UPDATE: I read the court’s order for Phaedra to comply with the depo.  The topics are narrowed to two. One, her agreement with Augustus Publishing resulting in her dropping her suit against them. And two, any “non-privileged”  questions regarding Apollo and his “alleged” criminal activities.  Which is pretty much the entire case more or less. So the depo might be interesting. Unfortunately, the agreement with Augustus has a confidentiality agreement involved. This means that the court will seal the depo when it is entered into evidence. So we probably won’t ever get to read it.

In other news, Phaedra is on her way to LA.  Who wants to go to the taping of Ellen and report back? 🙂 No depo today, tomorrow,  Wednesday or probably Thursday so I suppose she will squeeze it in on Friday or Monday of next week?  That Phaedra always pushing things to the last minute.

I’m getting really bored with this drama. One would think that Phaedra would have better things to do being a single mother with two young sons, filming a TV show,  selling her workout videos, hawking her etiquette book to the less genteel, running a busy entertainment law practice representing celebrities, embalming all those bodies of humans and pets alike, taking her prayer cloth on a countrywide tour of religious congregations, making talk show appearances, building moats and gates around her white house, and now filing for divorce from her felonious husband. One would think so. But one would be wrong.  Because more than two years and countless attorneys later, Parks v. Stanton is still a thing. One has to wonder how long cases can drag on especially with and uncooperative plaintiff.

I got tired of transcribing the ridiculous excuse for a deposition this summer. I got tired of waiting for the plaintiff’s response to the defense’s motion to compel, which turned up last month. It was equally as ridiculous as the “deposition.”  Plaintiff’s attorney, who must be dying to jump ship like  the others before him have,  responded by saying that Phaedra did answer all relevant questions and that Defendant’s attorney was trying to make the case about Apollo.  Isn’t Apollo a big part of the case? The alleged libel of Phaedra is that Angela wrote a book that said that Phaedra was involved in Apollo’s criminal mess, right? If this was happening on a TV show we’d all be screaming about the absurdity of the storyline. But it’s not a TV show. This is actually going on in a court of law. Over two years. The latest news is two months after Angela’s lawyer filed a motion to compel (another Phaedra deposition) and one month after Phaedra’s lawyer filed a response that pretended the first one was perfectly normal, last Friday, the court finally answered. Once again, Phaedra is compelled to give a deposition. She has until next Monday to do so. According to my interpretation of her calendar and tweets, today would be a good day for that, Tuesday Phaedra Films Ellen  Wednesday she will be on The Ellen Show.  And of course she is going to take her prayer cloth and a sack of books to a church service Wednesday night at 7, so the rest of the week looks bad. Because, Hollywood.  So my guess is, either she is doing it today or next Monday. Which means I suppose I should plan on getting the oil changed sooner rather than later for a possible road trip to Lawrenceville.  I wonder if I have any readers in the area? That last ride home was a nightmare.

Do you guys think there will be anything new and interesting in the second deposition?  At what point will the judge set a trial date and tell Phaedra to shit or get off the pot? It’s HER case. She is the plaintiff. Isn’t this much stalling proof of vexatious litigation?  Or does that only apply to multiple suits for the same issue? Or is this just how a lot of people spend their time?  I suppose Phaedra doesn’t actually have to invest her time in this case, other than being deposed. Nor does Angela.  It’s just a bunch of repetitive motions being filed over and over and over with no end in sight. I suppose we have to count on the judge, who does have to spend time on this nonsense finally getting tired of the case as well and somehow forcing something to happen. Maybe next fall? Sigh.

Predictions anyone? Because, as of now, I’ve got nothing.

    I think this is how the court employees spends most of their time. I don’t know how many times I have been selected for jury duty and right after lunch, the judge thanks us all and announces that the lawyers have reached an agreement. The judges are full time employees, so this is part of the job. When the judges are not in actual chambers, then they are researching issues.

    I think it stinks that you can force a person to hire a lawyer, then sit back and refuse to cooperate. Angela may not be doing much, but sometime or other she will have to pay her lawyer unless she can squeeze it out of Phaedra. The right thing would be, at the first sign of a plaintiff refusing to participate, force the plaintiff to pay the defendants legal fees incurred thus far, then cancel/throw out the case.

        Yes, Stanton was fortunate enough to have a generous attorney pick up her case pro bono, but either way, Beth makes a good point. It is a waste of everyone’s time and money–including the taxpayers.

      I agree beth!!! I’m so confused at how one can sue someone as the plantiff, but then refuse to answer questions in a case that THEY pursued!!! WTF??? Why drag this thing out? Pay that girl’s legal fees, settle out of court, or do whatever that needs to be done to drop this case, and move on already….or is it not that simple now???

      Phaedra’s name is in her book. The title is about a real housewife. I just don’t understand why the judge would not throw it out, if the case does not have any merit. I can’t imagine what Phaedra will disclose if she can only discuss non-privileged information about Apollo. I thought Phaedra was listed as one of Apollo’s attorneys.

    I wish Phaedra could in some way be chastised by the bar for blatant misuse of the justice system, as well as loose her case. I also would like Angela to counter sue Phaedra for her loss of income, plus a monetary penalty.

    I just hate how the uppity, shady Phaedra seems to be avoiding any responsibility or dust for all the other people around her that get jailed. She is the smart one in the middle, by comparison.

      Oh, God, such a BS response. Really? I think it is pretty fair to say that Phaedra is the one to point fingers at right now–not “corrupt court officers”. There are SO many good court officers who follow the law and there are procedures that they must follow. The legal system moves at a snail’s pace (except in rare, usually high-profile occasions.) Yeah, there are corrupt/lazy/incompetent people in every profession. But so far Phaedra is the one to blame here.

      I like that Tamara doesn’t allow her fans to use names other than the real names (or stage names) of celebrities. You can’t call Phaedra anything except her name according to the rules. No smart ass name calling allowed. I can appreciate that because calling anyone by their real name has more of a negative punch when talking about reality tv so-called stars.     Out of all of the housewives, no one makes me feel more icky inside that Phaedra. Just seeing her face in these pictures turns my stomach. She’s lucky that the whole “your face will get stuck like that” is just a lie that moms say to try to get their children to stop making ugly faces. Then again, in her case it wouldn’t make much of a difference since 90% of the time her face is ridiculously contorted anyway. Ick.

    Good luck to Angela! I hope this finally starts to move along for her.

    I thought Stanton counter sued, meaning she is a cross plaintiff. I am I wrong thinking that?? If that is the case, Phaedra will never dismiss her case until the cross suit is dismissed. Phaedra is probably most worried about the cross suit. If stanton is successful, she maybe selling Phaedra’s white house with the moat to pay for the judgment. Punitive damages?? I don’t know if bankruptcy brother ion will save her white house that point not familiar enough with that.

    Usually in most civil cases there is a discovery calendar. The judge will move only so many times. But at first it (in most states) it is usually pretty liberally moved. However, if I was the cross plaintiff attorney I would ask that Phaedra Pay for the transcript and court reporter for the first deposition. On that note, just in court reporters and deposition transcripts she must be spending a fortune. Also, if I was Stanton attorney. I would demand that the deposition be video taped and scheduled at such a time that the court is available and the first sign of any funny business I would call the judge. This ensures it gets done or she gets sanctioned. No playing around.

        I will predict on short end trial in Jan and long end April.
        I hope this goes to trial and….is televised. I have two small children and can’t travel..but I do have a dvr. Can’t you just see appollo showing up representing himself pro se in prison orange and scowling at phaedra. Priceless.

    If there is no trial, then what are they expecting the outcome of this to be? Obviously the judge believes Phaedra is being dishonest. If she is caught in a lie regarding Apollo? What happens next? Because not only will the lawsuit be dropped but won’t the Feds be at her door in regards to her husbands crimes?

    I’m trying to follow as best I can, but this all seems like a load of Phaedra’s spun and twisted B.S.

      These things almost always settle. I think it’s like 99% never go to trial. Well over 90%. I think she originally thought she could scare Stanton into settling, and then later into dropping her countersuit. Either intimidate Stanton or drain her resources.
      What Phaedra’s strategy is now? Who knows! She appears to have none.

      ​Angela doesn’t have the money to fight a lawsuit like this. She expected Angela to cave. Then Radford showed up and took the case pro bono and has not backed down from Phaedra. Phaedra intention is to wear the other party down. She does not want a trial.

          LOL. You are close. Phaedra appears to be committing vexatious litigation by continuously derailing her own case. She could be charged with malicious prosecution and that would get her disbarred. I don’t have much of a feel for the judge, but this probably won’t happen. Eventually, I think the judge my throw the case out, award Angela attorney fees and call it a day.

        Ok….so, she can’t drop the suit because of Angela’s counter suit & Angela’s lawyer knows Phaedra is lying and won’t back down!!! Got it!! This is a very wierd case indeed! Settling seems to be Phaedra’s best option at this point and stubborness is making her look hella shifty and shady….kinda like her soon to be ex hubby!

    Ellen is a softball interviewer, there wont be any tough questions or she wouldnt have agreed to it. She will hawk her southern belle wares and dish on the other girls and promote RHOA. Ellen watches the housewives shows and is good friends with Andy which is how she probably got on.

    I think I’m going to weigh in here. Why? I don’t know b/c I don’t dislike Phaedra or because I invested some time in reading Tamara’s posts (starting back in March 2012) on this topic. I don’t believe any earth shattering statements and or claims made by Stanton, St. Julien, or the other chick who’s name escapes me right now. Sure, little things are true but I do not believe for one second that Phaedra would allow any of these people to possess any bit of knowledge that could link her to crimes! Sorry, but I don’t believe it in the least. Do I think Phaedra was involved? I don’t know but she hasn’t been charged. I would think that if the Feds had the goods on her, they would have already charged her. One thing that I will give Phaedra, hands down, is that she is an intelligent individual. She did not graduate from a cracker jack law school and she passed the bar. Could she had a conversation with Apollo saying something to the effect of I do not want know anything about “your business”. I don’t want to know what you are doing. Sure that’s possible. In fact, that is what any good defensive attorney would lol. I think the only two people who know or Apollo and Phaedra. I would be SHOCKED if Apollo says anything that would get Phaedra in serious trouble. Someone has got to raise and support the kids. I think Phaedra over estimated the impact that Angela’s book was going to have and now wishes the whole thing would go away. Sorry for the rant. TAMARA THANK YOU FOR YOUR COVERAGE! .

      I think we have low standards for intelligence. If you do well in undergrad have a decent LSAT score and a few good recommendations you can get into a decent law school. If you pay attention in law school and study, you can pass the bar. These things are attainable for many many people as long as they have normal cognitive functioning and had a respectable early education.

        Sorry, I have to disagree with you. Not everyone who has an undergraduate degree can waltz through LSAT, Law School, and sitting for the bar exam. Perhaps you think so because you are yourself a higher than average intelligent person. I sort of think you inadvertently insulted attorneys everywhere.

        There are a lot of dumb people everywhere lawyers or not! However, I still think you have to be intelligent to become an attorney. Did I read that she went to University of Georgia which is ranked 39th? Now, after they get licensed to practice, do some “magically” become smarter than everyone else in the world (at least in their own minds lol)? ABSOLUTELY!! But if you go to law school then decide to “master mind a criminal enterprise”, then I would think you would make sure you were untouchable. You never know though because I know many people who are “book smart” and lack common sense!

        I don’t think I’m a particularly gifted person, and I am in the process of wrapping up my law school applications at the moment. I agree the LSAT is not an easy exam but that’s why you take months to study for it. In this process I had a judge I interned for advise me because it can be discouraging. My undergraduate program was insanely rigorous but everyone still tries to scare you out of going to law school simply because it’s a challenge. Anyway he said, “do you do your homework and study no matter what? Do you write well? Then you can do it.” I don’t think he’d be insulted by my assessment. There is a difference between being naturally gifted and hardworking. People that do these things do them because they break it down into steps and see those steps as achievable. If you have a good work ethic then you can learn and pass exams. I understand that I’m only in the beginning phases of the process myself, but I believe I will get into a top 50 school (especially the one in my home state). I think Phaedra probably worked hard in school , she seemed to for mortuary school. I will definitely grant her that.

    Since she’s publicly announced the divorce. She better get this court case done before the divorce is final. Because after the divorce, spousal privilege is no longer. This means any questions about Apollo have to be answered.

    T.T., I think you may be right (what you wrote above), Parks maybe hoping to wear down the other side and they just wave the proverbial white flag. ‘Cause nothing else makes sense. Who, in their sane legal mind [or any other kind of sane state] would deliberately subterfuge their own case? Parks brought this on, not Stanton, so why be difficult? It’s really about changing “public perception” of her; the truth hurts, and it hurts really BAD if all can read and have access to it. Parks may hope that if she win this the public will then see Stanton as a liar. The logical won’t! We’d just assume that the same ‘hidden’ politics that’s keeping you from the meeting the same fate Apollo met is the same hidden political powers that sullied up the trial [or pre-trial] proceedings to make Stanton look like the fibber-in-prose v. Parks. Let’s hope this miscarriage of justice NEVER occures.
