Chapter One : When Is A Deposition Not a Deposition?

Yesterday, everyone’s favorite hermit ventured across multiple counties and merged onto numerous interstates (God, I hate merging) in order to obtain this summer’s must-read, The Deposition of Phaedra Parks from the case of Parks v. Stanton.  And it was so worth it. I spent some time perusing the six or eight in thick file with all of the original motions that have been filed, I purchased copies of the most recent one, and then got caught in a horrific storm. I pulled into a Zaxby’s  and began to read. There is so much to discuss that I will be posting in installments.

But first, (said in my best Julie Chen voice) let’s remind ourselves of where we left off.  My last update was on June 24th. On June 19th, the judge had ruled that Phaedra must sit for deposition with 45 days.  So I’ve been patiently waiting to hear that occurred. The 45 days came and went without any indication that Phaedra had been deposed. Then, last Thursday, there was a new Motion to Compel filed by Stanton’s attorney, James Radford. I dashed over to the courthouse to get my hot little hands on it, and Lo! and Behold! there was a deposition!  So what is this Motion to Compel all about?  Thankfully, Radford writes motions in plain English unlike those New Jersey goons who write motions for the Laurita bankruptcy case. So I’m going to transcribe much of it for you here, in the first chapter. Then we will move on to a variety of topics covered in the deposition itself.

The actual scheduling of the deposition was yet another puzzling event in an already very curious case. We have discussed before that a plaintiff refusing to sit for a deposition is unheard of.  She even tried to use an affidavit as a proxy for her deposition responsibility. As one TamaraTattles.com commenter who is an attorney put it, “ the most interesting thing is that she filed an affidavit on 3/31/14 presumably to defeat Stanton’s motion for summary judgment. Anyone can file an affidavit. She filed it to serve as a proxy for her deposition but this is not allowed. A party cannot file self-serving affidavits and the “facts” set forth therein must be admissible in evidence; they cannot be based on information and belief.” Or, in plain English, Phaedra is shuckin’ and jivin’ every way she can to avoid being deposed. Plaintiff Phaedra Parks is attempting to make a mockery of this Court and of the civil discovery process.  On June 4, 2014, seemingly out of nowhere, long after discovery had expired, and after persistently refusing to sit for deposition, thus requiring a motion to compel, counsel for Parks  emailed (Radford) and volunteered to sit for deposition.

Phaedra provided Radford with a choice of a few dates and the date of June 19, 2014 was chosen. This all occurred while both sides were waiting for the judge to issue an order compelling Phaedra to comply. In the days leading up to the deposition, Phaedra began to place numerous conditions on the deposition. She required that if the deposition was to be videotaped, her attorney would be in sole possession of the video.  She also demanded that Radford not place the transcript of the deposition on his website. Which is why all the constant visits to Radford’s website proved fruitless. She also demanded that he not share the contents of the deposition with the news media.  Radford took what he could get and took the “deposition” with those conditions.

However, Radford stated:

Parks’ position that counsel is somehow prohibited from publically sharing information and opinion about this case is contradicted by the Georgia Rules of Professional Conduct and well-established Supreme Court jurisprudence.

Radford cites the following case-law (abbreviated for brevity, Bolded as written):

…an attorney may take reasonable steps to defend a client’s reputation and reduce the adverse consequences of indictment, especially in the face of prosecution deemed unjust or commenced with improper motives.  A defense attorney may pursue lawful strategies to obtain dismissal of an indictment or reduction of charges , including an attempt to demonstrate in the court of public opinion that the client does not deserve to be tried. (Gentile v. State Bar of Nevada)

Strangely, that very day, June 19,2014 this Court entered an order compelling Parks to be deposed. Counsel received a copy of this order on June 20,2014 the day after the deposition had been taken.

Strange indeed.

The Motion:

Defendant Stanton hereby moves for an order requiring Plaintiff Phaedra Parks (“Parks”) to fully participate in the discover process by re-submitting to deposition, and by fully answering questions that are reasonably calculated to lead to discoverable evidence regarding (a) her relationship with Apollo Nida and the extent of her knowledge, benefit from, and/or participation in his criminal activities and (b) the timing and content of her agreement with former co-defendant Augustus Publishing, which resulted in Augustus ceasing the marketing and sale of Stanton’s book.

The motion goes on to request that Phaedra bear the cost of the second deposition as well as all of the attorney fees associated with the eleventy billion or so Motions to Compel that the defense continues to have to file. She also moves for an order to reopen discovery for a period of 90 days.

Let’s talk about that motion for a minute. Especially the part where Phaedra’s relationship with Apollo her relationship with Apollo Nida and the extent of her knowledge, benefit from, and/or participation in his criminal activities. Phaedra is suing Angela for defamation and asking for damages. In his Brief in Support,  Radford states that the ultimate question in this case is “whether a reasonable person could believe that Parks herself was involved in the sort of criminal activities described in Stanton’s book.”  Radford continues , ” This line of questioning is closely related to Parks’ claim for damages, since her very public marriage to, and business partnership with , a man with multiple convictions for felony financial crimes obviously has an impact on her reputation separate and apart from any damage thereto caused by Stanton’s book.”

It would seem that Apollo’s previous convictions will be used in trial (if it comes to that) to support the statements that Stanton included in her book. The veracity of Stanton’s story was once questioned by many, myself included, until Apollo’s indictment showing that his criminal activity was ongoing throughout his marriage to Phaedra.  This would make Apollo’s criminal activities and Phaedra’s knowledge, or lack of knowledge, a crucial element for the defense. During the deposition refused to answer all but a couple of questions about Apollo.

But that is another chapter. ..

    Wow. That is really fascinating. I love a good true crime story.

    But what’s more amazing to me is…you drive the freeways. I avoid the freeways, as much as possible. Drivers here are worse than the drivers in California and Florida combined. It’s like being on one of those bumper car rides. People seem to aim for me.

        I got lost coming out of Atlanta when I moved to KC from Orlando. Traffic was busy, but not that bad when I was there. If you’ve never been on the KC freeways, you can’t understand the level of crazy. There is no merging here. If you are in the wrong spot, they will literally run you off the road. If they want to change lanes, they will run you off the road. Bunch of asshole drivers here.

        Then, of course, there are the snipers who like to pick people off when they get on and off the freeways. Like merging is not dangerous enough.

          I’ve started working on the next chapter drunk.. lol. so I will have to edit it tomorrow I am mostly transcribing tonight while watching an marathon of some show on MSNBC about San Quentin…

          I used to be fine with merging, public speaking, bathing, getting my picture taken, I keep telling my therapist something happened to me and made me crazy. Apparently, it’s “just” mental pause. ​Oh okay, so my entire personality is differnent and that is just normal. My therapist diagnosis THIS TIME is…I forget (because I AM GETTING DEMENTIA!) the one about inability to cope with change, and by change she means THE CHANGE. She is there to tell me this is all completely normal. BUT IT IS NOT. Apparently, I am having an issue coping with THE CHANGE. Um, no one told me THE CHANGE meant I would suddenly stop bathing and having any desire to leave the house. Which I am told is “perfectly normal.” Or that I would have debilitating panic attacks . Which I am told, “It happens”

          I used to be able to merge just fine when I had a Mazda (VROOM VROOM) but when I stupidly went back to a Honda…

          Basically, I lack the pick up to join the rat race anymore. And quite frankly, that pisses me off.

        As far as traffic – Austin’s traffic is apparently on some list somewhere that says “you’re a dumbfuck if you try and drive on our can’t-handle-the-population-boom highways.

        There’s only two ways to combat the problem. In your case, T, ditch the Honda and get a sports car. In my case it’s STOP FUCKING MOVING TO AUSTIN (I already bought the “fuck, if I’m going through THE CHANGE I might as well acknowledge it with a penis car”).

        I try not to be an asshole but when your prostate hurts a Pam’s gotta do what a Pam’s gotta do.

          Phaedra sued Angela for defamation over her book. Angela countersued for interfering with her being able to sell the book. Phaedra expected Angela to cave after TWO YEARS of this legal battle so far because it is expensive and time consuming. Angela is refusing to fold.

          The longer this drags out the more everyone talks about it. Phaedra should have just let the woman make her little money. When the book first came out no one believed it. We would all have forgotten about this by now.

          The LAST thing Phaedra wants is a trial. Right now not that many of us are even paying attention to this case. But if it goes to trial the media will cover it.

      Interesting . I like California roads better, because it’s a lot of open space and not clustered. Then again when I was driving through there. It was in the Mojave , and not Los Angeles.

        I lived in the San Francisco area for a few years. The roads may have been crowded, but at least people were considerate enough to allow people to merge. Even during rush hour. There was always a flow to the traffic.

        Orlando was similar. But you had to deal with tourists who didn’t know where they were going. They’d see a Disney exit, and freak out.

        Here in KC, they don’t give a damn about anyone.

      Same here with the panic attacks, NEVER had one before under the most dire circumstances. Was told hormones, or lack thereof, control adrenaline. Have learned techniques to breathe through. You are not alone…very similar response to change here. You rock…don’t forget it for a second. 🙂

    Interesting read… Waiting for the next chapter.
    I too, hate the I interstates. This country girl has been driving to Emory for 20 days while my mother is a patient. These fools cannot drive for shit and add water (rain, snow,etc) and it’s pure hell. I need a bottle of wine once I get home. So, bless you for braving the fools and the rain to get the tea!

    Since the only two times I’ve had to be in a courtroom were to get my divorce and when renters stole my washer and dryer when they moved out, I have little knowledge of legal proceedings. I have a question. In your teaser for the next chapter TT, you stated Phaedra refused to answer all but a couple of questions about Apollo. How can she get away with that? Oh and one more thing in your disclaimer, I thought it was supposed to be anal leakage not anal itch. Confused about both lol.

    Why doesn’t she just drop her complaint? If she did, Stanton would probably drop her counter suit and all this embarrassing questioning would go away. She’d lose face, but hey, she’s not worried about that, since a lawyer marrying a felon is the horse outta that barn.

    Stanton May want her to lift whatever embargo has has on the publication of her book though…

      Angela is counter suing Phaedra and Radford will seek attorneys fees plus a claim for frivolous litigation. I don’t think this is going to go away easily. Phaedra messed up by filing suit. It is drawing more attention to her alleged involvement in criminal activities. The timing of Apollo’s latest conviction does not help.

        Phaedra seems to have gotten caught up with her false beliefs about herself being so clean. She really believes that people buy that facade of hers, it’s backfired though because she was stupid enough to believe it herself. Her fatal flaw.

      questions: How did she even have the power to apply such an “embargo” on the publishing company in the first place? Especially without/before a win in court on this issue? Are some publishing companies THAT scary of civil threats? A judge has to order them to cease marketing and publishing it, not a Parks [lawyer]. Shame on their fears in business! …if this is how it went down?
      And Vibe…why? Why “settle” out-of-court with her? That’s the word on the cyber-curb…that y’all did that. How much? How much y’all wrote a check for to someone that “got mad” at y’all for doing what you’re in business to do: publish and promote! I would not have rewarded her bratty tantrums. Mad cause “a clear wrong-doing” [per book in question] returned to EXPOSE her, the REAL her!

      Sometimes, when we hold a mirror up to someone, they LASH OUT, BREAKING the proverbial mirror! OK, emotion…move on… It’s WHEN they got the NERVE to expect you to not only clean up the broken pieces, but glue it back together, then on top of that, buy them a new mirror with your $, and dare not HOLD UP THE NEW ONE or the OLD BROKEN one to them ever again. Like this silly act would heal their psyche? Warped!

      The more “she” keeps gettin’ away with this [legal] TomFoolery the more that passage in Stanton’s book rings true: secret societies. J/S

      reading that Robin Turpin book now, borrowed it… the way the law is turned, vague, broad…so disheartening! Stanton stand strong! The truth is much older than lies–remember this.

        I think Vibe settled because it was probably cheaper to pay Phaedra than suffer through a long, drawn out court case. Vibe may also have thought Phaedra was innocent THEN or at least couldn’t be proven otherwise. Now is a different story. Even if she could, Phaedra’s ego and remaining reputation wont let her withdraw at this point. She most likely thought Angela was no match for her. ha.

    You know what’s really confounding? Parks is an attorney, right? Shouldn’t she know the basic protocol, long before bringing this lawsuit against Stanton? How in the world are YOU gonna be the PLAINTIFF and resist delivering on the basic 1 2 step process required to getting on with the suit? It doesn’t make sense! Why delay something YOU brought about??? What do you have to hide, Phaedra? If you feel you are in the right–speak to that right! Sit for the deposition. Are they THAT scary? I suppose if you’re not telling the truth, they are. But AGAIN, You are suing her! Then why sue her at all? Oh, to get back at her. How dare she write a book about how you DID her [per said book]. You had the right to do what you did but she can’t exercise the right to write about that “doing.” Ego! The nerve!

    Some books have always spoken to Scorpions’ vengeful qualities. But I always thought that they’d want revenge when someone ACTUALLY WRONGED them, not for someone that wrote about being WRONGED by one of them. Warped!

    P.P., why go on living this lie? It’s aging you; even with make-up on, can still see it all around your eyes. No matter what the outcome, there’s still a large chunk of the populace that will ALWAYS believe Stanton’s words in said book; they read too real…too true. Why care about the court of public opinion? P, you dodged prison! See that as WIN in it of itself. You gotta win [manipulate] the minds of public-thought [re: your character] too? Really? That insecure? Chile, don’t let your ego do you like that! A waste of energy.

    Had you not posed as a “friend” to her, kept it business, you wouldn’t be in this predicament with her today. It’s the betrayal in friendship [or assumed friendship] that led her to write, not the betrayal in business [from what’s gleaned in the book]. Repent. Study self, P..P.

    So Phaedra was deposed on June 19th but has to sit for another deposition because she refused to answer questions?

    Angela is lucky to have such a patient, efficient attorney representing her. Thank you Tamara for finding out all the tea on this case. I feel it could lead to Phaedra’s downfall. All at her own hand too.

    Phaedra no longer surprises me. She did exactly what I thought she’d do which was try to arrange a conditional deposition. I’m glad Radford pulled her card. I can wait til he posts her deposition transcript. If she’s caught in a lie she could be charged with perfumery or worse

    I feel sorry for Phaedra’s attorney. She probably wont listen to one word of advice. Didn’t a few of her old attorneys withdraw from this case?

    Outstanding TT! I can only imagine the anxiety you had driving to get the tea. A trooper indeed! IMO thug mentality, which applies to both Apollo and Phaedra, is almost like a brainwashing. They continue with the same behavior after given 2nd chances and very few makes the change. Some rap artists is the same way cough T.I. Id bet my bottom dollar Angela isn’t going away even if Phaedra offered her a deal to settle out of court. I don’t believe Angelas motive is money but rejection. Justice doesn’t always prevail but I think the court system is going to be in Angelas favor. One for the underdog!!!

Parks has engaged in criminal activities for a number of years without any consequences, justice will be served in the near future, the net is closing in upon her.

Stanton; for your evident presumption that your readers are intelligent; for your witty and irreverent humor, and for telling it like it is about any number of ‘celebs’ (it seems that no one is sparred) and in process, for occasionally sharing bits about yourself.

    Though I doubt that you would know or reasonably care, I lurk far more frequently than post here, because my thoughts typically are expressed by someone who beat me to
    the punch, BUT “Tamara Tattles” is almost

    “no one told me THE CHANGE meant I would suddenly stop bathing and having any desire to leave the house. Which I am told is “perfectly normal.” Or that I would have debilitating panic attacks .” It sounds very hormonal to me. Before spending one more penny on the mental health angle I would get a comprehensive hormonal workup. Dr. Robert Goldman of Georgia Hormones in Alpharetta is the doc to see. ( when started bioidentical hormone replacement I had some symptoms disappear immediately, as if someone had flipped a switch.)

      I got the whole hormonal work up. Basically they said you still have hormones and will probably have a few more periods.

      Seriously, the general attitude is, “this is what happens, welcome to aging.” But I see plenty of women in their 40s and beyond that go work out, don’t gain a billion pounds, keep their jobs, and you know, continue to function in the world.

      Why am I whining about THE CHANGE in the Phaedra comments? I’m sorry for bringing it up. 🙁 ​

        Its okay TT. whine baby girl whine! You’ve earned the right……When my girlfriends and I , FINALLY, got through menopause, We laughed, when we discovered that at one point, each one of us had declared out loud, “WTF was That!!?”
        Its like walking in a dark tunnel bumping into things only to realize once you’ve reached daylight that it was only yourself you were bumping into. Scary! And believe it or not, alcohol will “light you up” like a sauna/steam room. The two things you crave the most, make you the most miserable with hot flashes and hormonal swings, Sugar and Alcohol. Oh and caffeine too.
        Walking and yoga “do” help with mood swings and bouts of fatigue and food binges.

        And thanks for such brilliant reporting. You are so on top of your game, girlfriend.

    TT thank you for braving the freeways! Phaedra refusing to answer questions only works in Angela’s favor. I retired from the judiciary and it looks to me like this is going to trial. This situation can be summed up in an old saying for Phaedra-You are the company you keep (marry/sleep with).

      That was the scuttlebutt when she first started talking about it. She doesn’t seem to have much of a….visible law practice. In the depo she says she does contract law. I’ve heard from people that work in her building that they never see her there. ​

    I don’t get all the glee about some person on tv. We don’t have all the facts so let’s wait. Vibe settled because they did not want the hassle doesn’t mean one party or the other is wrong. I wouldn’t believe a word Ms.Angela or to a certain point Ms.Phaedra says. I guess it is nature to love to hear about something bad about someone you don’t like.

      um, hey dumbass… THIS IS THE REASON WE DON’T LIKE HER! In fact, when the book first came out, I didn’t believe it at all. Then Phaedra started drawing a lot of attention to it, while her husband is going to jail for very similar things the book accuses her of, and I am quite content making a decision based on the facts. I’ve read several inches of court documents while you have been “waiting.”

    Staton luck up with having Radford as her Attorney. He is not giving up. I am sure that Phaedra assumed she could drag this on for a long time and the Attorney would quit. He appears VERY determined. I bet all the HW’s knew Apollo was doing something shady. After admitting spending $8K on strippers everyone had to think something was up.

If I can channel Phaedra for a moment, I believe she thinks that when a Judge or the Court, Orders her to do something, in Phaedra’s world it’s simply more of a suggestion really, nothing more. Ok, I need to stop channeling Phaedra now as I almost went down to the nearest prison for a conjugal visit.

    Well after reading and watching several things. I think Phadra most probably knew what Apollo was doing. Of course being that she’s an attorney she probably wasn’t too concerned with the details of what he was getting into. She knew exactly what’s going in and is going to try to make sure she comes out of these court proceedings looking like miss innocent. Because really what wife doesn’t really know what their husband is up to. Especially with money. I like Phadra but she isn’t any dummy. I think she is gonna try to land on her feet through this mess. That’s my thought anyway.
