Jodi Arias Trial Sentencing Phase: Aggravating Factors

jodifoolToday Juan Martinez will present his case for the death penalty in the trial of Jodi Arias. Because the jury found Arias guilty of first degree murder yesterday, under Arizona law there will now be a sentencing phase that occurs in two parts. First Juan will present the aggravating factors in case. He will be trying to prove to the jury specifically that, ” The defendant committed the offense in an especially heinous, cruel or depraved manner.”  While there are several other factors that could be considered in determining aggravating factors, as I understand it, this is the one that in this case was used to bring the death penalty into play to start with and this is the aggravating factor that Juan will be arguing. He is expected to do this be recalling Dr. Horne back to the stand where he will likely go into gruesome detail about each and every wound that Travis suffered. He will also repeat his usual refrain regarding killing Travis in three ways.

The jury will deliberate after this phase, and if and only if Juan is successful in proving the aggravating factor, then the defense will begin the mitigation phase.  That is when the lady who has been sitting directly behind the defense the entire trial will come into play. She is the mitigation specialist. This phase will most likely happen next week and take a few more days. This phase will attempt to show just cause why Arias’s life is worth saving. I can hardly wait to hear what that will entail. I suppose her mother will take the stand. We can talk about that next week.

A special shoutout to Puravidacostarica for recapping the Jodi interview that I slept through and am going to try to catch up on now. I really appreciate all of your comments yesterday as I had a constellation of minor health issues that all descended at once and knocked me out. Wouldn’t you know… on the day of the verdict.

          I reckon I am going to have to have a post just for us pretty much everyday after this is over. “Tamara’s Trial Tribe” or something. We will have to agree in advance not to discuss the Zimmerman case. I know from past experience that this board won’t be able to handle anything regarding race relations. It would be too big of a headache.

          I do hope that Sneiderman case is live streamed…

    Did anyone catch JA’s expression after the verdict? I am referring to the moment after all the lawyers went up to the bench and the mitigation specialist in the silver gray jacket came and sat beside La Arias.

    JA was watching what was going on up at the bench and the expression on her face became so angry and contemptuous. Her eyes narrowed and her mouth formed a stiff line. So telling… Anybody else catch that?

      Yeah, I also saw that. She looked like she wanted to kill her defense attorneys. Her beady little eyes looked like “Oh, if only I had a knife and a gun!”

      Also heard somewhere (on HLN?) yesterday that Arias flipped off the jury at one point.

        Yes, I saw that banner scrolling across the bottom of the screen, but since it was on Nancy Grace, I didn’t give it much credence. She tends to be the National Enquire -er of tv tabloid style exaggeration and sensationalism “journalism”. Did she provide any proof? Well, no, but it kept people watching, hoping to see what the heck she was referring to.

      Well that must have been when she decided to not listen to Nurmi and Wilma and do that freakin interview with KSAZ. Oh the lawyers must have barfed. I would imagine her going on the air will hurt her in a number of ways and you know Obi -Juan is like a big tiger who just catches a whiff of prey and one eye opens a weee bit wider. Because I would not be surprised if he refers to interview in today’s courtroom. Come here little kitty……

    Ok then, Governor of Arizona take note: all appeals by Jodi Arias after sentencing should be automatically denied.

    She wants to be believed, so let’s take her at her word, this time.

    The sheriff put her into suicide watch because of the interview. THAT STOPS HER FROM BEING ALLOWED ANY MORE INTERVIEWS (the suicide watch). I think Joe did it for that purpose only. He was said to be livid about the twitter thing but there was nothing he could do to restrict her from phone calls. I imagine that privilege is gone too. No more chatting with Donovan. They suicide watch is in a different facility so she has been moved from her little gaggle of supporters. Sherriff Joe rocks.

    She will be allowed to wear her own clothes today. That’s all she gets. I expect her to look a bit different without any support.

    Also, JANE V approached the family as they walked in today. FFS Jane…

    yeah sheriff joe also closed the visitation area to others for jodis security..so other inmates didnt get to see their families. Tv interviews and exclusive visitation but no preferential treatment for jodi

      To clarify, Jodi was interviewed in the courthouse. After the interview she was never taken back to her original jail. She is now in a different facility where visitation is not allowed. There is no way the scenario you described could have happened.

    Today you need to make a choice…HLN will sanitize the live feed, I imagine due to the horrific nature of the pictures that will likely be seen. So pull up a feed if you want uncensored, or don’t if you do…

        For myself, I KNOW I SHOULD pick HLN. I’ve tries to avoid the pictures as much as possible. But I have a live feed pulled up because I feel like I will want to know what the jury is being shown. I’m conflicted. I will probably start with the live feed and then wimp out. Another factor is whether or not HLN is going to do the maddening “you won’t miss a thing” crap.

    Arias family stopped to talk to the reporter Troy Hayden before entering courtroom. Bailiff says there is a delay. I assume Jodi is having a shit fit and her attys are trying to talk sense into her. I am sure she is taking her rage out on her attorneys.

Since she promised FoxAZ interview ahead of time – IF she was convicted of M1 – then wouldn’t the arguements w/ Atty’s and or the Psych Play – Act 1 cue up starting today ?

        HLN is reporting that family members on both sides still in courtroom. All attys present jury has not left the building. WTF? Maybe the defense motion will be argued in a closed hearing? Now saying Arias family has left. They would not be allowed in a closed hearing. So maybe despite Arias not showing up (she was never in the courtroom) the defense is going to get the motion limiting family impact statements out of the way?)

      That’s just plain disgusting. Does their audacity ever END ? This court is being held hostage by Arias’ antics. Does the Judge own a GAVEL ? Saw another small segment of Arias’ interview up close… Now I hate her all over again. She looks like Predator Shark Eyes ! Isn’t there a bus leaving for the desert in about 1 hour ? This IS our Aggrevation phase !!!!

    Just announced NO #jodiarias court today….aggravated phase rescheduled 2 Weds May 15 10am..no reason given.

    I am banking on this being a full on psych eval for Jodi. I think she went batshit when they locked her in the psych ward. I don’t think she was expecting that.

    now there is no way the jury can avoid hearing about this trial now. So jodi tactic is to cause another delay to postpone the inevitable. Next wed. Nurmi will make a mistrial motion to the judge about the jury admonition. The jodi is still playing games. And trying to limit victims statements is right up her ally she dont want to hear what the family thinks of her.

      The jury has handed down a guilty verdict. That is not reversible at this point. They can empanel another jury to hear the aggravation charges if they have to (and my understanding of AZ law is that if this jury cannot reach a unanimous decision on that issue, they will be excused and another completely different jury will be empaneled to try again).

      I wonder if this case will ever actually end?

    Q: So all this delay would still impact THIS jury right ? Only 3 alternates +1 to go ? Crazy as this sounds – If this worst case scenerio would happen – wouldn’t that cause a mistrail. Heard the Atty’s are in private hearing in chambers now.

They are treating her the same as an individual with education and training whose utterances are taken as fact and as being of some importance. How can you represent this Flake ? – (Someone should have taken away her toys when she was a kid. Maybe if we ignore her, she’ll go away.)     Get this: I checked out the public record for this trial online (you can go to the court’s website and read everything), and found out that yesterday the Defense made a “request” that the “victim impact” be presented via videotape ONLY. . .

    That is, the Defense wanted to effectively cut the throats of the Alexander family so they couldn’t speak directly to the jury–so they could not use their own direct emotions to appeal to a jury about just how much it hurts them that their brother was so very cruelly slain.

      I don’t think Arizona will grant any motion limiting victims impact statements. AZ has some of the most expansive laws that guarantee victim’s rights.

      Of course, the defense has nothing to lose by asking.

      I am starting to think Jodi is going to take the death penalty on her own. That would be just splendid. She will be sitting on death row for years longing for death to hurry up.

    I saw Ashleigh say that. At this point, I don’t see the defense attorneys have much else they can do, have her proven competent and let her put herself on death row. I think she should have to sign something that says in legalese “NO TAKEBACKS!” 🙂 It would save everyone a lot of headache and the state of AZ a lot of money.

    I don’t think it would take a full week to do a psych, even on Jodi, which leads me to believe they are giving her a week to reflect on her decision. In addition to the psych to show she is competent to make the decision.

    GOOD GOD JANE. Let Beth tell us what she knows. Stop interrupting Beth mid sentence so that you can have the same hyperactive hissyfit you have been having for the past several hours!!

    Beth has been trying to say that the reason we can’t continue until Wednesday is because HORNE cannot be in court Monday or Tuesday. So whatever the reason for the delay, Arias’s histrionics aren’t the cause of the entire delay.

          Too put it mildly, I find Nancy a tad abrasive…. It’s always so convenient when she doesn’t like the response of one of her guests or even co-workers at HLN (which has been becoming more blatant as of late) she loudly speaks over them which I have determined is a que to those working the microphones to turn them off. How does one get guests on their show when they are so rude? I admit I like her perspective on issues but find her people skills a bit lacking. :/ Me thinks etiquette lessons are in order for this Southern Belle.

        I have to give it to Jinkasaurus, her hair looked lovely outside of the jail the last two days. It must be pretty hard to manage in that heat. I have been hard on her in the past for not answering the question that is asked (mainly), but she sure does work very hard and had nice hair. I feel better now.

      I heard Beth say at the very end of the report where Jane cut her off: “the unsealed portion of the hearing is that the jurors were questioned one by one…” and that’s the point Jane wanted to recap what Beth had said about Horne testifying Wednesday….GREAT example of better to listen than to already be thinking about what you want to say, Jane! I might also mention I cannot believe the myfoxphoenix reporter didn’t ask Jodi “are you sorry for killing Travis”…instead of the open-ended question about “greatest regret”….total missed opportunity!!!

        The reporter said on Greta that he gave her multiple ops to apologize and she did not.I think he was trying to …keep his relationship with her for future interviews.

        I think they polled the jury individually for schedule conflicts because this is going on for so long.

    Okay, this PHX ABC reporter has been tantalizing us on twitter promising something they caught the Arias family saying on camera that no on else got at 4, 5 and 6. Their station refused to air it at 4 but reversed their decision for 5 and 6.

      Tamara, I found the video with PHX ABC taping the Arias family coming out and it sounds like Jodi’s mom does say something like “I hope none of the jurors saw that.
      They also have a picture of what looks like Jodi flipping off the jurors. Maybe that’s what her family was talking about? I hope it’s ok to post the link to the video.

      Listen closely when the family is walking toward the camera and past, that’s when you can hear Jodi’s mom say it.

    My question is this… why put her in the psych ward under suicide watch? Why not “unintentionally” leave an extra sheet (for a possible noose) or even a rusty razor in her cell and let her do to herself what would cost all the taxpayers in AZ an exorbitant more amount of money to do? Just spit balling here… :/

      Sherriff Joe Arpiao. He no likee Jodi. She keeps saying “I don’t want to live and death is the ultimate freedom” I heard on HLN that even a mention of suicide is an automatic 72 hour deal. That and I think Sheriff Joe who is pretty infamous for not caring to much about prisoners rights is tired Jodi La tweeting and demeaning Juan and a host of others. I think Nancy G is friendly with him. As much as I dislike some of Arpiao’s stand on things I do believe he is the perfect blunt force trauma to respond to Jodi. By the way it was hilarious to hear Drew go cuckoo yelling at Eiglarsh last night about this very thing. He thought that Mark was demeaning the Psych Techs in the Arizona jail system and Mark was saying ‘Who cares” I was saying , “it be Sheriff Joe laying down the law.”

        OK, so, Adam, are you saying that, by setting her aside under “suicide protocol,” he can, in essence, more effectively clip her wings? If so, I can wrap my head around it. Because my knee-jerk was to think, O, for petesake, surely you’ve got the newly convicted & other inmates pulling this same stunt around the clock in far more convincing & colourful ways.

        See, i would have expected Sheriff Joe (his rep having reached as far as Canada) to have been just the one to say, okay, Ms. Arias, you just hang out in the far corner, there, w/ your black bead eyes & your sloppy nether orifices pointed up in the air, and we’ll be over here, moving forward w/ the court proceedings. He comes across as that kind of no-nonsense guy. I’m a bit disappointed. But, if he’s got a plan, he’s got a plan… & I’ll be more patient.

          Greetings nice human. Welp I believe you are correct in what you say. Sheriff Joe (like him or not) is the BULL GOOSE MAJOR LOONEY in them thar parts. and I would think that Jodi is his worst nightmare. That is: Female, willing to yap, loudly, and a bringer of grief to all the good law enforcement folk in Arizona. In this case I am very much with him because, lets face it, she is the succubus from hell. My other point was you can see how problematic she can be when she even gets folk like Drew and Mark Eiglarsh yelling at each other and really neither of them got the true story. She is a purveryor of chaos. I think Arpaio just said “F**k it. The End”

    Tamara, I found the link with the clip of Troy Hayden the reporter who got the interview with Jodi right after the verdict. You will hear Jodi’s complete voicemail to him toward the end of the clip.

    I would love to know what the “off the record” things she said to him that she was so insistent that he not reveal til after the verdict & she promised him a post interview if she got Murder 1 because he kept her off the records comments confidential just like she asked.

    It is so chilling to hear how she calmly leaves this voicemail! I truly believe that she had this suicide talk interview planned when she set this up. I wouldn’t be surprised if Nurmi and Wilmott were in on it and the whole “argument” with them right after the verdict was staged as well to make it more authentic.

    She wanted the interview right away if the verdict was murder 1, but if jury comes back second degree, she told him to wait til after the sentencing. This tells me she planned to talk suicide in the interview to avoid the court proceedings that were supposed to be yesterday. She is one cold, calculating monster.

      Well… I watched the Dateline “Obsession” segment. It was interesting to hear the Dateline folk warbling about me, you and TT’s “obsession” about the case. Maybe I am a little sensitive (wife thought so) but in looking inward I think that this case has presented a very interesting and clear cut example of right and wrong and since it is a trial also presents (like sports) a clear beginning, middle and an end. As in whether I agree or disagree with someones politics one of the most frustrating things is watching the other side make fools of themselves and then my side does even worse! It makes me wretch. Jodi, Juan, JWill, Nurmi and company present a live time, very intrigueing situation that I not only feel strongly about but I know there is going to be an end. In this case and so far an end that I am fairly excstatic over. That and I have never participated in a discussion before and so I not only feel strongly about the case but I also feel part of a great group O folk who sure seem smarter and at very much attuned to the same aspects of this trial that I am. Maybe it is that Jodi is such an ALIEN THING that she draws all of us together in our mutual disgust, dismay and anger at her and what she hath wrought. Blah blah blah anyway, TT rules and I will shut up now. So Nuh Uh I AM NOT obsessed.

    Dr. Drew On Call was provided exclusively with an e-mail sent by Jodi Arias on Sept. 1, 2008 to a leader at Travis Alexander’s employer Pre-Paid Legal.

    I am writing this letter in regards to Travis Alexander, whose life was taken last June. He was a good friend of mine. Am also, at present, in custody as I am being charged with his murder.

    I am not writing this solely to plead my own innocence. That goes without saying — as Travis meant the world to me and I would never harm him.

    It is my understanding that his memory will be honored and recognized in Las Vegas this September. I would humbly remind those who say any different — that I am innocent until proven guilty.

    It is with a spirit of humility that I would ask that if I am in any way referenced during Travis’ memorial at the team breakout, that my implied innocence is taken into account.

    Sorry if this has already been posted, but there’s someone on Twitter who attached the minute proceedings from the Maricopa County Superior Court on May 9th. I just read them (couldn’t figure out how to attach and I’m not on Twitter so I couldn’t retweet). Essentially, one day after Jodi gave her “I want death!” interview, her defense counsel (Nurmi and Willmott) filed a motion to take the death penalty off the table. It was denied.

    So on Sunday, in the voice mail to Troy Hayden where she discusses setting up the post verdict interview, JA had the nerve to say “if, for some reason, they convict me …”

    Er, if for “some” reason??? Delusional much? Why do you think you’ve been imprisoned for five years and on trial for 5 months?
