The proceedings began with Judge Stephens excusing a juror due to a family emergency. The defense objected but the juror was replaced. There are 6 men and 12 women on the jury. The judge said the trial is expected to last until December 18th. She also informed the jury that the previous jury found that Travis Alexander was killed in an especially cruel manner and it is up to them to determine a moral and just sentence. Jodi Arias made eye contact with each juror as they walked in. The jury is very engaged and is taking note.
After a brief recess, Kurt Nurmi gave the opening statement for the defense. Kurt is either wearing a wig or has joined the Hair Club for Men as he has a full head of hair! He described the relationship between Jodi and Travis as one of friendship, lust, passion, spirituality and tragedy. He pointed out they will be seeing lots of very graphic evidence. For some reason he wanted them to know this will include a close-up shot of Jodi’s anus.. Did we see that last time?
Nurmi went on to point out the both Travis and Jodi overcame abusive childhoods. When they met at a Pre Paid Legal convention Jodi was already beginning to have signs of mental illness. She was young and intelligent but very immature. He says that Jodi as PTSD. She never committed a crime before this. She does not deserve to die. Nurmi’s opening was about 45 minutes.
Juan Martinez comes out swinging ranting about the cruel manner in which Travis was killed. Nurmi objects right away. Nurmi objects four times in the first three minutes of Martinez’s opening statement. Martinez goes into the sex talk about shaved pussies and blow jobs and asking Travis to come on her face. Martinez moves on to premeditation, the rental car, the gas cans, the gun… He describes the murder in detail pointing out that the stabbings did not kill Travis and he was in extreme pain as she killed him in the most cruel manner possible. Martinez goes through all of Jodi’s lies to the police, she wasn’t there, she was there but ninjas tried to kill them. Martinez supposedly has borderline personality disorder, but that is not a mental illness. I can’t believe he said that. I am going from tweets and updates from reporters in the room. Surely they got that wrong.
Nurmi asks for a mistrial for the first time. Something about Martinez pointing out Jodi lied to police as an attempt to minimize defense’s mitigating circumstances (no prior criminal history). Motion denied. After a recess, Martinez says that the only proof that Jodi was abused are stories she, a known liar has told. Martinez states that there are no mitigating circumstances in this case. NONE. The only outcome should be death penalty. Nurmi asks for a mistrial again. Judge denies it again.
Michael Melendez is called as the prosecution’s first witness by Martinez. He’s the computer forensics guy who recovered the photos off the camera found in the washing machine. Nude photos of Travis and Jodi are displayed on the large screen. Travis’s family looks away. Jodi’s family is in the courtroom as well. They show the pictures of Travis’s dead body and note the time stamps. Travis’ sisters cover their eyes and cry. Nurmi does a perfunctory cross about nothing.
Esteban Flores the primary investigator on the case is the next witness. Flores talks about the bedding in the dryer as well as Travis’s LDS undergarments. Martinez shows the layout of Travis’ house. He states they did not find the gun,rope or knives. The only knives they saw were in the kitchen. Discussion about the doggy door (Jodi was known to get in that way) and points out doors were unlocked. Flores identifies Travis’ body curled up in the shower. Martinez is really focusing on the gore. Close up of slit throat, grey flesh on face. More gruesome photos of blood everywhere. Court observers are grossed out. Flores says the body was partially decomposed when they found it.
The jury is shown blood splatter in sink. Blood was aspirated from Travis’ nose and mouth from the knife wounds. More and more bloody photos are shown. Juan shows the autopsy photos and one female juror covers her mouth with a scarf. Juan continues to show pictures until it is time to adjourn for the day. Nurmi whined to the judge that Martinez deliberately left the jury with the horrific photos with no time for him to cross. Yes, Nurmi, that is how it’s done!
We are done for the day. The media asked to be allowed to televise the opening arguments but Stephens denied the request.
