After yesterday’s bizarre developments where the defense decided not to call either of their mitigating witnesses and once again asked to be removed as counsel claiming they can no longer provide an effective legal defense, all that is left in the court process is Jodi’s allocution, a statement to the jury. There will be no cross-examination by Juan. The expected agenda is: Jodi’s statement, defense closing, Juan closing, and a final closing statement by the defense.
That is what we expect to happen. But nothing goes as expected in this trial. We don’t even know if Jodi is going to beg for her life to be saved or ask for the death penalty? Or will she have a migraine and the whole thing will be called off? Who knows. But we will find out soon.
It sounds like Nurmi has asked for an appellate court to review the stay of sentencing motion that Stephens denied yesterday. He is trying to get them to reverse the decision that witness intimidation has caused Jodi to be unable to get a fair sentencing.
