Judge Sentences Kim Richards in Beverly Hills Hotel Case

Today was the final day for Kim Richards attorney and the prosecuting attorney to agree on a plea deal. Since Kim rejected the deal due to the community labor requirement, the judge ruled today siding with the prosecution’s offer.

Kim was charged with  four misdemeanor charges of trespass, resisting arrest, battery on a police officer and public drunk.  The judge sentenced Kim to never to return to the Beverly Hills Hotel or within a hundred yards of the hotel, serve three  years probation, attend fifty-two alcoholics anonymous meetings within one year, and complete THIRTY  days of community labor.

The judge was clearly saying that the thirty days of labor was important so that she would actually have some consequences.

The only thing about this decision is I don’t expect her to actually complete the requirements. That would violate her probation and quite possibly locked up for violating.

This still isn’t over. She still has to be sentenced for her Target shoplifting.

Those tweeting from the courtroom said that Kim was late to court.

Update:  Kim Richards was more than late to court, she was not there at all.  Also since the Target charges Kim has hired a new attorney, Sara Caplan, who has taken over both cases. Caplan is a very prominent attorney in L.A., but she is best know for the Phil Spector trial where she represented him on murder charges and was also required to take the stand herself. Some people thought she was withhold information from the court.

I also found out as part of the deal, the public intoxication and assaulting a police officer charges were “dropped” essentially leaving only the resisting arrest charge on her record.

UPDATE 2:

One more thing,  Kim was ordered to pay restitution to “the victim” (would that be the hotel? if I recall correctly there was some damage to the bathroom door).  A December 14 restitution hearing was set where she must also provide  a status report from a physician regarding the foot injury.

    I have the feeling that she will take the Lindsey Lohan approach….complete it when she gets good and ready. Lindsey had multiple times before a judge and was able to string the completion of her “sentence” out for a very long time and never suffered any actual consequences. I hate to say it, but the judge did not do Kim any favors by imposing such a light sentence. Hopefully, the judge for the Target case will be a bit more heavy handed, but since it involves a “celebrity” and is in California, I highly doubt it.

    I think it’s a fair sentence for a first time offender. I don’t think Kim sees it that way though. She sees herself as a victim and probably feels she it’s an unjust sentence due to her “celebrity”. Maybe she just thinks it’s all Lisa Rinna’s fault. I do not think it will be long until she breaks the terms.

        Sorry to be ignorant, but the charge refers to being publicly drunk and no mention of drug abuse, from what Tamara wrote here. So I didn’t know if drug tests would be part of the consequences when she wasn’t charged with a specific drug-related charge.

      let us hope it does include random drug testing; before she gets in a car and kills someone.
      what really bothers me; although I do not condone stealing, is if that was some poor person
      stealing food for their children, their butt would be in prison, and their kids in the system.
      so much wrong with all of this. it makes my heart hurt.

        She tested positive for an inhalant so probably drug tests (in CA? in Florida probation=at minimum random drug tests)

        I live in Florida and have been on probation for DUI and had no drug testing because it was an alcohol offense not drug. Probation laws depend on the jurisdiction and the charge(s). I will entrust TT to find out the truth behind any probation.

    She will drag this out as long as possible and then end up with a dirty ua and be thrown in jail. This may end up being her rock bottom, i really hope it is for her sake.

    Hopefully she realizes this is a chance to turn things around, especially if she keeps being followed by TMZ to keep her accountable.

    If Bravo won’t take her back, or follow her through the therapeutic corrections process like Theresa Guidice on RHONJ, then maybe Arnold Schwartzenegger could give her a job on the new westcoast Celebrity Apprentice. Her charity could be a favorite rehab or women’s rescue center. She really could turn it around if she wanted to, committed to a program and Monty wasn’t her only agent.

    I totally agree that the community LABOR is the am extremely important part of this sentence. She needs to come down off of her high horse big time. That ego and false pride is going to kill her. I would imagine in kim’s head, doing community labor is almost as bad as a jail sentence. Of course, as you said Tamara, I would be shocked if she is able to compete any of this. You can’t be an hour late for an aa meeting, because they only last an hour, so that’s not gonna work for her. Of course she can just forge the aa signatures, etc., but where she’s really gonna be screwed is the random drug tests, and even just making it to her probation appointments. I hope that they have her going into the office every week, or every two weeks at the least. Time will tell, but as Dr. Phil (our fave – wink wink) says… “The best predictor of future behavior is past behavior”. Wishing her well and as always, hoping that her “enough is enough moment”, whether it be internal (within herself) or external (through the courts not taking ANY crap) finally arrives. I’m sure it will be the latter. Whatever it takes.

    Oh boy, Kim’s family or attorney pulled in favors on her sentencing. Kim not being in court for sentencing and her not being held in contempt is a biggie.

    52 meetings (1 hr.) is nothing, she could be done with those in under 14 days or less.
    30 hours service is two weekends.
    The biggie is the hotel not wanting Kim around.
    Kim has a year to complete this stuff, she will do it IF she stays out of trouble.

      I don’t think she HAS to be there. The 52 meetings are once a week for a year. Community Labor is often in four hour increments because it’s working outside usually and because they don’t want to do a lunch break.

      The hotel not allowing her back is nothing. I’m interested to find out how much her restitution will be.

        Wow, ok!
        I assumed since Kim said she felt like that Hotel lounge was like her home she would miss it.

        Out here service is done at parks, non- profits or county offices. Mostly it is 8 hours and lunch is counted as time. Mostly it’s everyday people who are rather sympathetic that you report to.

    I am truly scared for Kim. I know she is a grown woman etc but we don’t really know her foundation (how she was brought up) ,what coping skills she has. I want her to be the cone back story, and kick ass. Maybe I am stupid but I feel until there is absolutely no hope, there is a way. Except when it comes to My Little Pony,# throwing female, and a non taxpaying ,put shit in others names bitch. I am closed minded when it comes to them 2.

    I think because technically she was only being sentenced for resisting arrest that drug and alcohol testing would not apply. But that line of thinking would apply to the AA meetings too. So I don’t know. I read the requirements, right down to the usual “obey all laws” stuff and there was nothing in there about random drug testing.

    I assume her probation officer could require it at some future point? I think people on probation can drink unless the court specifically says otherwise.

      I think it could involve an “obey all laws” check – illegal to take drugs without a prescription, so check to see if she is doing so? That is all I can think of…

      TT, I agree with you about Kim not being tested.

      Most lower level misdemeanors probation (Calif) you don’t have a probation officer, only the judge. I think the DA’s office is the judges eyes.
      Three years probation will be a long time for a addict.

      The resisting charge will work against Kim in her next case, it is no longer her 1st offense.

      You’re right, TT. If her case wasn’t drug related, there won’t be random tests.

      At least here in FL, if, for example, I am on probation for Car Theft, they are not going to spend the time and precious resources (tax dollars), drug testing me when I wasn’t in trouble for drugs in the first place.

      The “obey all laws” thing just means “don’t get arrested again or else you’re in bigger trouble”.

    With every update we get about Kim, I say the same thing, this is sad & depressing. I feel like the best thing that could happen to Kim is *IF* she were to end up in jail. She’s not “getting it” and I don’t think she’s going to until she truly hits rock bottom. Unfortunately, rock bottom is different for everyone and in her case, it might mean jail, but hopefully, it’s without her hurting herself or someone else more than she already has. I hope she turns it around before it gets to that point.

    I received 40 days in jail or pay $4000.00 for a five year old traffic ticket. She attacked a police officer. She won’t complete anything and she will never be punished. I watched a judge give a woman that just came from the hospital after having a baby get six months because she didn’t complete her community service because she was on bed rest. He didn’t care about her letters from the doctor or the fact that her husband was in court with a baby that was 24 hours old. Celebrities are never punished.

        I went to jail, it was all the money upfront or jail. My daughter was going to college that was her tuition money. It was my fault I can’t blame anyone except myself. It was in a city that was bankrupt.

    I know this is sad…but my reality …as a fan …of Kim..she is a conflict within conflicts. I am unimpressed that Kim didn’t bother to show up..even though it was court ordered twice.

    If Kim hadn’t joined RHBH we would never know about Kim’s plopping of the “wagon” twice….So as far as we know..this is the worst it has been for Kim….we have zero clue…this may be the tamest things that have happened to Kim..who knows..Kim may not even remember.

    Kim has been chillin…doing what pleases Kim and I am so disappointed that Kim hasn’t had either the “aha” or “come to Jesus” moment.

    I just know for a fact…..she is not enjoying her life right now…and I know that this is of her own creation…I know that I would never want to live 1 hour of her life..as it is right now.

    People like Kim, there is no fixing their problems. They just hire lawyers and get out of any mess they might be in. Kim has no intention of doing anything to help herself. Her attitude is I will do as I please and there is nothing you can do about it. How they get away with this stuff in court is beyond me. If they were nobody’s I guess they would get the book thrown at them. But because she is know and used to be a child star, she seems to get away with it all. When they find her dead of an overdose of whatever she is on or overdose of booze, it will be said how sad it is and was for her and all the things that went wrong in her life. I doubt she will ever be well. Everyone says how they wish for her recovery, well I do too. But if she doesn’t want to get better she absolutely will not. If people would just stop with all the attention, MAYBE she would try just for herself. I wish her good luck, she is gonna need it.

    Pray for her instead of trying to shame her or speaking of it like she is going to fail. Her struggle is real and since her so called loyal sister decided to tell the whole world about her sister struggle,she having to do this in public, it is hard enough without a audience, and she has regrets and having to deal with the guilty feelings of embarrassing her children and family is very hard, As women, as sisters we need to stand beside each other, and stop being mean girls! Lots of people have this struggle ,but not in front of the whole world, our dirty little secrets are not before the world, and I don’t care who you are, every single one of us has a vice, it might not be booze, it might be food, or cigg. , maybe Dr. Peppers like myself, lol, but everyone has something, be kind, not mean
