RHOA Phaedra Deposition

After spending an incredible amount of time getting Phaedra to admit she has a husband who she can’t remember meeting and knows essentially nothing about, Phaedra finally remembered when presented with documentation by Radford that she did indeed have a business with Apollo called Nida Fitness.  After rambling responses about the daily operations of Nida Fitness a much-needed break was taken.

After the break, Radford questions Parks about National Recovery Group Inc.  If you recall on RHOA Phaedra would tell people who Apollo’s job was “asset recovery.”  National Recovery Group is one of the shell companies used in Apollo’s fraud scheme.

Q. Ms. Parks, What is National Recovery Group Inc?
A. I don’t know.

Q. Okay. Are you aware of being listed as an incorporator on something called National Recovery Group, Inc.?
A. No, sir.

Q. Do you know what is at  239 Harriett St, Atlanta Georgia 30315?
A. No, sir.

Well Phaedra may not but I do… it is a property that Apollo purchased for  $12K in 2010 and sold last September for $9K and it is likely the address associated with this shell LLC  below are the sales transactions on the property. It appears to be listed as 259 with the county but is 239 everywhere else.  The info below is mine and is not mentioned or included in the deposition.

It is weird and certainly worth noting that his house was listed as “not typical of market conditions”, in this case grossly overpriced since it was built. It has also been foreclosed on twice. It’s a very small older house in a neighborhood.

A. No sir.

Q Okay. Do you know Michael Derrick?
A. Uh-huh. Yes, sir.

Q. Who is Michael Derrick?
A. My brother-in-law

Q. Okay do you know who Tanya Bussey is?
A. No, sir.

Q. Do you have any business with Michael Derrick?
A. No, sir

Q. I show you what I have marked as defendant’s 3. This is articles of incorporation that I got from the Georgia Secretary of State’s website for something called National Recovery Group Inc. and it states the incorporators are listed as Michael Derrick, Apollo Nida and Phaedra Nida.
A.  I have no idea what this document is.  (BWAHAHAHAHAHAHAHA)

Q. So you have no idea what National Recovery Group Inc is?
A. No, sir.

Q. Do you know who Anthony Derrick is?
A. No, sir.

Q. Before today has it ever come to your attention that there is something called National Recovery Group Inc. on which you are listed as an incorporator?
A. No.

RHOA Phaedra Check thatQ. So you have never heard of this before today?
A. Not that I know of..

Q. You know, let’s say for example, someone used your name on this without your knowledge.
A. Uh-huh

Q. Are you telling me that this is the first time you’ve ever—-
A. Today is the first time that someone has brought this to my attention that I recall.

Q. Okay. Your brother-in-law, Michael Derrick, is he your husband’s brother?
A. Yes, sir.

Q. Okay. Is that someone you speak to regularly?
A. No sir.

Q. Do you and your husband maintain a joint bank account?
A. No sir

Q. Have you ever maintained a joint bank account?
A. Yeah, some years ago.

Q. After you were married though, right?
A. Yeah.

Q. Where did y’all bank?
A. I think maybe First Citizens Bank?

Q. Was there a particular branch that you used most regularly?
A. I don’t go to banks, so no.  SERIOUSLY? Radford is getting annoyed with this…because…

Q. Like you don’t ever go to a bank?
A. No, I don’t.

Q. Is there any reason why you don’t ever go to a bank?
A. I just don’t. I don’t.

wait for it….wait for it….

Q. You just don’t like the way the smell? DEAD!
A. No, I just usually go to banks.

A brief line of questioning occurs where Phaedra says that Apollo probably went to the bank but she doesn’t know what branch.

Next we move on to Apollo’s financial deposition…

Q. To your knowledge did your husband recently attend a deposition conducted by the US Attorney’s office that was part of his criminal proceeding?
A. I don’t know.

Apollo was deposed 9 days earlier where he was required to bring a ton of financial documents, many that included Phaedra’s banking records and such. See list of items here. 

Q. You don’t know, okay. Did you provide any documents to him or to his attorneys, financial records, for use in that deposition?
A. I don’t know.

Q. How would you not know that?
A.  Obviously, he is my husband so he would probably be privy to the documents if he needed some.

Q.Did you provide him any documents?
A. I did not.  Y’all know damn well Phaedra carefully selected what documents to provide to the court.

Q. Okay, are you aware that he was as by the US Attorney’s office to bring documents related to your finances?
A. I don’t know, I wasn’t there. I don’t know. I don’t even know if this occurred. But if it did, I don’t know. Wow the quadruple denial! How interesting!

Q. Okay so no one has ever told you that you had an obligation to provide certain records?
A. No. Wouldn’t that be something done in writing for the record?

Q. During your marriage to Mr. Nida, do you have any knowledge of what is sources of income were?
A. He is not a party to this lawsuit so I don’t believe that is relevant.

Much back and forth where Phaedra replies, “asked and answered” several times to a variety of questions about her husband’s source of income. Andrew (attorney of notice for Phaedra) objects on the basis of relevance. Radford continues by explaining to Phaedra that as the plaintiff she has to provide evidence and testimony to prove her case. Phaedra contends she is doing that. Radford points out that refusing to answer questions about her knowledge of her husband’s criminal activities during their marriage impedes the case.  Then finally, this…

Q. Did you know during the time of your marriage that his income was derived from criminal activities.
A. No, I did not know that.

Then Radford begins a line of questions about where she thought Apollo was getting his money from. She again refuses to answer. Radford says it is necessary for Phaedra to answer more detailed questions to test the truth of her assertion she had no idea Apollo was a criminal. Phaedra refuses. Radford asks her if she has ever spoken with Apollo about her case against Angela. She refuses to answer…

And this is a good point to take a break.

    All I can say is she must be upset that she ever brought a lawsuit against Angela Stanton because, in her attempt to b the proper Southern belle who dispenses etiquette advice, she ended up in a very bad way. She should have left it alone. Now she is sidling up to Michael Brown’s grandmother with the hope that she can get Apollo to rip them off before he goes to prison. SMDH.

    Thank you so much Tamara! I enjoyed each and every installment of this series. I swear Phaedra’s plan to strong arm Angela, who she definitely considered to be without means and intelligence, sure backfired. I hope that Phaedra is strongly reprimanded by the bar; her lawsuit is frivolous. Um, yes, how could Angela’s book damage the reputation of someone who married an ex-con (knowing full well he was up to his old tricks again) and is known for accepting cash payments for “legal services” in the parking lot of grocery stores? She is not the arbiter of what is “relevant” to the lawsuit; the judge will determine that. The purpose of deposition is to give the attorney a chance to seek any information that may have a tendency to prove or disprove any of the matters at issue and clearly, her (lack of) reputation is a central issue in this lawsuit as well as Stanton’s counterclaims. I do not see how the judge could not side with Angela on Phaedra’s (mis)conduct during the deposition.

    FYI – Google street view shows a cute but very small 1200 sq ft house next to an industrial building

    It looks like lots of financial hanky panky happened with this house, no way it was worth $200,000 at one time and then it got foreclosed on. And then for the bank to sell it to Nida for $12,000? Ecverythin else nearby has sold for $24-45k). Somethings not right with the buttermilk here. (And then Nida sells it at a loss to Tanya Bussey, one of the principals in National Recovery Group).

        I think this house was initially supposed to had been for Phaedra and Apollo’s halfway house they were planning to set up. They were probably going to recruit and train more vulnerable ex-felons to do their dirt.

    You know, how could she claim (when tripped up in an answering) that Radford’s questions were “suspect” when ALL of her responses ARE. If that ain’t the pot calling the kettle black! How could you sue someone then be one of the ones impeding the case? Early on on the show Ne Ne referred to her as “Faketra” and the others saw her as disingenuous with that “due date” ‘n all. Even if she felt it was none-of-their-business, then say that (a southern belle would know how to say that nicely). Her whole aura read disingenuous from the gate! If you study both (Angela & Phaedra’s) their interview styles in videos, again, Stanton truly reigns as the one that appears more (MUCH MORE) honest. She’s suing her as a way to suppress all that honesty. Suppressing facts seem to be the fabric of of this society. And they allowing Phaedra to make a mockery of these proceedings really makes me wonder if Ang will win? Although WE’RE KEEPING HOPE ALIVE!

    Ang, continue to stand on the square of truth! Don’t falter. <3

    Phaedra and all her southern charm she seems to be digging a huge hole for herself. I really think her playing with the law as she is by not answering the questions “truthfully” in my opinion is a Big, Big mistake. Phaedra girl you in danger.

    Wow. She is screwed. And I love it. Phaedra deserves absolutely everything that is coming to her. I have no doubt that her day is coming, and coming fast.

    And I suppose Phaedra is doing all this outright lying without even breaking a sweat. She is reminding me of a non violent Jodi Arias type. I sure hope Angela’s case against her goes to court and Phaedra purgers herself, looses the case as well as her rights to practice law. The frosting on the cake would be the FBI finally indicting her for ratcheteering and more.

    Your so right, she knows by playing dumb she can obfuscate and make it hard for them to prosecute especially if you have a husband that won’t testify. But the problem is that we don’t know what the feds have in regard to recordings and evidence that Stanton’s lawyers don’t have. The feds may be getting ready or building a case against Phaedra. But I think that If Phaedra goes to trial and repeat what she said with a jury present she’s going to lose to Stanton.

    Looks like she feeling the heat. It’s going to be worse being caught in a lie. I’m sure there’ll be something in some of those questions and answers that Radford can prove is a lie at some point. She’s determined to use every tactic she can to prevent exposing her guilt, but I guess she has no other choice since her back is against the wall at this point.

        Just to let you all know, when I went to court with Sheree, some comments were used in court. In this case my site has been mentioned several times. So your comments may show up in court documents.

        If you care, and use your own names… I’m just saying. You are not facing liability per se but you will be subjected to the taint of posting at Tamaratattels.com. lol​

        Which is why we won’t mention that shitty site who refuses to acknowledge how they even knew the motion existed without me. I’m told that they are under investigation for claiming their source was at the deposition.

        Because, well, there is lying about sources, and then there is lying about having a source in the depo…. Fortunately for me, that site is being investigated by someone who is not me. Who lies about a source when you have the documents of who is in the room? ROFLMAO. Idiots that is who. All they had to do is acknowledge me as the source of the PUBLIC DOCUMENT I found, but noooooo, they claimed to have a source inside the depo…. where it was clearly stated that either Angela or Radford would have been the source since it was anti-Phaedra. So now, more court cases could be filed. LOLOLOLOLOLOLOLOLOL

        My attorney friend said the other site is so insignificant, that Angela’s atty’s may not bother with it. However, I have heard that the some people are handling it. The clear accusation of a breach of deposition is a big deal. Which is why children should not blog.

          ​Exactly. No one present for that depo gave anything to anybody. The reason I didn’t have the depo on the 19th is that no one knew it happened at all. I went to pick up the most recent motion to compel because I was wondering why there was yet another thing to compel the plaintiff to do. I was surprised to find the deposition attach to the motion to compel for another deposition. If she had some mysterious source in the depo, she would have had the story two months ago, not days after mine was published.

          It’s public record, sure. But if not for reading my blog she would not know the document was available.

          That is just a matter of common courtesy. What her primary issue is now is suggesting that someone in the deposition provided her with a copy of the deposition and her hilariously made up commentary on Phaedra’s behavior. Karma is not always quick, but it’s coming.

        ​I’m a hermit and I have to go to the bank quite regularly. In fact I need to go again as soon as I can motivate. I have a savings account with no card or checks of any kind attached to it. It keeps really short hours. It’s really hard to get money out. Which was the plan. Do I really need a hundred bucks THAT bad. Usually the answer is no. It’s a great savings plan despite the fact it doesn’t earn squat in interest.

    If Phaedra was smart and if it was possible she should settle quietly with Angela Stanton.

        I understand Phaedra is the one suing but I doubt Angela would go away quietly now.
        Angela’s attorneys are getting answers in the non answers.
        Phaedras case isn’t looking good.

    I forgot, but think Apollo’s first crime was money related? If so he could not get bonded or even work as a cashier in walmart.
    Phaedra knew it would be a miracle if anyone hired him as a felon.
    So he created a company with Phaerda on the board to rip people off.
    I now hope she goes down.

    I’m not too well versed on legal procedure but wouldn’t the judge be pissed off after reading this? Obviously her literally lying in bed with a criminal is relevant to her defamation/character assignation case regarding being accused of criminal activity. Did Radford bring that up? I read the other chapters but don’t remember him addressing that directly as the reason he was questioning her association with Apollo.

    Wouldn’t do Phaedra any good to drop her case because Angela has a countersuit. I’ve watched enough Judge Judy to know you can’t pee on someones leg and tell them its raining! Case of life being truer than “Bravo”. This is almost as good as when that heifer drug you to court! Thanks for the posts

    I can see Radford going to RHOA footage to impeach her about Nida Fitness…her muttering at the reunion when she told Andy that Apollo’s job was asset revovery! ☺

    Her blatant disregard for the legal process has me wondering if she knows something we don’t. I have been deposed twice. Questions posed to me would never have been answered in the flippant manner of Phaedra unless I was certain I would not be punished by the courts.
    Possibly she knows the decision might be to slap her on the hands with a minor fine and call it a day. No harm, no foul and definitely no written record of wrong doing or do over. That bell has been rung.
    I am a suspicious person by nature and this whole thing with Phaedra’s posturing stinks to high heaven.

    Things that make me say uummmm…….Could Apollo have sold the house so that it couldn’t be used for restitution? At the reunion, didn’t Kenya tell Andy that Apollo said he and Fakedra would pay Brandon for beating the hell out of him from their company account? Is this the same brother-in-law that was supposedly working as Fakedra’s paralegal where he was shown on RHOA filing something? Do you think Atty Radford has looked at RHOA scenes like the donkey booty video as proof she knew somethnng about her huzzzband’s businesses. Can Atty Radford get information like the payment on that mansion they moved into, the costs of the renovations they made, those expensive cars, traveling, spending thousands in the strip club, etc. to determine if their salaries alone could cover all of the spending they were doing?

    I think Phaedra should be looking at State Bar proceedings. Maybe her undoing will be her untruthfulness in her deposition. This woman is a joke as a plaintiff and an attorney.

    I am curious what kind of deal she made with the US Attorney’s office to have herself so far removed from Apollo’s proceedings.

    To keep responding in this manner, clearly shows her contempt for the process, but does she think that this will not go much further than the deposition or that the public will not be privy to this?
    She thinks that she can spin this into (southern) belles and roses?
    i’m completely baffled.

    I’m kind of worried about Phaedra. (Just kidding.) That poor, poor woman…to have no memory of these things…she needs an MRI, or something. (Kidding, again.) Especially since the DonkeyAss video was a big part of her storyline for awhile. She even debated the success of the video on the reunion. For her to suddenly lose memory of all of that is….disturbing. She thinks she’s being sly, but she’s just being stupid.

    On the other hand, maybe she DOES have a memory issue…and that’s why she calls her kid “Mr. President”? Maybe she doesn’t remember her own kid’s name? If she’s taking cues from Arias, she’s following the wrong role model when it comes to legal problems. That “memory fog” didn’t do Jodi any good, either.

    Advice to Phaedra: If you are going to be involved with criminal activity (allegedly), you might not want to be on camera.

    Hmmm…I wonder if they will make Andy do a deposition?

    She’s going down. Slowly, but surely. She shouldn’t lie when she has stated on her TV show and her Websites that she was very aware of her association with Nida fitness and had her pics taken for the Cover of the fitness DVD’S . Allegedly…..she was the brains behind Nida fitness as she said on Cam. Kenya ought to breath a big sigh of relief that she didn’t work for them….n get paid with their Dirty Money.

      Does anyone actually believe that Nida Fitness made ANY money? I don’t. Show me a balance sheet. Those videos were not flying off the shelf; there was no marketing blitz to sell it. It was probably and allegedly used to launder Dirty Money. Phaedra is either the dumbest person in the world and really thinks she can thumb her nose at the legal system and get away with these fraudulent schemes, or she is completely innocent. But, if in fact she is guilty, she is mocking everything and everybody and is showing nothing but contempt to the law and to her fellow pharishioners (aka her naïve phans). Talk about issues. She really doesn’t believe in any power higher than herself. And that is exactly why she will get burnt. The moral dichotomy of her psyche presents a person who offends authority because they are offended by authority. The authority of law and the authority of the church. Yet at the same time she studies the law and runs around proclaiming to be a Southern Belle and thumping a bible she rejects. This woman is an absolute thoroughbred of a mockery.
