her fuck-up here. I give her props for that, and props for being so brutally honest about relapsing this summer and returning to rehab. (Thank goodness she didn’t try the typical Hollywood “exhaustion” cop-out.)
Here’s to Luann’s recovery. Recovery isn’t always linear, and it certainly isn’t easy, but I really do wish her all the best.
It was brave of her to admit to a problem and go back to rehab, when this was still pending. She has been very courageous and optimistic, while under a lot of pressure. Being sued by one’s children has got to be devastating. I hope her family is there for her through her recovery process. Imo, Lu needs their love more than she needs any new boyfriend.
I’m pulling for Luann, and I give her praise that the showed responsibility by going to rehab initially and now this second time. But I just want to point out that her most recent relapse was not caused by her family suing her–she was publicly drunk and caused a scene at a party in the Hamptons a couple of weeks before the suit was filed. Many of the comments on previous posts seem to imply that her relapse was caused by her trying to cope with her family suing her. Maybe the suit made it worse, but she had already resumed drinking too much.
It is very rare to get clean with one rehab visit. The percentage of addicts (yes she is.considered an addict) that get and stay clean is somewhere around 5%. She has taken a very great fall from a very high place and would be surprised if she got clean in one visit. Going back, along with the tremendous amount of humility and honesty she has shown tell me she is very serious and knows what she has to do and how to do it. The mandatory meetings are a Godsend. My personal physician went through rehab 9 times and now heads up a major rehab center as well as is very active in the metropolitan AA area. Terry worked at a rehab for years and drew the analogy of the Japanese in WWII-you have to surrender to win. My money is on Luann.

Relapsing is part of recovery and I wish Lu the best, whatever is going on with the family has to be painful and stressful. Filming with crazy ladies without alcohol has got to be stressful as well. So glad the judge was not all “uncool” lol

It’s not unusual for a settlement to be reached before the court date. Also on the day of court before going before the judge. I hope she keeps going forward. As long as it takes.
She is supposed to be performing on Aug 4 in Huntington NY. I have tickets and they have yet to cancel the show. Is she checking herself out in time to perform??
Wow Laureen, lets hope Lu gets out just for you. Would hate to see you lose money because she has returned to rehab to work on herself.
Well…ok…I guess this means a COMPLETE end to her drinking in public or on camera. This plea deal will totally affect her ‘job’ on RHONY!

Whoa! As someone who’s seen many, many dispositions on felony cases (not as an attorney), I have to say she got off really easily compared to what could have happened. Then again, she’s not a career criminal and was definitely acting out of character that night. Hope she realizes what a break she got and makes the most of it. Always Team Luann!
When we say “relapse,” did she ACTUALLY relapse or did she feel that she might and just check herself back in? I feel like there’s a difference.
