Everyone is back from lunch and ready to go. Juan skipped lunch since he has been eating Bob for lunch all day. Juan talks about the Lake Havasu trip and point so out more inconsistencies. Again, Juan points out inconsistencies in the stories and the lack mention of fighting on the trip. He asks Bob questions he doesn’t know the answers to. Next, he reads a diary entry from the day Dan called her to tell her Travis was dead. In her journal she wrote about the shock of Travis death, etc. It was all bullshit. This of course calls into question everything in her journals. Bob says maybe she was disassociating. She journaled about calling Flores to find out how he died due to her morbid curiosity. Juan points out that what she writes in her journals is to her benefit and that she leaves out things not to her benefit. Bob says she leaves at things that are to her benefit as well. Juan says Bob believes everything this delusional defendant says.
Moving on way too much time was spent on determining the exact day that Jodi and Travis became “official” (2/2/07) and even more nonsense about whether “official” means “exclusive” and when and if they were “exclusive.” Juan brings up Jodi’s message to Travis at the funeral and focuses on her saying he was beautiful on the inside and the outside. Juan wants Bob to explain why she would say that about someone she saw masturbating to child porn? He asks Bob if he didn’t think to ask Jodi about Travis’ exact position while masturbating? Did he find it weird he was supposedly on his knees? Bob says he wasn’t worried about whether or not it was true because he was trying to put the puzzle together. (WTF?) Juan says wouldn’t a lie make the puzzle untrue? Bob says no. Juan suggests that is timeline is simply a tool to smear the victim. A ten minute break was called. When the jury returned they were asked to disregard the question about smearing the victim. Heh. That just makes them remember it’s important.
Juan asks Bob if he read Chatanya’s statement saying that they never were intimate, that they just flirted. Bob did not. Bob says no he was just talking about Travis’ patterns. He says he can only give opinions on Jodi. Juan says but you gave an opinion on his patterns and said he was manipulative! Bob says he is not going to say Travis was manipulative. Um, I think he said exactly that yesterday. He’s backpedaling. Bob says there is a difference between being manipulative and manipulating a relationship. Oh for fuck sake. These two have been arguing semantics all afternoon. Next they argue about when and if Travis and Jodi were ever “boyfriend and girlfriend.” Also about the labels for Travis’ relationship with Lisa Andrews. It’s all crazy and irrelevant for the most part. Juan wants to make it clear that Travis was within his rights to date and sext other people when he was not in a relationship.
We move on to the PTSD charts, graphs and tests. Juan says that the PTSD tests asks for the cause of the onset, that is the precipitating event. Juan wants Bob to tell us what that was. Bob doesn’t want to tell use. Juan asks for a sidebar and the jury is tossed out for a bit.
Bob tells judge the events were, “Attack by Travis on June 4th, Second even was Travis Alexander on day of murder and domestic violence in general.” There is no white noise as the attorney all gather around Bob as he speaks to the judge. Juan says that the answers were changed. (or perhaps combined over two tests???) and Bob says they were not. Geffner is hold his own this afternoon. It’s bugging Juan.
The jury comes back in a Juan seems to go in another direction. He wants to discuss the test Samuels gave Jodi. He shows it to Bob. Bob says that test should not be made public. It is copyrighted and would taint the validity of future tests. And Judge sends the jury right back out!!! Here’s the deal on the test Jodi says that her trauma began when Travis was murdered by intruders. She lied. Defense is arguing Juan should not even have access to the test and DeMarte should never have given it to him. Stephens want to shut down the cameras and other transmissions of the trial to protect the test. WTF? If we are talking about one question, “What was the answer to what was the initial incident that caused the trauma?” that will have no effect on the validity of the test! What is wrong with these people? Bob says he takes issue with Juan asking him questions about specific answers. Juan says he objects to the witness telling him what questions he can ask him. Juan also wants to ask about questions about assault by a stranger and a non-stranger. These questions were publicized in the original trial. Why isn’t Juan saying that?
Nurmi asks for a mistrial because Juan said Witness #1’s name yesterday. Oh for fuck sake. That does not harm the defendant in any way. The testimony she wanted in got in. Judge Stephens says that situation was handled and is not before the court. Defense wants the media not to be allowed to tweet the testimony about the test because of copyright. Judge says that she is not going to tell the media what to do, they understand copyright law and that is their issue to deal with not hers.
Juan reads directions for the test to jury and gives some of Jodi’s answers. She checked of non-sexual assault by a stranger, non sexual assault by someone she knows, and other trauma under one portion of the test. She lists non-sexual assault by a stranger as the most traumatic. Juan is going to say she lied on the PTSD test and that this question is based on an event that never happened (ninjas). But before Juan gets to make his points, the jury is tossed out again for unknown reasons. Sidebar. White noise.
Jury is back. Not sure if Juan ever got to make his points on the test. Why doesn’t he remember this testimony was already admitted the first time?
Anyway we are moving on to a letter that Jodi wrote to the Alexander family after Travis’ death. She says she knows they hate her and she understands because she has a brother. She tells them the fake ninja story. It’s full of graphic details of the fake attack replete with Travis screaming and talks about her trying to fight off the ninjas and save him. Jodi tries to look sad and eek out a tear or two. So far no luck with the tears. They jury is very engaged as Juan reads the letter that ends with, “Sorry about the handwriting, I’m shaking as I write this.”
Juan says that the made up answers on the PTSD test were made based on this lie. Way to get your point in Juan. That is where testimony ends. Juan sends the jury home for the weekend with the thoughts of Jodi lying to the victim’s family in horrific detail. Nice work Juan.
But Juan is not leaving. He is now going to duke it out with Bob again over the tests that we have all already seen. It seems he has to ask Bob the questions outside the presence of the jury first or something. Because, Arizona. It looks like everyone else is as ready to be done for the day with this as I am so they booked on out of there.
