Parks v. Stanton Update

NEW UPDATE: JUNE 24th.  The judge ruled on June 19th that Phaedra MUST sit for a deposition within 45 days. That’s pretty up all I know about it. Please excuse me whilel I continue to cling to life. #CheapChampagneHangover

MINOR UPDATE: Phaedra Parks has now listed herself as Pro Se. Her last remaining attorney is still listed, but it is unclear if he is dropping the case as well or if Phaedra just added herself as an attorney on the case for some reason. As you recall, Apollo lists himself as Pro Se in his criminal trial but also has an attorney of record. I am not sure what the benefit of that is.

Okay, I have a long version and a short version to answer your questions about what is going on in the case of Parks v. Stanton.  The short version is that Phaedra does not want to be deposed. Stanton’s attorney has filed motions to compel her to sit for a deposition. Stanton’s attorney has filed for sanctions. Stanton’s attorney has asked the court for a summary judgment based on this lack of cooperation. Then Phaedra’s last remaining attorney (four previous attorney on her side are no longer on the case) filed to ask for a summary judgment getting Stanton’s counter claims thrown out. Nothing has happened in a month as both sides appear to be waiting on the court to set a hearing date.

Now for the longer version. Below is an excerpt from an email conversation I had with someone about the information contained in the docket.Phaedra Parks Accused All Sorts of Nonsense by Very Troubled Woman

“What is very interesting is that there have been several motions  to compel and a motion for sanctions filed by Angela Stanton (see Feb. 2014 entries below). Motions to compel are filed when the other side is not participating in discovery (answering written questions or sitting for depositions); motions for sanctions are usually filed when the other side refuses to comply with a court order regarding discovery. So Phaedra, as you reported, was refusing to sit for a deposition when she was the plaintiff–she filed this lawsuit. And the most interesting thing is that she filed an affidavit on 3/31/14 presumably to defeat Stanton’s motion for summary judgment. Anyone can file an affidavit. She filed it to serve as a proxy for her deposition but this is not allowed. A party cannot file self-serving affidavits and the “facts” set forth therein must be admissible in evidence; they cannot be based on information and belief.

For example, how would Parks dispute Stanton’s allegations that Parks gave her a list of things to get using illegal funds and she handed those items over to Parks in the parking lot of a store, which several witnesses testified to? The only ways she could dispute this would be to produce a bank statement and check/atm receipt showing that she gave Stanton monies she legitimately earned and asked Stanton to go shopping for her. I really believe that Parks thought she would run rough shod over Stanton and now she runs the risk of having all her crimes exposed through the civil suit, which the feds are no doubt monitoring.” ~ Anon legal source’s opinion on information from the docket.

So then I got a copy of the affidavit that Phaedra submitted rather than sit for a deposition. As the legal source above stated, this is not kosher.  Phaedra REALLY does not want to be deposed. Despite Stanton’s motion to compel and motions for sanctions, it appears that Phaedra will not sit for a deposition under oath.

The affidavit is short and says nothing.

1) My name is Phaedra Parks. I am over the age of 21 and otherwise competent to provide this Affidavit.

2) I filed the about civil action against the defendant Angela Stanton in 2012. In my complaint I have listed multiple statements made by Defendant Stanton that are not true.

3) Specifically the statements of Defendant that are reprinted in paragraphs 73, 83, 93, 102 and 104 of my complaint are not true.

4) I have never been arrested for a crime or charged with any crime.

5) I have never been questioned by any law enforcement agency about any possible involvement in a crime.

6) I have never been involved in any criminal schemes with Defendant Stanton or anyone else.

7) I have never committed any crime other than routine traffic violations.

8) The facts above are based on my personal knowledge.

I have read the foregoing statement consisting of (7) seven paragraphs and declare under penalty of perjury that it is true and correct.  I understand that this affidavit may be relied on in the civil matter styled above.

So why would Phaedra refuse to sit for a deposition in a case she brought herself? It doesn’t make any sense. It would seem she would want to end this ridiculous suit and not drag it out. We would have all forgotten about this a LONG time ago she had just ignored the whole thing.

      It’s because she doesn’t want to be under oath when those questions are asked. Because I bet anything that Stanton has physical evidence to corroborate what is said and she may get caught in lies. Phaedra is dirty as hell and I truly think that the Fed know that Phaedra is dirty.

    Tamara, you are bar none the best blogger. period. If I lived in the Atlanta area, I would give anything to attend the summary judgment hearing where the judge will no doubt censure Phaedra for her (mis)conduct in refusing to be deposed and then filing this affidavit which is worth nothing. They say when you have no facts working for you argue the law, and if the law is against you, argue the facts. But when you have neither, just argue. This appears to be Phaedra’s strategy–just argue (“I have never committed a crime” blah blah). I cannot wait until her butt gets handed to her.

      The 5th amendment is available only in Criminal cases. Now she may not want to sit and be questioned in the case she filed, but that only heightens the suspicion about her involvement in my opinion. Side note: this is why casey anthony did not want to be deposed in the zanaida gonzalez civil defamation case because she does not have a 5th amend privilege and must submit to questioning)

        I oversimplified the 5th am privilege somewhat. I should say that it generally applies in criminal cases and to government questioning. The protection has extended in civil matters but once Phaedra does that, assert a 5th am. privilege to refuse to answer a question, her case is done and the feds are going to be all over her.

        ​The fifth amendment right is a right against SELF INCRIMINATION. It is used when someone is accused of a crime and they are not required to incriminate themselves. You can’t plead the fifth if you are the ACCUSER.

      Nope, when you are in a court case you have a right to depose the other side, ESPECIALLY when they are accusing YOU of a crime. If all the things she says are true and she is the one making the accusations, why would she refuse to be deposed on her own case? I’m sure Angela didn’t want to be deposed by Phaedra’s lawyers but she did. ​

        Phaedra should have let Stanton makes some coins and shut the hell up. Phaedera doesn’t want to be deposed because shes a lawyer and I’m sure she knows perjury is illegal. Tamara, did you see Phaedra on The Rickey Smiley’s show? She looked weathered and stressed. Clearly all of this is taking a toll on her.

        Thank you Tamara for the time and creativity you put into this post. I want to see Phaedra go down and go down hard. How do you become an officer of the courts, take an oath and without skipping a beat find yourself involved with accusations of this magnitude, Twice!!! Allegedly!!! Phaedra allegedly lead people down a dark road, people who were gullible,less educated, and from lower economic circumstances who tended to look up to her. Let me be clear I am does not excusing Angela’s and Apollo’s participation in these crimes!!!
        The fact that Phaedra had extremely close relationships with these people, speaks volumes about her character and blatant disregard for the Law. Why didn’t she encourage Angela to go back to school? Or encourage
        Apollo to develop a business? Or insist that if they were involved in
        criminal behavior she would not and could not befriend them because of her profession? Or because it just wasn’t who she was as a person? This thing might be bigger than Phaedra but she is the One common factor that Angela and Apollo had in common. And I want justice to prevail regarding this woman!!!

    Yes, Tamara! Phaedra is quite shady and trying to play the court for a fool by threading the needle. I believe in the full text of the affidavit Phaedra claims that she has never been involved in any “criminal enterprise” with Stanton. She knows that that terminology is defined in statute as an organized crime group of 6 or more people with a management hierarchy and that routinely engages in drug trafficking crimes. So she is technically correct that she was not a part of a “criminal enterprise” as defined by law. Shady Phae Phae strikes again! I guess all that time being a public defender for Georgia’s street hustlers has taught her a thing or two about turning a phrase for the sake of throwing the scent of her trail.

    Well, it is obvious that she does not want to deposed under oath because she would then be on record. If she was innocent this would not be a concern. The affidavit is misleading, but really carries little weight. Under oath there’s no telling what she might be asked and could find herself in a very dangerous position. Not agreeing to be deposed points directly to guilt. It is a matter of time before the Feds deal with Parks. She will go to prison eventually, thank goodness.

      Phaedra is so dishonest with herself that she must be delusional at this point regarding her complicity; and the idea of actually being charged much less prosecuted for anything is probably in a remote place in the recesses of her fine criminal mind. If indeed she was involved, and I believe she was, she is a psychopath. Her behavior has been so contrary to what she is and her facade so elaborately disjoined from reality that she is worthy of at least a tome or two on her background and how the hell she ended up like this.

      In my opinion, which is not very educated on this matter, I would think the judge is likely to toss Phaedra’s case but she wants the judge to toss Angela’s counterclaims and that is not likely to happen.

      And if Phaedra really is now representing herself, and her fifth attorney has quit, God help her. She certainly didn’t help Sheree out any with her case.

      Also on Avvo which is where clients rate their lawyers, She has one review, it’s not a nice one and the interesting part is according to AVVO she is a child custody lawyer. Weirder and weirder. ​

        Phaedra knows what she is doing. She is not trying to win this case outright, but instead trying to win de facto by trying to drive up the costs on Angela’s side by prolonging the case. This happens in lots of divorce and civil cases. It’s financial warfare — the other side eventually loses because they can’t pay their lawyers. Phaedra is pure evil.

          Don’t let the wonky eyes fool you. Bob is super smart. He recently went back to finish his college degree at Stanford. He may not have been the best husband, but he is a good dad and very smart and still pays Sheree a shit ton of money. Not just child support, but half his retirement and he was good to her in the divorce.

          She just blew all the money. ALLEGEDLY. ​

        The more I read what Angela and Jessica have to say about Phaedra’s history of involvement with fraud, prostitution, car theft rings and gang members without one arrest or any jail time? The more I smell informant or undercover something or other. Phaedra seems to be swimming in this community of crime without getting wet. And we are all shouting WTF is wrong with this picture? We might be tuned into the wrong identity of Phaedra Parks. This is just my hallucination.LOL

        @Teeri, but if she was undercover she wouldn’t be at all worried about Stanton suing her–would have been like water off a duck’s back. Good intrigue though and it would be the ONLY explanation I could think of that explains her overly calm demeanor. But having much to hide would explain her facade otherwise. BUT THERE IS A FACADE to be sure.

    I think your last paragraph says it all. Why would someone bring a case of defamation and refuse to testify and stonewall for two years? I think she was hoping Stanton would give up. That affidavit said as little as possible which gives the perception that she is hiding something. When did she start studying mortuary science? Was it after this case was filed??

    Phaedra is playing a very OLD game. She knows that she can not provide an adequate argument in her favor — so the real goal is to BANKRUPT Angela Stanton by having her pay exorbitant legal fees defending herself. It’s a sleazy strategy that is done all the time. Phaedra is not dumb. She knows that she runs the risk of losing her license to practice law and/or her freedom if she is caught lying under oath. The goal is not to clear her name, it’s to destroy Angela Stanton financially and besmirch her reputation.

      Thank you She Codes. You get it. This is EXACTLY what Phaedra is trying to do: Harass Angela financially. EVERY SINGLE TIME Angela has to file something in court, talk to her attorney, have her attorney talk to someone, write a letter or even send an email, she gets charged, and Phaedra knows this better than anyone. She is hoping against hope that Angela goes before the real story comes out. (Luckily it looks like she is failing.) Hell, I’d help donate to her cause because NOBODY should be bullied this way: And that’s exactly what this is: Bullying via our legal system and it’s absolutely DISGUSTING!

        It seems like if the judge knows that Parks brought the lawsuit, and refused to depose (if that’s what she continues to do) said judge would realize something ain’t clean and the buttermilk and wouldn’t throw out Stanton’s counter claims. Hopefully, the judge is ethical.

          ​Stanton’s attorney has filed motions to compel her to sit for a deposition. Stanton’s attorney has filed for sanctions. Stanton’s attorney has asked the court for a summary judgment based on this lack of cooperation.

          I’m guessing the judge is going through the motions in order. He granted the motion to compel, perhaps he is “giving her a chance” before sanctions and summary judgment?

I wish I had know about him when I quit teaching due to an anxiety disorder caused by a hostile work environment. I did go to one attorney said I didn’t have a case. Well what she really said is it would be hard to prove and quite frankly at the time, I as too riddled with anxiety to deal with a court battle.

        It is interesting that Phaedra had very experienced attorneys drop her while Angela’s attorney is quite young and sticking with her. The truth prevails and Phaedra’s attorneys must have known she was lying. It is unusual to go through so many different attorneys in only 2 years especially since P is an attorney herself.

        I don’t think Angela’s attorney is even 30 yet but from his site he looks more than capable and determined.

      Was this Vibe settlement the one that Regina Bell initiated or a different one? I have a brief recollection of Pastor Bell bringing suit against Vibe for millions (6, if I recall) based on statements in Angela’s book that Bell alleged were false but I have not read anything else until I saw this outline of court dates. If the settlement was for 5 thousand dollars the misinformation had to have been minor. It does not make sense.

      It’s very clear that Phaedra cost her income. If Phaedra wins her case, then Angela doesn’t really have one. But if Phaedra’s case is thrown out or she loses then Angela sort of has to win, from my perspective. ALLEGEDLY.

    If Angela wins the case then her attorney will ask (file a motion with the court) for the plaintiff (Phaedra) to pay his fees. The judge will rule on that. That is frequently done in civil cases. I am thinking he is taking this case on a contingency fee. He gets a piece of what they win or at least his attorney’s fee paid . I really like Angela’s attorney. Checked out his website. he is one of the good guys. That was great to see all that has been filed in this case. Very interesting. Your blog is great, kudos to you Tamara.

    The fact that Phaedra is going thru so many attorneys is a giant red flag.That means that she is either not paying them their money – clients generally give a retainer upfront and then are billed thereafter. when clients stop paying their attorney’s bills the attorney will file a motion to withdraw representation after notifying the client. Or if the client refuses to do what the attorney advises. The sanctions would go against the law firm representing Phaedra and they do NOT want that.

      Her bringing Angela Stanton to court just shows how damn cocky she is with all of this, and it looks like it just may be catching up to her after all. This whole not wanting to be deposed mixed with Apollo voluntarily “thou protesting too much” on the internet and in conversations and when no one is even asking or mentioning her being involved… (not that I personally haven’t thought from the get go that she is involved anyway). Apollo isn’t even close to being smart enough to do this crap on his own. I am also one of the few who actually believed Angela Stanton’s story when I first heard about it (and watched the video), or at the very least, I certainly didn’t NOT believe it. I will actually be shocked if she doesn’t end up going down. I really will. Waiting for this to play out is like waiting for the ending of a really good suspense movie. I hope the ending is a jaw dropper.

    I think Phaedra is using the typical stall tactics that any criminal would use. Angela Stanton is unlikely to speak to the media while this case is pending. Apollo still hasn’t been sentenced and she doesn’t want this case to conclude before that time because Angela Stanton would be able to conduct interviews before Apollo is sentenced and influence public opinion which we all know is important to Phaedra and Apollo.

    Apollo has never met a microphone he didn’t like. He would conduct interviews attempting a rebuttal to Angela’s interviews which wouldn’t help Phaedra at all.

      They knew she was telling the truth when the settled. Settling is not always about right and wrong, a lot of the time its about money and time spent, “is it worth it to you”. That’s what Phaedra was counting on with Angela, that it wasn’t worth it to her and/or she didn’t have the money.

      What she wasn’t counting on is: Revenge is a powerful drug.

    I have thought about buying Angela’s book, but I will wait for her to WIN her case, so she will get the proceeds. Yes, she was a criminal, and what she did was wrong, but she’s served her time, and it seems like she has learned her lesson. I think she was taken advantage of by Phaedra. From everything I’ve heard, it sounds like she had a needy desire to please her… like a lost soul. I feel bad for Angela having to deal with the EVIL known as Phaedra Parks, and I am really pulling for her. Not just to see Phaedra go down, but to see Angela go up.

      One of Angela’s book reviews of book on Amazon made a very interesting observation. She said the more she read the book, the more it seemed like Angela was in love with Phaedra. To wit: “In my opinion it read more like Angela was in love with Phaedra. When you read the lengths that she went through to please Phaedra you’ll see exactly what I’m talking about.” Hmmmm.

        It was Justin Cody’s deposition. He testified that he always thought the two women were together, like a couple, together. That was his view anyway. The first time he and Angela broke up was because of Phaedra’s relationship with Angela. It’s right there in black and white for all to see.

He is clearly talking about Phaedra being in a lesbian relationship in this depo. That was his opinion.     Just read the Justin Cody deposition. Is there a statute of limitations on the crimes she allegedly committed. Because this is 13 years ago now and it will be hard to go back that far and try to build a case on that activity, I believe. So she will probably never be charged by her legal career is ruined. So is her reputation despite of the Southern Belle bullcrap. His testimony was a little all over the place and sometimes contradictory and they would have to come up with a lot more than this and some recent activity to charge her with anything IMO. She stinks to high hell but Angela was definitely hurt emotionally by Phaedra’s betrayal and THAT is her motivation for the whole book thing. I’d like to see what real evidence she has and if the statute of limitation applies here as it may be all for naught. Future mortician. What a story.

    #1 rule of all guilty parties….drag out court as long as you can. Sometimes, just sometimes court cases get settled out of court simply because it has taken so long…barring that go to court with a jury trial and take your chances, because during arguments, you can manipulate the jury’s feelings to your side…

    Allegedly Phaedra is more scared of the thugs than she is of the Feds. Her downfall was appearing on RHOA. IMO the skeletons has only begun to rattle in her closet. Apollo is going to take the time. Not sure about the snitching, easier to do time than worry who’s going to kill you. Allegedly these aren’t the kind of folks you would want to snitch on

    I’ve never heard of refusing to sit for a deposition. The judge should properly sanction her. BTW, just getting sanctioned is enough to kill a legal career.

    Ms.TT-Happy belated birthday, and I hope you recover quickly from the cheap libations. 🙂 Thanks for the update because it seems like this case is in limbo, possibly because IMHO the Feds intend to indict Ms. Parks for whatever they may have discovered from this case shortly after a judgment is made. Who exactly is Fame Productions Inc? Is this some type of phantom firm or shell corporation who represented Phaedra in court on “01/11/2013 – answer – attorney for defendant filed by: fame productions inc” when she was supposed to be deposed by Angela Stanton’s attorney? Maybe this is Phaedra’s real law firm that represents all of her sex industry clients?, This would explain why I have not seen any prominent clients of the Parks Firm….hmmm, just food for thought.

      Here’s the answer to my own question: Fame Productions Inc, is the parent company for Vibe Magazine, the other defendant in this case who came to a settlement agreement with Ms. Parks. The judge in this case can still send Phaedra to jail for contempt of court charges if she refuses to be deposed within the 45 days. Where is her huzzzzzbund when she needs him to lie to the court and say she had nothing to do with the crimes Angela Stanton alleges in her counter suit? Oh yeah, perjury is a crime punishable by law. Those pesky laws just keep getting in the way.

      If she does that then Angela will have a better chance at winning her counter suit so I doubt phaedra will drop it or she will be faced with having to pay Angela

    Seems like Phaedra made a profound misjudgment in suing Angela.

    Of course, Angela may, in fact, agree to drop the countercharges as part of a settlement. I guess it depends on how angry she is.

      angela lost a lot of money as a result of phaedra’s lawsuit so I’m sure she is going to want something to make up for that which is why I don’t think she will drop the counterclaim

    One of Phaedra’s attorneys is/was L Lin Wood. He also represented The Ramsey’s and was successful in NOT having them deposed. Once deposed, then they must answer all questions asked in any lawsuit that comes up. There were a lot of lawsuits going on after Jon Benet was killed. Not sure if Phaedra thought she could follow that process.

    Phaedra was staff counsel for the insurance company I worked for and prosecuted claimants on cases such as STOLEN VEHICLES. She knows the ins/outs of vehicle theft/identity theft. If I remember correctly, Apollo was one of our cases & he went by a different name. This would’ve been 2004-2008? Before Phaedra “left” to start her own firm.

    When all this is said and done I will not be surprised if Stanton and her attorney file a lawsuit against Phaedra. Phaedra may very well end up paying Angela Stanton. Phaedra did all this bluffing and stalling hoping to intimidate Angela and hope she goes away. She was hoping to tie this up in court so long that Angela would drop it out of not having the funds to keep going.

    Surprise Phaedra!!! The pit bulls teeth are gnashing at her back side!
