I didn’t cover the trial yesterday mostly because I was reading the secret testimony. The secret testimony was not an allocution. Jodi actually took the stand. There was absolutely not a single thing new or interesting in her testimony that she did no publicly testify to before. They started off with her childhood. Her mother beat her with a wooden spoon. Her father beat her with a belt. Her parents fought. She got the hell out of dodge as soon as she could. We went through all of her relationships, some of them were mildly physically abusive. Some were emotionally abusive. She broke up with the guy every time. We got a lot through the Daryl Brewer days, and had just begun the beginning of her relationship with Travis Alexander.
She and Travis had oral sex very early in the relationship. They met at a motel off the highway for a couple days for naked grinding. Jodi begins to attend a Mormon church in her area almost immediately. Then the order comes to stay the secret testimony. Nurmi says he has no more witness. He cannot move forward until the final order. Or alternately, he says if he does have witnesses taking them out of order would be detrimental to her mediation. Martinez says that the testimony has to be stricken if she doesn’t testify in public because he was unable to cross-examine her. It’s a clusterfuck. Because, Arizona.
Yesterday, the mysterious bearded man returned to talk about technical computer issues that no one, not even the young, techno savvy, intrepid courtroom tweeters. The second half of the day, the old standby witness Flores took the stand. He testified that to his knowledge Travis’ roommates did not use his laptop. Still the defense feels the need to play an audio of an interview from Travis’s roommate Zach Billings saying he did not use Travis’ laptop. That same interview says that he would be shocked to learn that Travis had a sexual relationship with Jodi. After 30 minutes of arguing outside the presence of the jury the tape is allowed in. It took them a long time to figure out how to work a tape player. I’m not kidding. Eventually, the jurors hear the tape that could not possibly less relevant. Flores says he was not in that interview, and he knows nothing about it, and he can’t acknowledge that the person speaking is even the roommate. He’s simply not familiar with the interview.
On cross, Juan’s main point was that Travis always left the house open and anyone could come and go and potentially use the laptop. The jury is sent home with no witnesses for them until next week. There will be court (god willing and the creek don’t rise) next week on Tuesday, Wednesday and Thursday. The jury was told the trial will continue through February and to let her know about conflicts. Those poor jurors.
The defense motion to dismiss the death penalty was denied. Until, Tuesday…
