The Curious Case of Parks v. Stanton Chapter Two: A Tale Told By An Idiot, Full of Sound and Fury, Signifying Nothing

Phaedra face2

ATTENTION: I’m thrilled that you may want to excerpt small portions of my work and link to my site with proper credit. Thanks so much! But if you are here to steal my work, only bad things await you,  ranging from karmic paper cuts to the wrath of my legal team.  You could wind up with cysts and diseases.  You don’t want that, do you?

Chapter Two: A Tale Told by An Idiot Full of Sound and Fury, Signifying Nothing

It’s interesting that that the genteel Phaedra who starts off with “yes sir, no sir”  quickly devolves into visions of neck rolling, eye rolling and doodling. It’s also interesting that Radford manages to get her insolence on the record. If you missed Chapter One, you should go read that first. It will answer your constant question of “Can she do this? Is this legal?” It’s all in the motion.

Here is another excerpt from the Brief in Support by James Radford:
Sidenote: Trial junkies will love his blog. Lot’s of interesting cases from everywhere.

“This refusal to answer questions is the latest instance of Parks’ abusive and bad faith conduct in this litigation. She has filed a frivolous lawsuit against Defendant Stanton, used her wealth to stifle the publication of Stanton’s truthful narrative, and then refused the basic obligation of any litigant to fully participate in the discovery process. Parks apparently believes she is above the law, even in her own lawsuit. She must be compelled to fully cooperate in her deposition, and her conduct must be sanctioned. The credibility of the civil discovery process is very much at stake here.”

And now, more from the deposition, the Apollo questions.

Q: Is you legal name Phaedra Parks?
A: Yes Sir. It’s Phaedra Parks Nida.

Q: Did you have it legally changed upon your marriage to Mr. Nida?
A:Yes

Q:And when did you marry Mr. Nida?
A: November the first, 2009.

RHOA Phaedra Face

Q. Your lawsuit sounds in defamation, is that right?
A. I believe so. (Um, this is a yes or not question to an attorney. She already equivocating! )

[lots of thing happened in between here and the next questions but, for the purposes of this story, I am going to focus this chapter on the Apollo line of questioning. There will be other chapters of course.]

Q: Your husband recently pled guilty to a number of federal financial crimes. Is that correct?
A: I wil not be discussing my husband.

Q. Well you don’t have to discuss him. But is that true, that your husband recently pled guilty to a number of financial crimes?
A. I will not be answering any questions regarding my husband.

Q. Okay so you are going to refuse to answer the question?
A. That is correct.

Q. All right. Do you believe that your husband’s criminal activity has an effect on your reputation?

And I’ll note again that you are doodling . You appear to be ignoring me. Are you refusing to answer that question as well?
A: As I have answered earlier, I will not be having any answers having any discussion regarding my husband.

Q: Okay, I am going to continue to ask you questions, and if you refuse to answer, I’m going to ask that you state that you’re refusing to answer because if you just ignore me, I don’t know whether you are thinking about the answer or refusing to answer and we are going to be here all day, okay? Who is your husband? What is his name?
A. Apollo Nida.

Q. And when did you first meet Mr. Nida?
A. In the ’90’s (LOL NO SHE DID NOT JUST SAY THAT!)

Q. Okay, That’s a ten year period. When in the ’90s?
A. ’95, ’96, ….well ’96, ’97 maybe… (Seriously? Who doesn’t know when they met their husband? This is a harbinger of her future testimony. Evasive, and uncooperative I mean perhaps she is not sentimental, but most people know to the day…she can’t even get within three years? And these are the easy questions)

Q.And did you know at that time he was involved with criminal activities?
A. I did not.  (Apollo was incarcerated  from 7/28/2004 – 5/27/2009 she married him less than six months after he got out of prison. Seems like an obvious assumption she knew he was a criminal and married him as soon as he was out of jail. I guess she means she didn’t know on the day they met?)

Q. He was incarcerated sometime after you met him, is that right?
A. I will not be answering any questions about my husband.

Q. Okay, so you are refusing to answer that question. Is that right? Is that right?
A: That is correct.

Q. Okay. And you knew when you married him that he had been involved in a number of criminal activities is that correct?
Again, if you’re refusing to answer, just say it because if you ignore me I’m going to wait all day for you to answer.
A. I will not be answering that question.

Q. And you knew that the criminal activities he was convicted of and incarcerated for related to financial fraud, it that correct?
A. I will not be answering that question.

Q. Okay. And you married him in spite of your knowledge of his involvement in financial fraud, correct?
A. I will not be answering that question

Q. Mr, Nida is also a cast member of the Real Housewives of Atlanta, is that correct?
A. That is incorrect.

Q. Well he appears on that television show along side you, is that correct?
A. I will not be answering that question

Q. Okay. And you have been part of a number of business ventures with Mr. Nida is that correct?
A. I will not be answering that question

Q. Okay, For example, if I went on your twitter page, I would see a picture of you and your husband standing together as part of something called Nida Fitness, is that correct?
A. That is incorrect

Q. Okay, at some point was that displayed on your twitter page?
A. I am not sure. (SERIOUSLY? I thought you had to answer the questions during a deposition??)

Q. Okay, Do you think your association with Mr. Nida has any effect on your reputation?
A. I will not be answering that question

Q. Why not?
A. Because I will not be answering any questions related to my husband.

Q. And do you not think your relationship with your husband is relevant to the instant litigation?
A. No, it is not.

Q. You don’t think it’s relevant to your claim of reputational damages?
A. No it is not.

Q. Okay, you don’t think that your husband’s involvement in numerous financial crimes is relevant to the question of whether a reasonable person could believe that you are also involved in those crimes?
A. No it is not.

Q. So in your opinion, it has no relevance, is that right?
A. Correct.

Q. Okay. Have you had awareness that your husband was involved in criminal activities while those activities were going on?
A. Again, I will not be answering that question

Q. Are you pleading the fifth amendment? (If she says yes to the question, she would be invoking her right to not incriminate herself.)
A. I will not be answering any questions as it relates to my husband.

Q. Okay. What is Nida Fitness Incorporated? What is that? What is Nida Fitness Incorporated?
A.  It sounds as if it is a company. (Seriously? Can you believe she is doing this?)

Q.  Is that a company that you are involved in in any way?
A. No sir. (WHAT???)

Q. Have you ever been involved in it?
A. Not that I know of. (And here we go with her denying knowledge that she was included in any of Apollo’s business deals.)

Q. I’m going to show you Defendant’s exhibit 2. This is something that I got from the Georgia Secretary of State’s website. It’s a record of 2013 corporation annual registration of Nida Fitness Incorporated. And the CEO and the CFO are listed as Apollo and Phaedra Nida. And there’s a section that says “authorized signature”. Beside that it says Phaedra Nida. Are you in fact a CEO or a CFO of this organization?
A. Oh! You’re talking about my exercise company! Okay. I’m sorry. I’m sorry. I was mistaken when you were saying something else. I apologize. (SERIOUSLY? She was mistaken when he asked what Nida Fitness was and it didn’t ring any bells for her?  She answered “No Sir” when asked if she had any involvement in the company that she is the CEO of? She was mistaken? Oh deal Lord this woman is insane.)

Q. What did you think I was saying? (Excellent question!)
A. I didn’t know because your line of questioning has been so suspect, shall I say. So yeah, this is my exercise company. (HIS LINE OF QUESTIONING IS SUSPECT? DID THAT ACTUALLY COME OUT OF HER MOUTH?)

RHOA Phaedra face 3

Q. Okay. And you and Mr. Apollo Nida are jointly the CEO of this company?
A.  On paper yes.

Q. Well, tell me, is there some difference between what’s on paper and reality?
A.  I mean I obviously have a workout company and you know, he is on the workout videos with me.

Q. Okay but does he have a formal relationship to the business? In other words, do you pay him to appear in the videos or does he have some interest in the business?
(Phaedra’s attorney says that is two questions so Radford asks them separately.)

Q. Does he have an interest in the business?
A. Yes, sir.

Q. Okay and you and him jointly own this business, is that to correct?
A. Yes. Yes Sir.

Q. What is this business? What is the business that this entity is engaged in?
A.  Exercise workout videos.

Q. And Anything else? I guess the production and sale of videos, is that a fair description of what the company does?
A. Yes sir.

Q. Does this company do anything beyond that? Seminars? Personal Training? Anything like that?
A. No that I’m aware of. ( You are not aware if the company you are CEO of does seminars, personal training or other services?)

Q. Okay. And you derive some income from this business?
A.  Yes sir.

Q. Okay. About how much income in 2013 do you derive from this business.
A.  I would have to look. I wouldn’t know offhand.

Q.  Just estimate.
A.  I would not know, just to be honest with you.

Q. More than a thousand dollars?
A.  I would not know. Just to be very honest with you, I wouldn’t know. (She has no idea how much she makes at any of her jobs, btw.)

Q. Do you think it might be possible that it might not be more than a thousand dollars?
A.  I wouldn’t want to make an estimate without actually speaking to an accountant who handles this.

At this point Radford has to ask Phaedra several different times who the accountant is. She provides a name of an accounting office but she doesn’t know the name of her personal accountant who handles her finances. Eventually she comes up with a name and says he has been handling her finances for five years. Perhaps she is going through the change or experiencing early onset dementia.

Q. Okay. With respect  to Nida Fitness,  I would imagine that you had some capital that you used to start this business, is that correct?
A.  Yes sir.

Q. Okay. And did you and Mr. Nida both contribute to that capital?
A.  I don’t believe that’s relevant.

Q.  That’s not what I asked you. Did you and Mr. Apollo Nida —
A.  I don’t know.
Q. both contribute to the capital
A. I don’t know.

At this point there is a bunch of back and forth where Radford is trying to determine who would know this answer. Phaedra continues to  be forgetful, unsure and evasive. She says the start-up capital would not have come from anyone other that her or Apollo but is not sure who contributed or if she did at all, or if he did at all. She will not admit to any commingling of funds regarding Nida Fitness. The questions move on to other names mentioned on the company registration. Stephen Want is listed as Secretary.  Phaedra really doesn’t know anything about him.  He used to work for Nida Fitness. He was in marketing. He just sent in an unsolicited resume. They hired him. Radford wants a copy of his resume. Phaedra isn’t sure she still has it. She has a production company in California that hands the distribution of the videos. They just send a check. Who gets the check? Do Apollo and Phaedra split the profits? Phaedra has no idea. She also doesn’t know the name of her contact with the company. This entire line of questions goes no where…

In Chapter 3 we move on to her involvement with National Recovery Group Inc…and where she presumed Apollo’s income came from.

As an “attorney” she should know full well this will not fly with the judge. Apollo’s conviction was enough to cost her this case, not that shehad a xchance but the attitude and clear lack of cooperation will be enough for the judge to rule in Mrs.Statton’s favor. Stupid stupid woman. Smh

I agree, why doesn’t she just drop this case against Angela. Now that Apollo is going back and she he was involved in illegal activity while married and in business partnerships with her, it just subjects her to all kinds of other legal problems. Let this women write her book and move on. There are books written all the time about people that are not necessarily their account of events, but they are published. Oprah Jz., ect.

I am not a lawyer but I was Googling exactly that question this morning. If she pleads the 5 the she can be declared in contempt and the judge will throw out the case. There is a good discussion of this issue by attorney Barry Zalma where he concludes:
“The issue is simple, the Fifth Amendment to the United States Constitution, is a protection (a shield) not a weapon (a sword). If a person does not wish to testify in a manner that might incriminate him or her criminally do not file a suit where you might be required to testify in a manner that might incriminate him or her criminally.”

But Faulkner got the title of his book from the Shakespeare quote — so you’re both kind of right.

Phaedra did not invoke the fifth, she just refused to answer questions, and suffered from a very poor memory.

I’m sure he has some to a degree but could he use this to request more info? If I were a judge and saw these answers, I would want to know myself. Phaedra’s not really doing herself any favors.

I mean I wouldn’t be surprised if bones were even stored in Mr. President’s diaper bag. If one knows they live in a glass house, why would one be so quick to hurl stones?

I’ve never liked Phaedra, way back to her first appearance. She makes ugly faces, acts ugly and I don’t have any idea who she really is. She did answer the questions well from HER position. I don’t believe her and doubt anyone in the room believed her. The judge might rule against her.

Phadrea said she that she wasn’t affiliated with Nida Fitnesss…..When her picture is plastered all over their dvd. #snickers If she would lie about something that can easily be verfied by doing a quick Google search, I’m pretty sure she’s lying about her criminal involvement with Stanton/Apollo.

So you believe that Phaedra didn’t know what Nida Fitness was? She didn’t know she was the CEO of the company? She doesn’t know how much money she made or lost on the DVDs? She has no idea how much she is paid by Bravo or how much she makes as a lawyer (some of those may not have been in this post, but are in the depo) She doesn’t know what year she met her husband?

        You are delusional.

I hope that justice prevails and Phaedra gets her comeuppance. She’s a thug in a too small Business suit with her tiny apples pushed up to her neckline. She’s too slimy n dangerous to peoples financial well being. Apollo could not have been that smart to set up the fraudulent. scheme. He can barely speak properly. Mr. Juvial himself is handsome n all, but he’s not that bright to set up such a scheme. That’s where the conniving Phaedra took the seat n directed him and others how to run the scheme…..allegedly?

Also the questions where she claimed not to know what Nida Fitness was and Radford produced the printout from the GA SOS Corporation database showing her to be an officer of the company speaks to her lack of credibility and being shady.

Luckily, Mr. Radford took on this case. I hope the truth will prevail and he will vindicate Angela at the end of this case. The best legal reporting TT! Reality TV needs its own legal issue blog given all the criminal/fraud cases they are involved in. Do you guys remember on RHOA when Phaedra (or was it Apollo?) was asked the same question that Stanton’s lawyer asked – how did they meet. Phaedra or Apollo gave this long, detailed story about how Apollo saw her in the car and followed her — then they exchanged phone numbers. I think Stanton’s lawyer should review 1st season she was on. IMO, the Judge in this case needs to take control of discovery and start issuing sanctions and ordering payment of attorney fees. It’s bad enough that a litigant can get away with these tactics, but officers of the court (i.e., lawyers) have a higher duty to the Court. I hope the Court strikes her Complaint and orders her to pay Stanton’s legal fees. If the motions warrant it, the Court could even refer the matter to the State Bar of Ga. State court judges are elected, so they usually are wussies about this. Kudos to Angela and her lawyer for continuing to fight. I can’t imagine how stressful this has been!

You fail to realize… When Angela rolled snitch in her book it failed to be about money…yes money is involved but it has nothing to do with it directly…in chess you have a varied array of moves until the opposing side puts you in check at that point you have to move to protect your king(pin) even at the expense of your queen(Apollo)… Angela has kept Phaedra in check and she is positioning to for a checkmate …Phaedra behind bars …if she gets money in exchange that is simply a bonus…at least that is my view… But let’s take this to a logical extreme…there are only a few things that criminals respect fear and money…if Apollo was not the mastermind it definitely isn’t fear that is motivating him not to talk and judging by his Kool aid smile I would guess he has a stash of money that will be washed and dry cleaned for him when he gets out…allegedly lol

While not defending Phaedra, her remarks are actually fairly typical for an adverse party being deposed as there is no penalty for not “remembering” as no one can prove whether or not a person remembers.

This wouldn’t work in front of a jury because it would make a witness appear unsympathetic and obfuscating. However, the purpose of pre-trial discovery is to make it as difficult as possible for the other party. In a deposition, typically you can be questioned on matters that might not be permitted at trial. Your attorney can object but you would still have to answer. Hence the advice of most attorneys to their clients is to not have a great memory in deposition.

There’s a difference between not remembering and refusing to answer a question. She refused to answer several questions her lawyers did not object to. She said she wasn’t going to discuss her husband on several questions but then answered a few about him.

Also the judge will see the game ages playing. She didnt know about having a business with her namesake then all if a sudden she remembers? Your really trying to play the judge for a fool. She should expect heft sanctions

You theory is somewhat accurate if you are being deposed BY A PROSECUTOR who is coming after you for a crime. It makes NO SENSE if you are a PLAINTIFF who is trying to prove you are the truthful party and are suing someone for LYING about you. In that instance, you should have clean hands and nothing to hide. You are arguing that you are telling the truth and the other person is lying. So, dodging deposition is ridiculous.

The advice of most lawyers to clients being deposed is to say as little as possible and not to lie. Obviously, some of the answers exhibiting a ludicrously faulty memory may seem to be lies but there is no way for anyone to prove one is lying – unless one is handed a document to “refresh one’s memory” which was done at certain points in your excerpts.

As to what Phaedra’s ultimate goal is in terms of winning the case, I have no idea but the goal in this deposition was to give the opposing counsel as little information as possible even if the answers appear to be ludicrous because who wouldn’t remember.

There must have been some agreement regarding relevancy of certain lines of questions prior to the deposition because although there is a right to object (very limited) on grounds of relevance, my experience is that the questions are answered with objections noted in the record. If opposing counsel really wanted to play power, they could actually attempt to get an immediate court order to compel an answer. However, from the conditions which the attorney agreed to, it seems as though he just wanted to get her deposed.

Phaedra may well regret having brought the case but it’s legally difficult to just drop a case because of what opposing counsel can unless the parties agreed to mutually settle all claims with a confidentiality agreement.

LOL – Never saw the show but I have had to attend a fair number of depositions and also assist with preparation of witnesses.

It’s all about the deposing counsel attempting to get facts on the “record”. The deposition transcripts are not generally seen by anyone except the attorneys as they aren’t used in trial generally except to impeach a witness – which is why you want to remember as little as possible because then there is nothing to impeach.

As a practical matter, depositions are used to determine whether and how much a case should settle at in terms of seeing what potential witnesses might say because it’s not just the plaintiff and/or defendant who are deposed but any potential witnesses can be subpoenaed for a deposition.

I don’t know what Phaedra’s ultimate litigation strategy is. I assume she thought that Stanton would fade away if she was hit with a lawsuit. Little did she guess that Stanton would find an attorney who was willing to actually defend the lawsuit and bring a counter-claim.

Again, I am not saying that Phaedra’s answers are believable or that she isn’t playing games. I am just saying that this is the way the deposition game is normally played and if opposing counsel really had issues with the answers, he could have stopped the deposition and sought a court order to make her respond.

The judge also has the option of throwing out Phaedra’s case for wasting the courts time. Then the only remaining thing would be Angela’s counterclaim.

She allegedly lied about the following IMO: When the attorney asked if she had a picture of her and Apollo on her twitter account at some point she said, “I am not sure.” Really? When the attorney asked if her company did seminars or personal training she said, “Not that I’m aware of.” Really? She said she didn’t even know how much money her company made. When asked if it was more or less than $1,000.00, she said, “I don’t know.” Really? I remember when Phaedra would tell anyone who would listen that her DVD had outsold Kenya’s DVD. She even said that her DVD outsold Jillian Michael’s DVD. When the attorney asked if both her and Apollo contributed to the capital of the business she said, “I don’t know.”

Not only is he convicted, he pled GUILTY, there is no prosecution to avoid (unless it’s for other crimes not covered by this conviction, hmmm…).

Better to be thirsty to get a boyfriend to marry her or be ambitious to be famous and rich like others in a legitimate way than to be married to a convicted criminal who steals from even retirees and has sons who will forever have a criminal father. I would prefer to be Kenya right now than phaedra.

I’m not looking for pity. Life is what it is. My sweet husband of many years is dying of Congestive heart failure and dementia. It’s only me to care for him and when I can, I head straight to your site, because I know it will calgon me away for a while. you have no idea how much I appreciate what you do. Laughter does heal.

vbewley10….yep a lot of the people here have much to thank TT for. Your “calgon moment” describes it perfectly. I know you don’t want pity, you just want to show your appreciation to Tamara for the diversion from the sad situation you are experiencing. Laughter does heal and lift the sprit. I have someone close to me with stage4 liver cancer so I know what you are talking about. We have to be thankful for the escapes we get from visiting Tamara’s Alternative Universe. Its a nice place to be every once in awhile. Just knowing that my two fur ball cats, who are definitely not gay, eat better than Banjo, who is suspect and finicky, makes my day. Does Banjo have a limp paw, who knows? And if they do they ain’t sayin’. Not that’s there anything wrong with that.

You know what we think? We think she didn’t think Stanton would secure Pro Bono help…mmhmm, she wanted to bankrupt and silence her as quickly as possible. And may be pissed off that “that plan” didn’t go as planned!

I’m not sure why anything I have written deserves that kind of response – get a grip.

I was responding specifically to the post regarding judge or mediator being present at the deposition as a deposition isn’t a hearing but is generally attended only by the person being deposed/his her attorney and the opposing counsel which may include staff. These people aren’t generally considered to be third party.

Who are the “members” present who aren’t a party to the litigation?

A deposition is generally “self policing” unless the parties seek an emergency court ruling which is almost unheard of.

I’m not defending Phaedra – just pointing out that many depositions are pretty much like this with the reluctant witness claiming a faulty memory and not admitting to anything at all until forced to

You feed Banjo dog food? For some reason I pictured you cooking up his dinner each day, chicken, veal, octopus etc… King Banjo. Now that I know you feed him dog food (which is what I feed my dog) that puts him back into peasant mode.

He eats expensive grain free dogfood, this bag is DUCK based. He will not eat it would some sort of oil (olive is okay but he prefers Flax) or broth (Boxed will do in a pinch be he prefers my homemade), He also appreciates canned pumpkin if is tummy is unsettled. He will not drink water that is not fresh from his bowl, but he will drink from the toilet. When a chicken is roasting he doesn’t leave the kitchen and will stare me down until he gets some.

I wish he were a peasant.

Yeah. She’s done. For Phaedra to claim damages, she must first show her salary or earnings estimate before and after the book. And being that she was on the show, had children to care for, and went to school… Chances are her salary reduced because of other occupational interests instead of the book itself.

Plus you can’t deny talking about your husband, when the book is about you and your husband.

People call Porsha dumb, but honestly, Phaedra’s stupidity is the pink elephant in the room.

First, awesome, TT. You really should be formally recognized for your work. This is a whole different level of “blogging”.

Second, while I certainly forgive–people screw up and they deserve a second chance–and I realize that Phaedra has not been charged or convicted of anything YET, I am sick of Bravo employing felons. Not felons who have served their time and repaid their debt to society, but employing felons who have pled guilty. These people haven’t just been charged but not found to be guilty or admitted their guilt yet, but people who are now officially felons, as determined by the justice system. It’s ridiculous! And the way they are editing the Gudices so the viewer is led to feel sympathetic is shameless. Then consider the (lack of) remorse these people show.

If I was the type of person who was brave (and motivated) enough to start petitions, I would. I think Bravo is a really disrespectful and tasteless network. I mean far beyond the reasons people call it that normally.
