Jodi Arias Trial Recap for Monday 11/24: Driving Down Slime Highway

This photo of Jodi on Friday seemed to upset her. Awww…

Things ran a bit behind this morning as the usual morning band of criminals took a little bit longer to finish up. Then Nurmi gets up and has a hissy fit again over the media in the room during a public trial. This time is problem is that the news pool photographer chosen to take photos for all media outlets, Tom Tingle took a couple of photos of Jodi in her prison attire at the defense table. Last Friday’s ridiculous events were not part of the sentencing case presided over by the jury so they were not in the courtroom. Jodi is only allowed to wear real clothes when the jury is there. Jodi doesn’t like for us to see her prison look, so today Nurmi wasted a bunch of time arguing that the media should be thrown out because the still photog took a picture of Jodi that invaded her conversation with her attorneys. Clearly, my friend Nurmi doesn’t understand that the video camera cannot record Jodi and her attorney speaking, but that you can’t read lips from a still shot. Judge Stephens denies the motion.

Jury is seated.

Judge Stephens announces that due to a jury scheduling issue there will be no court next week on December 1 or 4. So that gives us a shot at Tuesday and Wednesday of next week. She says the trial will probably last into 2015. Because, ArizonaJodi Arias Juan 1121

Juan comes out swinging at Dr. Forseca  right out of the gate. Asking questions, cutting her off, refusing to let her complete answers. He asks her if in addition to the voluminous amounts of information given to her by the defense if she looked on the Internet for additional information. She says she viewed photos on the Internet. Juan says she was told to give him everything she reviewed. He is asking her if she told him he could look on then Internet himself. YES OR NO? She looks to the judge again as she cannot answer yes or no. We have two back to back long sidebars about proper or improper impeachment. Jurors begin to wonder if their summer vacation plans will be impacted. By the way, I don’t think the jury will be there tomorrow as the trial will stop again for the court of appeals session about the potentially illegal media lockout when we believe that Jodi took the stand for a day outside of the presence of media.

Forseca is appealing to the judge about Juan’s YES OR NO? Demands. She says she doesn’t want to go through this all morning. His questions are not yes or no questions according to her and would misrepresent her interview with Juan. Juan wants to roll tape. Nurmi objects. Judge sides with Nurmi. The same attempt to play the tape happens two or three times with the same result. I don’t see why he can’t play it if she wants it seen in context… maybe I am not understanding something. Forseca repeatedly says she would like to complete her answers. Juan starts in with his repeated questions about her possibly having trouble with her memory.

Juan is asking about specific dates that Jodi and Travis got together and when they broke up. Forseca says essentially that she has reviewed tons of documents and would have to refer to notes to recall specific dates. She says that there really aren’t set dates for either as it never actually ended and the classification of together or not together wasn’t very defined. (That was a huge paraphrase on my part, but it’s basically what I am doing here. Again most of this is not directly quoted.)

jodi arias 1120 Fonseca

Forseca is holding her own. She is taking her time to answer when Judge Stephens jumps in and allows it. She tells Juan to step back from the witness box and give her time and space to answer. She made a statement about not wanting to go down “slime highway” with Juan. Jodi seems enthralled with Forseca and loves seeing her push back on Juan. Juan is trying to prove that Forseca specializes in youth and adolescent assessment based on an assessment tool for teens she has devised. She says that tool was not used in this instance because it was not age appropriate and is irrelevant.

We move on to texts from Travis about a sexual photoshoot. There were sent May 2nd at 9:13 am and ended at 9:21 am. One of the things Travis says toward the end is about someone being a “muse.” Juan is trying to say that some of these texts from Travis may have been written by Jodi. He shows another email in which Jodi is talking about Travis being a great outlet for her musings. I may have roles reversed here. The tweets are confusing, because court seems heated and confusing today. Juan asks Forseca if muse refers to a male or a female. She says it’s unclear. Juan says are you saying Travis was transgender? Juan seems really out there today. Forseca says Juan is on “slime highway” again and I agree. Nurmi is objecting his head off, and this time with good reason IMO. Forseca says something about gender identity not always being genitalia but she based on photos of Travis’ penis she is indeed comfortable saying he was male. Juan’s point is that a muse if female by definition. Juan takes the mention of Travis’ penis to thrown the picture of it back up on the big screen. Can someone explain how this humiliation is necessary to the Alexander family? Juan says that Forseca only believes it is Travis’ penis because that is what the defense told her! (Implication, just like everything else.) Nurmi erupts in a frothy mess of objections and we have sidebar 27 of the morning. Okay it’s #3 I think.

Dr. Forseca says from the stand, “Apparently Mr Martinez has a problem with his memory because I told him I didn’t view all 18 days of testimony.” Because Forseca has an accent, I have not put much import on the fact that everyone talks about the way she pronounces “Martinez” but at this point it seems as though she deliberately mispronounces it.

We have wandered into Juanderland here and Juan is berating the witness for saying that the juxtaposition of the penis picture and the baptism photo was distasteful. Juan claims that statement means she has lost objectivity. No Juan, it’s just distasteful. Do we really need to spend all day talking about a penis that may not even be Travis’? Move on down the Slime Highway with your penis.

The next pit stop on Slime Highway is for Forseca to be forced to read graphic texts from Jodi to Travis where she says she wants to fuck him like a horny schoolgirl and talks about her taint. Obviously, most tweeters are not excited about tweeting the particulars. The gist is that Jodi initiated the sex and the school girl discussion and she’s a nasty whore that defiled the innocent Mormon boy you just wanted to save her fro a pit of brimstone and fire out of the kindness of his heart.

One exit down the highway, Juan plays the sex phone call at the point where Jodi is (IMO fake) orgasming. Jodi puts her head down and covers her ears. Oh Jodi, just own it at this point. Travis’ comment about her sounding like a 12 year old is replayed. There is much back and forth about who initiated the school girl references in this relationship. Juan is trying to imply it was Jodi. It could be either one. I don’t care. Slutty schoolgirl is has been in the top ten Halloween costumes since Halloween was invented. MOVE ALONG down Slime Highway, Juan.

Sidenote: The tweets come in at slightly different times because some people are faster at texting than others. Nancy Grace’s tweets are like 20 minutes behind the testimony. Bless your heart, Nancy Grace. I don’t text either.

Blah, blah, blah jizz, and grinding and a plethora of texts about shaved pussies and pig tails and….who cares.  Jodi asked for a “facial” Juan explains what that means… *yawn* Forseca is bored too, she keeps stating that Juan is getting distracted by the sexual acts rather than the overall nature of the relationship. Juan finally gets to a relevant point. Forseca says that Jodi was in love with Travis and yet she killed them and then drove directly to another man to kiss and grind on. FOCUS ON THAT JUAN!

And then we get lunch recess.  Also there has been a verdict reached by the Grand Jury in Ferguson so my trial tweeters are tweeting a lot about that and it’s going to be a mess to sort them out soon. I will post this now and try to get the other half later. I am a bit under the weather today. I need to eat something.

Samantha, Jodi was found guilty of first degree murder.

In Arizona they do things differently than most states. Instead of the judge determining life or death, a the jury makes that call. In this case, they could not come to a unanimous decision.

IN ARIZONA, when that happens the prosecutor can decide to impanel one more jury to ask for DEATH. If this crew doesn’t come to a unanimous for either death, or life without parole, or life with parole, then the next step is. To send this jury home.

Then Judge Stephen decided the sentence. The death penalty will not be an option for her. She will sentence Jodi to either life in prison without parole, (most likely) or life in prison with parole (which I understand doesn’t really allow for parole in ARIZONA because ARIZONA has a very weird system. Thus my constant refrain of Because, Arizona.

      Hope this helps.

Thanks Samantha! I’m condescending A LOT here. But only when absolutely necessary. This was not one of those times. Part two is up and I took a side trip to Crazyville when recapping it Because, Crazy!

The trial about guilt or innocence is over. The jury then deadlocked on the PENALTY, and this penalty(only) phase is in front of a NEW jury. Will it br life, with or without parole, or will it be death? Because, Arizona…

I just don’t get how Dr. F thinks that ANY of this is justifiable or mitigating the murder of an individual? Do you get the sense that Dr. F is coming to the defense of Jodi?

I found your blog because of your Jodi coverage. I feel so bad for the family. I remember the rage I felt in circumstances not even close to this circus. To have it extend nearly a decade, with a loved one dragged through the mud over and over. I hope her life is a living hell.

If Nurmi really hates Jodi and wants this all over with quickly, then why does he waste time objecting over the media all the time when he knows it is useless and just delaying the important aspects of the hearing?

I just want to say that it is refreshing to hear the truth you speak when referring to the state of AZ policies and especially to the way you see Juan Martinez. He is a bully, IMO he should be removed from his office, as he seems to love giving the death penalty. This is shown in his past history with said penalty. Judge Stephens seems to be his side kick as during the trial it would show them laughing together at the bench before the life streaming closed. No person needs to be treated as he treats those he is questions (interrogates). This in itself has changed answers, confused people and lead to misunderstandings of those listening, etc. I would much rather read your posts than to watch him in person again. I had to take heart medicine to deal with my blood levels, Seriously.
Thank you ever so much…..love your comments.
