UPDATED! FOUR MONTHS LATER…. TMZ figures out Phaedra is not divorced. How long until they realize Apollo is now the petitioner? PLEASE NOTE THIS POST WAS WRITTEN ON DECEMBER 10, 2016
TMZ keeps running these crazy stories about Phaedra Parks divorce being final. Once again they are running a story about the divorce saying that Apollo is filing his own petition because of “spelling errors” in the one Phaedra filed. This is just more bullshit being fed to TMZ to publicize a sham storyline on RHOA that has been going on for at least two seasons.
When you file for divorce in Georgia, that filing is public record. Even if there was some pressing need for the proceedings to be sealed, which there is not in this case, the actual notice of filing, at the very least would be verifiable. Numerous times over the past year or two I have spoken with local Atlanta journalists and bloggers as we tried in vain to local a petition to divorce filing by either party in the marriage. We have not. There are also tabloid sites out there who would pay for a copy of the public records, yet no one cashed in. Any site that has the filing, would likely post of copy of the court documents with their reports, but TMZ never did. Not one of my legal sources, nor those of others sites I find credible had any evidence of a divorce petition being filed. Nothing. Zero. Zilch.
Until today. @Atlien the owner of Straight From the A was tipped off by one of her sources on what is really going on. She has all the receipts. And it’s very intriguing. And complicated. So put on your thinking caps and grab a snack.
It seems that Phaedra may have committed perjury in her divorce petition. You see, the issue is more than misspelling her legal last name as “Nita” she did not use their legal names as they appear on the marriage certificate in the divorce. This is why no one could find the documents. She petitioned as “P. Creonta Nita” and listed Apollo as “A. Edward Nita.” It seems obvious that she used those names to hide the proceedings from the media. However, presenting false information in any document sworn to under oath constitutes perjury. The state of Georgia requires that all initial divorce complaints be verified by the person filing for divorce. The verification is a document attached to the pleadings in which you swear under oath that the statements in the complaint are true, and it must be notarized. Whenever you sign something before a notary, you are swearing under oath that your statements are true. If you sign a financial declaration or affidavit that contains false information, you are committing perjury.
Then things become a bit murky for me. It seems that she took those forms and presented them to a judge and managed to have them sealed. Then she started saying she was divorced. But she was not divorced. There was a proceeding that Apollo was never notified about and it appears that the second to last false TMZ story about Apollo being divorced caused him to contacts some lawyers who were located for him by his future prison bride. Those lawyers investigated the situation in Atlanta and discovered Phaedra’s deceptions. At that time the documents were unsealed and a judge told Phaedra she would need to refile, on the public record, using the actual legal names.
After that happened Apollo had already filed with the proper legal names. So now he is the official petitioner for the divorce and Phaedra is the respondent.
So problem solved, right? Nope. This is Phaedra we are talking about here. According to the SFTA source, five days ago, on December 5th, Phaedra tried to file the documents with the aliases, I suppose with another judge, to have a final divorce decree declared. Even though it is not legal. That has since been overturned.
So Apollo’s properly filed documents will be the legal documents in play. And he will now have the opportunity to plead his case, particularly with regard to custody.
It looks to me that Phaedra was trying to keep Apollo from having a voice in the proceedings so that he could be seen as a father who had walked away from his family. It seems like Phaedra wanted strip Apollo of any rights to the kids. Now it will be a fair fight.
So for all of the idiots saying that I should have written some sort of “retraction” about my constant and consistent refrain that Phaedra is not divorced because of something they read at TMZ. I suggest you work on your critical thinking skills and learn how to vet sources. And always get your information from the person with the full documents. Which is why you should skip right over to SFTA and read the original information. Or you could continue to believe the wild stories Phaedra plants on the Internet. Like this one. I must admit they are hilarious.
Phaedra Parks is NOT divorced. And there would have been a lot less reporting on this if she had done a straight forward filing. But she didn’t. I wonder what she is worried that Apollo might spill in court? Could it have something to do with this case?
