Oh Teresa, take a seat. Today (presumably new) attorneys for Teresa Giudice filed a suit in Manhattan Supreme Court, claiming her BANKRUPTCY, attorney, James Kridel, mishandled her original bankruptcy filing in 2010 and did not properly prepare for her testimony. The suit alledges that “Kridel failed to perform a reasonable investigation concerning the petition, schedules and statement of financial affairs.” The suit also says that Teresa feels she was not properly coached on her testimony in bankruptcy court. I guess he didn’t stress enough not to lie like a lying McLiarson. I don’t know who the current lawyer is but Teresa has blamed all her lawyers for her prison time and quite frankly, if her criminal lawyers were not so good she would have been doing much closer to three years. She got off VERY easy.
This is Teresa Giudice who was $11 million dollars in debt four years ago and sinking further every year, spending money lavishly on national television while all the while admitting her kids have no college fund WASTING EVEN MORE MONEY in legal fees. Legal malpractice cases are rarely won. This case will not be the exception. The financial damages Teresa is claiming from her businesses are because she is a convicted felon who committed 41 felons and took a plea deal. She does not have a leg to stand on and is only doling out more money to lawyers at a time when she needs to make sure her children have a roof over their heads. We have been told she is spending time with her children during her last month of freedom. It seems that was a lie. She has been hunting down new lawyers to rack up insane bills with.
Her new lawyers have to know they will not stand a chance with an attorney with Mr. Kridel’s credentials “James Kridel brings a wealth of business, legal, military and life experiences to his law practice. For four years Mr. Kridel served as a special agent for the United States in the field of Counterintelligence, which resulted from his voluntary service with the United States Army during Vietnam. Before starting his own law firm, he was the tax partner at a previous firm. In addition to his Juris Doctorate degree from Rutgers University School of Law at Newark, Mr. Kridel spent five years at New York University towards a Master of Laws (LLM) degree in taxation.”
Does this attorney, whose NYC office is on Madison Avenue somehow “failured to exercise that degree of reasonable knowledge and skill that lawyers of ordinary ability and skill possess?” The fools that filed this lawsuit claim that Kridel caused Theresa to lose income, incur legal fees, lose business deals and face public ridicule. God Dayum this woman is stupid.
UPDATE: I am going to predict this entire case will be thrown out as “untimely” though “ridiculous would” work for me. Mr. Kridel has an office in NJ and another in NY. I was curious as to why the case was filed in Manhattan superior court. The statute of limitations in NJ for legal malpractice is TWO years, in NY it is THREE years. In any case, it would seem that even if Teresa had a case, which she does not, it’s too late to cry about it now.
Let’s review what really caused Teresa to lose income, business deals and face public ridicule.
To quote a wise woman, (myself) ” When Joe and Teresa went to file for bankruptcy, they committed fraud. They hid assets and lied under oath to the judge. The government doesn’t like being lied to and that is how the Giudices found themselves preparing to do some federal prison time in the first place. The Giudices were tossed out on their asses, the government stopped considering their bankruptcy case and the feds came calling. They were not allowed to file bankruptcy and their creditors are free to pursue them through any legal means available to be repaid in full.”

Because they are lying liars who lie, they hid the few assets they had from the bankruptcy court. This made the court mad. Both Joe and Tre invoked their right not to incriminate themselves. Then the court told them they could take a short leap from a tall building. Their request to discharge their debt was DENIED. No bankruptcy was allowed.”

The FEDS agree to drop charges 2-14 16-21 and 26-35. Tre pled guilty to Count 1, Count 15, Count 23 and Count 36 for a total of four counts.
Count One: Conspiracy to commit mail and wire fraud. Maximum Sentence 20 years/ $250K Fine
Teresa claimed to be employed as an executive assistant for Modern Era Investment Corp making $3,750 a month. At the time (September 2001), she was actually unemployed. Both Teresa and Joe are charged with falsifying federal documents (a HUGE no no) including income tax returns and fake w-2 forms as well as fake pay stubs. Based on the falsified document, they obtained a mortgage loan for $121,500.
But wait, there is more. In June of 2004, at another bank, Teresa claimed she was the owner of G&G Stucco and made $14,750 a month and had made that amount for seven years. Based on that line of bullshit, she was given a mortgage for $20,200. How dumb do you have to be to break a Brazilian federal laws for $20K? Teresa was unemployed at the time. These are just TWO EXAMPLES of thing Teresa did, in person at a bank knowing full damn well she didn’t have a job. The rest are detailed here.

Here was her very public statement at the time she PLED GUILTY:
“Today, I took responsibility for a series of mistakes I made several years ago. I have said throughout that I respect the legal process and thus I intend to address the Court directly at sentencing. I will describe the choices I made, continue to take responsibility for my decisions, and express my remorse to Judge Salas and the public. I am heartbroken that this is affecting my family—especially my four young daughters, who mean more to me than anything in the world. Beyond this, I do not intend to speak specifically about the case outside of court, at the recommendation of my attorney and out of deference to the Government and our legal system.”
Teresa, go make Christmas cookies with your brood and enjoy the rest of this month. Quit filing stupid lawsuits. Then go do your time and try to comprehend what YOU DID to land your ass in prison.
