When last we were in court, the defense had stated its case for saving Jodi Arias from the death penalty. It was not a strong case, but it was a very long case. And Juan had given his rebuttal. Normally that would mean it’s time for closing arguments but today the defense began its surrebuttal, which is a rebuttal of the rebuttal. Because, Arizona.
Willmott decided to put Geffner back on the stand today. Geffner is the old psychologist who she has done panels with in the past who is also buddies with Fonseca, who we will also be seeing again. Geffner is the one who fumbles through mounds of papers and testifies with an inappropriate affect. He got on the stand today and began attacking DeMarte. He says that graduate interns in psychology are not allowed to use the words “psychology” or “practice”. Because he is an idiot. The jury HATES this witness. He spends all morning attempting to discredit DeMarte’s testimony. It’s still morning and jurors are not taking notes and leaning on their hands looking bored. Good grief, Geffner is saying that the testing instruments cannot be viewed by anyone who is not a licensed mental health profession. So glad there is a real psychologist on this jury. Geffner goes on to say that DeMarte is a terrible, unprofessional, unethical, young person who has a little bit of knowledge and is dangerous.
Geffner goes over his previous testimony about testing. He is trying to say that Travis was the violent one and Jodi was not aggressive. Geffner says that Demarte exhibited confirmatory bias when testing Jodi and reviewing her journals. I wonder if he learned that term when his expert testimony was thrown out for exactly that reason.
There was nothing new in the afternoon testimony. It’s just a rehash of their opening. Geffner points out that some of the interviews from the Purple Plum contradicted the ones that DeMarte discussed about Jodi manipulating men. Geffner’s afternoon was spent trying to convince the jury that Jodi was a victim and Travis was an abusive bad guy. The sexting charts, the sets, all the women he told he was a virgin, blah, blah, blah.
A surrebuttal is to address things that only were mentioned for the first time in the rebuttal. It’s not a chance to replay your entire case all over again as a stall tactic. It is ridiculous that Judge Stephens doesn’t have more respect for the integrity of the system and the time of the jurors.
