Teresa and Joe Giudice Get Yet Another Sentencing Postponement

September 6, 2014 by tamaratattles 45 Comments

RHONJ Christmas tre joe

Oh for fucks sake. Really New Jersey?  The plea deal was finished months ago. There was already a two month postponement. How long does it take to get from plea deal to incarceration in the fucking Garden State?  This is just embarrassing. Teresa and Joe Giudice now have new sentencing date of October 2, 2014.  Don’t hold your breath on that being a firm date either.

According to NorthJersey.com: (My comments in purple)

“Typically, sentencings get postponed so that everybody involved can be fully prepared,” said Henry E. Klingeman, Teresa Giudice’s attorney. “The court is waiting on information from all sides – the defense, the government and probation – so it’s been postponed by a couple of weeks.”

Oh horseshit. “The Court” is ready, the government is ready.  Is Joe Giudice still on probation? Those records take an hour. It’s the defense that is pussyfooting around and drawing this shit out. Did Klingeman convince the judge to let Teresa film the reunion to go toward her restitution? What on earth could the defense need more time for at this point. THE PLEA DEAL IS DONE!  I understand the defense wants to make a case for Teresa to get probation, but for the love of God the plea deals have been done FOR SIX MONTHS! Is the defense attorney still trying to come up with a reason for Tre to get probation? Is two more weeks going to help somehow?

In March, they each pleaded guilty to one count of conspiracy to commit mail and wire fraud, and three counts of bankruptcy fraud. They admitted concealing assets, testifying falsely and making false declarations in a court filing. Joe Giudice also pleaded guilty to one count of failure to file a tax return in 2004.

Under their plea agreements, Joe Giudice, 43, could be sentenced to a minimum of three years, but less than four years in prison. Teresa Giudice, 41, would face a term of 21 to 27 months. Klingeman said he intends to seek probation for Teresa Giudice. “The plea agreement permits us to do so and it’s certainly a just sentence under the circumstances,” he said.

If you get Teresa house arrest, let alone probation, you might have actually earned your six figure paycheck, Klingeman. I am so ready for these two to get sentenced. We have a slew of Bravolebrities to lock up, and quite a few of them are in New Jersey. Let’s get the damn ball rolling. At this rate we’ll have another last Giudice  Family Christmas special.

Are the wheels of justice even round in New Jersey?

So it wouldn’t surprise me if the payment from the reunion filming some how impacted the delay. Although, that would imply that Tre is definately getting some time. My gut feeling is Tre wont do time though so I don’t know what to think about this.

My gut feeling is she won’t do time (in the big house) either, although I think she should. Probation or in house arrest just doesn’t cut it for me, and so I’m sincerely hoping my gut feeling is wrong.

The jurors are sending two Virgina celeberties to jail. Former Governor McDonald and his wife. They just sent Former Mayor Ray Nagin of New Orleans got 10 years. So Teresa and Joe think they are going to get probation or slap on the hand, these are all federal offenses they have done.

Maybe it’s to allow Teresa to attend Parent teacher conferences or School open house. How about more time to hit the fundraiser circuit to have state senators, etc. to write letters on Teresa’s behalf? Sorry tonight’s Italian dinner isn’t sitting too well right now.

TT, you are right… This has reunion all over it. More money for the creditors, which is not a bad thing. If I was owed money, I would not object to a slight delay. They have to serve the time regardless. I personally would want to get it over with. The stress of delays and constant not knowing the sentence would be killing me.

I’m sure she needs more time to buy flashy dresses and hair accessories for the girls for the time she out of commission. Then again, maybe she will get internet shopping priviliges in The Big House?

They probably want the state case to be heard before final plea deal is done. It will definitely impact the plea deal. This is typical of the court system with all these delays. It’s not like the court is concerned that the Guidice family are leaving.

Blimey if they stop the arsing around and just went inside and did the time from when these adjournments and this debacle of a court case happened they could have probably served their time and be out by now plus saved themselves a fortune in lawyers fees.

If ever I need help with a speeding ticket I want it “looked” after in NJ. So I assume – probabtion- was mentioned by lawyer for a reason -would that be for Teresa?

I think you hit the nail on the head Tamara, it’s financial surely. Teresa has to submit that $200,000. check (initial payment on the Forfeiture Money Agreement) by sentencing time. She gets more money for the reunion, when will that be filmed – end of Sept. ? Wonder if she has filed those many tax returns with supporting docs and paid her taxes or entered into repayment plan with IRS? According to the Plea Agreement that was to be done before sentencing. And she has the Financial Disclosure Statement to submit. Would love to see how much she has paid and still owes in attorneys fees. It seems like since Teresa has her brother, sister in law , Mom and mother-in-law to help care for the kids that won’t get her out of jail time. The Judge won’t care that the girls can’t get the latest cell phones and fashions because Teresa is in jail. At some point those girls have to become accustomed to a much less affluent lifestyle. The Feds will take all. I read that Plea Agreement on Scribd as well as your superb breakdown of it into layman’s terms. The Feds seem determined to get everything.

In cases like this probation is typically in charge of conducting a pre sentencing investigation (psi). They compile a report based on their findings and submit it to the judge to consider in determining sentence. That is probably why her lawyer mentioned probation needing more time.

Actually Teresa’s Plea Agreement refers to a draft pre-sentence report that I think the US sentencing commission files. I think the probation department may be involved. So I think Mejo is correct.
Her lawyer is hoping to get Teresa probation , of course but the Judge will make that decision. I am very interested to see what that Judge’s decision is.

They are going to lose the house. Foreclosure takes awhile. The creditors were only officially set free on the Giudice’s in April. See new post. http://s17948.p858.sites.pressdns.com/2014/09/06/revisting-the-giudice-bankruptcy-filing/

They talked about how the Giudices have 3 mortgages on their home. Can the govt. still grab their home to try to recoup money and creditors also. And if so they get stuck with the 3 mortgages (Teresa and Joe that is).

sigh. The government can’t take their home. A lot of people think they are “homeowners” who are not. The bank owns the Giudice’s home. They just have to file all the proper foreclosure documents and sell it.

Wouldn’t it be great if (and I know it can’t happen since everything is wrapped up) if the Bankruptcy judge ordered a huge action of all their assets – including the marble mansion & all the contents, high end jewelry, clothing, shoes, china, furniture, etc. I bet a lot of people & creditors would sign up for that! Public humiliation can often times be better than getting your money back. Sometimes Karma is a b#tch.

There are many really cool women in NJand everywhere in the US but they would NEVER participate in such a trashfest as Bravo’s HW series. As long as people watch that brings in advertising. As long as there is the advertising support, there will always be an ensemble of entitled cunts and cunthusbands on Bravo.

So I’m a volunteer caseworker in the court system here advocating for abused and neglected children. This douchebag molested all three of his daughters. Our criminal court case has been going on 1.75 years, ugh! After finally pleading THREE months ago, his sentencing dates have been put off 4 times ugh! Manipulative defense attorney tactics is the bottom line. More billable hours too. Of course our state is paying for the douches defense. Got to tighten up our judicial system. Its such a gross and absurd waste on soooo many different levels!

Teresa just wants things back “like they used to be”… Paying with wads of cash for her children’s clothes and all of that gaudy furniture.
Feel bad for Gia as she is obviously very aware of the trouble her parents have gotten themselves into. And Milania? I find her personality a little endearing but I do think she is acting out. Poor kids.

What I don’t understand is how people can feel so sorry for people that lied to have the lifestyle they have when people are doing things the honest way and struggling so much! I do wish them the best but its time they pay for their mistakes, even though they knew what they were doing. Time to live within your means and not lie to have more, no more big houses, cars, etc. I sweat a debt of 3,000 but at least it was to feed my family and legal! Let’s put an end to this drama and on with sentencing
