There was a very interesting AP report today concerning Joe Giudice and his future release from prison. The big news is that ICE has already placed a detainer on him and they will be deporting him to Italy.
The rest of the news all is the result of that retainer. Here is what I said about the retainer and how it effects his RDAP program in a very lengthy post on the subject you can read here.
So, to summarize, Joe could well get into the RDAP despite his illegal status in the country as a non-citizen; however, the only result of that would be to move him into an ICE facility a year earlier. It’s still a good gig for him if he can get it with regard to moving out of prison sooner, but most likely he will be spend at least a couple of years awaiting deportation in an immigration detention facility. If he gets lucky, and is admitted into RDAP, and earns all his good time his release date will be 3/14/18. That’s a week short of two years.And then, he will be in the deportation center for most likely at least that long, in which case it highly likely that the next time he is a free man will be no earlier than 2020 and he will be in Italy when it happens with no possibility for a visa to return.

He is not going to win a challenge against ICE. He will likely spend at LEAST two years in civil detainment. Then he will eventually be deported to Italy no earlier than 2021 and will not be allowed to return to the United States.
This explains the rumors that Teresa is ready to divorce Joe. Teresa has publicly denied the latest divorce rumors but this make divorce a much more likely option. I do not see Teresa taking the kids and moving to Italy.

My heart is breaking for his girls, who didn’t do anything wrong in all of this, but will be paying the biggest price for it.

Very sad for the girls. Gabriella seemed so close to him while Teresa served her time. She was the tomboy of the bunch, playing a lot of soccer. I feel bad for his Mother as well.

I could not agree with you more! These 2 thought they were smarter than “the average individual”. When they got caught I truly believe it truly affected Teresa as she had absolutely no way to influence the Judge or the final decision on their punishment. These 2 FELONS should have thought of their children before they committed their crimes and not use them now as a shield, a reason why their punishment should not be “harsh” i.e. deportment to Italy. Hell, Teresa is always going on and on about how “us Italians” are the best at everything, she should be over the moon to going home. Have you ever listened to her massacre the Italian language? My heart goes out to this family. This is one pardon I would like to see happen. This is the only home the children know. I do not want this family to suffer anymore. They have paid over and over again. Dear lord keep this family together.
How have they paid “over and over” exactly? Joe and Teresa defrauded innocent people out of millions, none of which, to my understanding, has been paid back. On top of that, they committed fraud against the federal government and both are convicted felons. The court gave them a GIFT by letting them serve their sentences consecutively rather than concurrently.
Now Joe will be very justly deported. He committed a felony as a non-citizen. He doesn’t get the privilege of staying here. Yes, I’m sorry for their girls but Joe and Teresa should have thought of them before deciding to commit multiple felonies. The girls don’t deserve it, but Joe and Teresa deserve every bit of punishment they have received and will receive in the future.

Anchor babies are not a real thing. Joe is not entitled to apply for any kind of immigration status from his marriage or otherwise because of his multiple convictions. Or rather, he would have to disclose them on the application which would then be denied because of them.
If he had followed the laws of this country this would not be happening.
Joe had 28 years to become a US citizen. He is an Italian citizen that chose to not follow the laws in the US.
I support a more liberal immigration policy than Trump however, if an immigrant breaks our laws they should immediately be deported and never allowed in again. Period.

Marrying a US citizen isn’t an automatic thing anymore. That changed a while back. He could have applied for citizenship or naturalization (whatever it’s called) when he became 18. He was only a baby when his parents moved to the US. His brother became a US citizen. It doesn’t surprise me because it seems like a typical Joe move. He doesn’t take things seriously and puts things off. It’s not in a mean way, more of a stupid way, that the details aren’t important to him. Well it’s now caught up with him. Teresa was too ignorant to care about what she was signing. And their families are paying the price for it. The stress pretty much killed Joe’s father and Teresa’s mother. I can’t even begin to image what their girls are going through. Especially Gia. She had to take on the mother role while Teresa was in jail. She had to keep things together while dealing with a drunk father. I know Joe and Teresa did this to themselves, but I really hope this is their wake up call to turn things around.

They are not. DACA is still in effect for 6 months while Congress gets off its ass and comes up with a path to legalization for them.

The Giudice kids do not need DACA they are American citizens.
DACA doesn’t apply to any of these kids because they were born in America.
“dreamers” are kids who are foreign born, but were brought here as very young children by undocumented parents.
Teresa is a citizen, all her kids are natural born, American citizens, DACA won’t affect them.
Cheychey wasn’t saying that DACA would apply to any Giudices, only that it would be unfair to give them special treatment when the dreamers are facing very likely and unfair deportation.

Because they reoffend before they get 5 miles from where they were incarcerated.

What’s with the deportation centres? Can’t he just serve his time in jail and then get sent back home? It seem’s like an unnecessary step. Why keep him locked up and fed and watered?

Me either. Why can’t he self-deport? I can’t imagine that he would find any other Italian citizens in the deportation center. Teresa and Joe both speak the language and they have family in Italy so going back there does not seem like a horrible fate to me. I’d like to see Teresa woman-up and stand by her man but who knows?
There are over half a million people in line to be deported with only a couple hundred immigration judges. So it takes around two years to get your trial on the docket. In addition, the country taking the felon back, in this case Italy, has to agree to take them.
Joe could sign away his right to a hearing and just agree to the deportation, but it is unlikely he will do that. Though I think he should. So if he doesn’t sign away his rights, he will spend a couple of years in a detention center that is much, much,much worse that were he is living now.

all of joe’s family are citizens. for some reason, joe never became a citizen (not sure just why though?) he had to have know that he wasnt a citizen. remember when they went to the dominican republic and italy? he would have had to travel with an italian passport.

He’s receiving his punishment and rightfully so, if he’s deported as a consequence then c’est la vie. He should count himself lucky he’s being sent to a beautiful country such as Italy, many are deported to far worse places. I’m confused as to why so many people are so gleeful at this prospect though? A family being potentially split up isn’t something to celebrate. Unlike his wife he has actually showed some sort of remorse and his it’s evident his daughters cherish him.
Their family will only be split up if the parents choose for them to be split up. Joe being deported won’t split the family unless Teresa chooses to stay here. Bad choices have consequences. It’s time for Joe and Teresa to face theirs.
