Joe Giudice Lost Two Legal Battles In New Jersey Courtroom Today

Jailbird JuicyThere was a very interesting AP report today concerning Joe Giudice and his future release from prison. The big news is that ICE has already placed a detainer on him and they will be deporting him to Italy.

The rest of the news all is the result of that retainer. Here is what I said about the retainer and how it effects his RDAP program in a very lengthy post on the subject you can read here. 

So, to summarize,  Joe could well get into the RDAP despite his illegal status in the country as a non-citizen; however, the only result of that would be to move him into an ICE facility a year earlier. It’s still a good gig for him if he can get it with regard to moving out of prison sooner, but most likely he will be spend at least a couple of years awaiting deportation in an immigration detention facility.  If he gets lucky, and is admitted into RDAP, and earns all his good time his release date will be 3/14/18.  That’s a week short of two years.
And then, he will be in the deportation center for most likely at least that long, in which case it highly likely that the next time he is a free man will be no earlier than 2020 and he will be in Italy when it happens with no possibility for a visa to return.

Lawyers for Joe were in court today arguing that Fort Dix is excluding him for the RDAP program which now pushes his release date out a year father to 3/14/19.  Their motion also claimed that the prison is preventing him from fighting his scheduled deportation. The prison does not allow inmates to appear before immigration judges. According to the court document, other federal prisons allow inmates to challenge their deportations. The earliest he will be able to challenge the order is after his release to ICE in 2019. This is a problem because it takes years to challenge the detainer and his attorneys want to go ahead and get started on that.
He is not going to win a challenge against ICE. He will likely spend at LEAST two years in civil detainment. Then he will eventually be deported to Italy no earlier than 2021 and will not be allowed to return to the United States.
This explains the rumors that Teresa is ready to divorce Joe. Teresa has publicly denied the latest divorce rumors but this make divorce a much more likely option. I do not see Teresa taking the kids and moving to Italy.

        He pardoned Sheriff Joe before he did time. Normally a pardon happens after a person is in prison doing time.
        Teresa absolutely should ask, possibly Joes only chance. Everything is so ass backwards something like this does not even matter anymore.
        I don’t care where Joe goes, however to be fair he should be deported.
        The girls can visit him there or not.

      Why should Joe be exempt because his wife was on a stupid TV show? Trump is actually pushing for non citizen criminals to leave the country. Terrible the damage these two did to their families. Too bad the kids have to pay the price.

    I really feel for his daughters who love him so much especially Milana ( even though he verbally abused Teresa & Gia ON CAMERA) & was drunk or just didn’t give a shit about American laws. I still believe that even if he was allowed to stay, he would commit the same crimes again. He doesn’t care & he never admitted to doing anything wrong during the airing of any seasons of #RHONJ. His stock answer to everything was “Whatever” or “Shut-up, Don’t worry about it” #ByeJoe #FelonsByBravo

    Very sad for the girls. Gabriella seemed so close to him while Teresa served her time. She was the tomboy of the bunch, playing a lot of soccer. I feel bad for his Mother as well.

      I could not agree with you more! These 2 thought they were smarter than “the average individual”. When they got caught I truly believe it truly affected Teresa as she had absolutely no way to influence the Judge or the final decision on their punishment. These 2 FELONS should have thought of their children before they committed their crimes and not use them now as a shield, a reason why their punishment should not be “harsh” i.e. deportment to Italy. Hell, Teresa is always going on and on about how “us Italians” are the best at everything, she should be over the moon to going home. Have you ever listened to her massacre the Italian language? Sad really but if marriage is a sacred commitment as she says it is then she should stand behind her man and get ready to move the marble mausoleum to Italy. get ready Tre, your days on RHWONJ are numbered YEA!!!!!!!!!!!!!

    My heart goes out to this family. This is one pardon I would like to see happen. This is the only home the children know. I do not want this family to suffer anymore. They have paid over and over again. Dear lord keep this family together.

      How have they paid “over and over” exactly? Joe and Teresa defrauded innocent people out of millions, none of which, to my understanding, has been paid back. On top of that, they committed fraud against the federal government and both are convicted felons. The court gave them a GIFT by letting them serve their sentences consecutively rather than concurrently.

      Now Joe will be very justly deported. He committed a felony as a non-citizen. He doesn’t get the privilege of staying here. Yes, I’m sorry for their girls but Joe and Teresa should have thought of them before deciding to commit multiple felonies. The girls don’t deserve it, but Joe and Teresa deserve every bit of punishment they have received and will receive in the future.

        Not only did Teresa not learn her lesson, she has refused to accept one IOTA of responsibility, and she’s passing her ‘values’ to her girls.

        Although her daughters will miss their father, him being gone is one less bad influence.

        100%. I feel terribly for these kids, they’re in a horrible position now, but their father is a fking moron, as is their mother, and they were already given a huge gift by being allowed to serve their sentences apart rather than simultaneously. They show no remorse or acknowledgment. His ass should be deported.

        My thoughts exactly. Joe was too arrogant and Teresa too stupid to realize that yes, they would get caught and their family would pay the price. I think Teresa will divorce Joe too and immediately hook up with a guy with a few coins so she can live her old lifestyle again

    Is Teresa not a US citizen either? Wtf?! And wouldn’t having American born children allow them all to stay in the US? It seems extremely cruel for our government to force legal residents to split up or move to another country. Although Italy looks totally fab.

    Having said that, I’m all for deporting the entire Giudice clan. They’re just gross.

      Anchor babies are not a real thing. Joe is not entitled to apply for any kind of immigration status from his marriage or otherwise because of his multiple convictions. Or rather, he would have to disclose them on the application which would then be denied because of them.

    Joe had 28 years to become a US citizen. He is an Italian citizen that chose to not follow the laws in the US.

    I support a more liberal immigration policy than Trump however, if an immigrant breaks our laws they should immediately be deported and never allowed in again. Period.

      Marrying a US citizen isn’t an automatic thing anymore. That changed a while back. He could have applied for citizenship or naturalization (whatever it’s called) when he became 18. He was only a baby when his parents moved to the US. His brother became a US citizen. It doesn’t surprise me because it seems like a typical Joe move. He doesn’t take things seriously and puts things off. It’s not in a mean way, more of a stupid way, that the details aren’t important to him. Well it’s now caught up with him. Teresa was too ignorant to care about what she was signing. And their families are paying the price for it. The stress pretty much killed Joe’s father and Teresa’s mother. I can’t even begin to image what their girls are going through. Especially Gia. She had to take on the mother role while Teresa was in jail. She had to keep things together while dealing with a drunk father. I know Joe and Teresa did this to themselves, but I really hope this is their wake up call to turn things around.

    I do feel very sad for the kids but that’s it. He is a criminal. There are kids in school and college about to be deported out of this country who have never done anything wrong and most likely don’t even remember their home country they’ve been here so long. So no I don’t feel like any pardon or easy treatment for Joe is warranted.

      They are not. DACA is still in effect for 6 months while Congress gets off its ass and comes up with a path to legalization for them.

      However, criminals should be exempt, so no pardon for the Juicey.

      DACA doesn’t apply to any of these kids because they were born in America.

      “dreamers” are kids who are foreign born, but were brought here as very young children by undocumented parents.

      Teresa is a citizen, all her kids are natural born, American citizens, DACA won’t affect them.

    The sad thing for the kids is that they’ve got sleazy parents. And if the parents get away with it, that will be what the kids learn from it. Those kids lives have been padded and spoiled off the backs of innocent people who doubtfully could provide as much for their own children. Don’t we have enough home grown felons without keeping the ones that don’t belong here? The Governor of California today (Governor Jerry Brown, Gov. Moonbeam, as he’s called) put out an edict that said illegal alien prisoners let out of prison (who can only be there for violent crimes now) will be released and not deported. Let out to victimize more innocent people. The precinct in L.A. with the largest recidivism on burglary is the one closest to the jail. Why? Because they reoffend before they get 5 miles from where they were incarcerated.

      I live in a California county with a very large Latin community, majority now, yet our sheriff does turn undocumented felons over to ICE.
      They are trying to oust him from office and turn the county in to DACA sanctuary county. /sigh

    What’s with the deportation centres? Can’t he just serve his time in jail and then get sent back home? It seem’s like an unnecessary step. Why keep him locked up and fed and watered?

      Me either. Why can’t he self-deport? I can’t imagine that he would find any other Italian citizens in the deportation center. Teresa and Joe both speak the language and they have family in Italy so going back there does not seem like a horrible fate to me. I’d like to see Teresa woman-up and stand by her man but who knows?

        There are over half a million people in line to be deported with only a couple hundred immigration judges. So it takes around two years to get your trial on the docket. In addition, the country taking the felon back, in this case Italy, has to agree to take them.

        Joe could sign away his right to a hearing and just agree to the deportation, but it is unlikely he will do that. Though I think he should. So if he doesn’t sign away his rights, he will spend a couple of years in a detention center that is much, much,much worse that were he is living now.

I do not feel sorry for the kids … unrealistic expectations have been set for them … last season when the 2nd daughter was wearing braces I was just enraged! Pay your debts ya bums and bravo stop paying felons.

        TT, Joe is too old for DACA but it has nothing to do with “Obama not being president when Joe was two”. Any individual born after June 15, 1981 is within—and shall remain within—DACA’s age requirements. Only individuals who were 31 years old or older on June 15, 2012 are ineligible for DACA. Joe was born in 1972. Obama was inaugurated on January 20, 2009.

    Just out of curiosity, are all of Joe’s siblings and mother non-Us Citizens as well, despite the fact they’ve been living in the US for over 40 years? I know they moved here when he was very little, still don’t get why he didn’t take his citizen exam, but then again the Guidices aren’t the brightest bulbs. I feel for their daughters, it’s not their fault their parents are criminals and screw ups. Of all places to be deported to, he’s incredibly lucky it’s freaking Italy. He’s not being sent back to a worn torn, third world country. I have strange a feeling he will thrive there, despite not being able to return to the US if the court rules in that direction.

      all of joe’s family are citizens. for some reason, joe never became a citizen (not sure just why though?) he had to have know that he wasnt a citizen. remember when they went to the dominican republic and italy? he would have had to travel with an italian passport.

    He’s receiving his punishment and rightfully so, if he’s deported as a consequence then c’est la vie. He should count himself lucky he’s being sent to a beautiful country such as Italy, many are deported to far worse places. I’m confused as to why so many people are so gleeful at this prospect though? A family being potentially split up isn’t something to celebrate. Unlike his wife he has actually showed some sort of remorse and his it’s evident his daughters cherish him.

      Their family will only be split up if the parents choose for them to be split up. Joe being deported won’t split the family unless Teresa chooses to stay here. Bad choices have consequences. It’s time for Joe and Teresa to face theirs.

    Awww, I feel sorry for our Almost-all-American, mafia-type Italian thug we all know and love. If he was Tony Soprano somebody would do sumpin. I mean America seems to elevate these creatures. Part Italian Robert De Niro was bestowed honorary Italian citizenship just because he plays a mean mutha Italian in the Godfather, Goodfellas and he has Italian blood.     What aggravates me the most is despite all the money they stole and fraud they committed, she and the kids still have a very lucrative lifestyle. Its not right at all, I work my butt off and don’t steal but never could I afford to live like them.
