Looks like we might need a place to talk about tomorrow’s Jodi Arias trial. I am going to open up this post for conversation. My sleeping issue has me “in a fog” 🙂 today so I am a bit slow on the uptake.  The attorneys are all in court today in closed hearings presumably hashing out the last minute details of jury charges, perhaps arguing about the limitation on the surrebuttal as it seems that the Defense wants to ask their pysch witness about whether or not the gun shot happening first would have incapacitated Travis. Also, Juan has someone lined up for a possible sur surrebuttal regarding the question of which came first the gunshot or the stabbing. Personally, I have not been convinced either way on that issue.

Let’s chat about the daily drama here and I will put up a new post for the surrebuttal action tomorrow. This is sort of a catch all thread. Let”s try to avoid death threats and violent threats toward others here. 🙂

    We’re in the homestretch – thank goodness! Can’t wait for tomorrow to see how the defence witness handles cross examination. I don’t think Juan needs a sur- surrebuttal. The jury has a picture of the multiple defensive wounds onTravis’s hands to show he was fighting for his life before his throat was slit. That should be enough, imo, to discount a brain injury before the stabbing. Plus, there was no blood on the floor where she claims she shot him, before the fog started rolling in. The blood was in the sink where he staggered after the first knife wound to his chest. When that didn’t knock him down, she stabbed him in the back – 9 times, I think. The coup de grace, slitting his throat ear to ear, came in the hallway where he was staggering to get away from her. He fought or his life, but was no match for her when she took him by complete surprise while he was naked in the shower.

      Um, I hate to admit how stupid I am, but here goes. I needed you to point out that the defensive hand wounds were from the knife battle. I mean I GOT that, but for some reason my foggy brain didn’t register that that fact means that he was alive during the part so it came first. However, if the gun shot didn’t cause immediate incapacitation… oh Lord, I am right back where I started.

      I don’t know why this is so hard for me to get a handle on.

        I agree with you. The variables are causing a headache. The one thing that is a fact is that she killed him and then she lied about it and so much more. Has she shown her true evil self? We can only hope the jury can see through the “fog” and sentence her to the DP.

        Don’t know what to think re: dragging him back to the shower.

        Maybe that’s the storyline she envisioned during her psychopathic pre-planning? Or, maybe, simply that she hadn’t anticipated the extent of Travis’ defensive struggle or the bloody aftermath strewn throughout, so, stupidly, tried to drag all evidence back to the shower stall to make it look like he’d been surprised there?… But, alas, that train (as they say) had already left the station. The suite was a bloodbath.

        Hard to figure. Despite her apparent talents in certain areas (gas pumping, makeup artistry, journaling, role-playing, bold-face lying…), Jodi is astonishingly stupid overall. Maybe she thought it’d be a tidy, true-to-script caper? And, when it wasn’t, just started trying to correct things & made some bizarre choices?

        Honestly, it beats me! I might even trade 1st degree/life without parole for full elocution IF ARIAS WASN’T SUCH AN INCURABLE LIAR!!

          Seriously, Tori! It’s said that narcissistic ego causes stupidity to ultimately undermine intelligence in psychopaths? Or something? I don’t know, but makes sense.

          And, above, I kinda meant that murdering him in the shower was her original fantasy plan, and the resistance & widespread bloody scene took her by surprise (causing her to go off script.) But, christ, who knows, who knows… Nothing I come up makes sense. i can’t imagine doing anything but running start raving out of there, having a heart attack on the lawn, deliberately falling on my own knife… Any attention whatsoever to detail, any ability to micromanage (after all was said & done) simply doesn’t compute in my brain.

            Heh. You are not in trouble at all, silly. A moderated word is a word that causes a comment to go to moderation, meaning I have to manually agree to post it. I have a few of them. Most are regarding things like personal information on some commenters who have stalkers (not even kidding) and others generated by WordPress. I have a few sources for information I do not find credible so I include their names in my personal list.

            I just thought it was funny. I think people who will get the moderated word would too. Sorry it was sort of an inside joke for people who… oh lord… I am over explaining. If you want detail you can email me. I should have just put it through without laughing about it. 🙂 It has nothing to do with you, whose comments on JA I very much enjoy reading.

          I think placing him in the shower had a double purpose. I’m not sure whether she washed him out of love or to get rid of evidence. But, I do believe she placed him there to decompose and make use of the drain and closed up bathroom. Sorry, I tried to find a more gentle way to make the shower comment.

          I think your shower comment is lovely, peach.

          Especially, the juxtaposition (I’m surprised Jodi didn’t employ this obnoxious term in her testimony)… the juxtaposition of “placed” (so tender) with “decompose” (a tad raw) and, then, the syntax “do believe” preceding (lofty, spiritual)… The “washed him out of love” launches a whole other rocket.

          I’m just playing with you! I just really liked your post…

        I’m not sure why the gunshot came last. Maybe it came somewhere in the middle when her initial stab to the chest didn’t kill him, as she hoped. I can’t remember where the casing was found. Was it in the middle of the bathroom? Anyway, he didn’t go down easily, no matter which came first. Of course, the more blood he lost, the weaker he’d become, and I imagine it was quite simple for her to eventually slit his throat. I think she did lose a fair bit of blood herself and that’s why she dragged him back to the shower to wash it all off to leave no evidence. In her perverted mind she left no evidence. But for the photos in the camera (that she thought she’d taken care of), and the bloody palm print on the wall in the hall, she may have gotten away with it – for a little while longer. She was very surprised when Flores told her they had found it.

          YES, Babs! “In her perverted mind she left no evidence.” And wasn’t that astounding in the interrogation how she actually, in baby voice no less, tried to negotiate/navigate her way out of the palm print! As if she could “enlighten” Det Flores re: the options he should entertain. As if she & Det Flores were colleagues or co-authors, figuring out the plot of a fictional murder mystery! Crazy! And the way she said “couldn’t I have… couldn’t I have maybe… ” BINGO! Places herself at the scene of the crime in her VERY efforts to deny she was there!

        the gsw to his head definately hit frontal lobe of brain……….this is the “personality and intentional action” area…………where and how it pivoted around his brain after that was indeterminable…………not cuz science doesn’t know, but because decomposition of his brain was too advanced to figure out the path of the trajectory…………but the limited view i saw of the entrance wound showed that it could NOT have NOT hit his frontal lobe bullet wounds do not only ricochet off of surfaces within the body depending on caliber, closeness of impact, etc, but any energetic projectile immediately releases TREMENDOUS energy into all of the surrounding soft tissues………..no WAY he was just a little shaken up by the GSW to his head. My education and experience in GSW (as veterinarian) is that the less distance the bullet traveled, the more energy that it released into the soft tissue surrouding its path. Hope this makes sense.

          Son (physician-scientist), like you, says decomp would make it difficult to document path; nevertheless – anatomy/physiology being what they are – it’s absurd (ie: UNreasonable) to think that the bullet missed the frontal lobe (considering entrance hole, trajectory, terminus). Lack of discernible blood in tissues along bullet path would indicate Travis was already dead, heart not pumping & well on the road to bleeding out from previous catastrophic injury/injuries.

          NOT self-defense.

          Perfect sense. No way would he have had the strength to fight her off as long as he did if he had been shot first – not to mention tackle her and chase her down the hall.

          I wonder when Arias decided to change the story she gave LaViolette about shooting him in the closet? I don’t believe LaViolette misspoke. I believe Arias changed her story as she went along – tailoring her story to fit the evidence.

          I was just curious about all the fuss regarding whether the bullet hit the frontal lobe or not. So, I googled “photos of the frontal lobe of the brain”. The images are simple, clear and tell it all. Based on where the lobe is located, there is no way the bullet could not have passed through it. Just as the ME stated, the bullet entered the head, the lobe was between the entrance and the point where the bullet lodged.

          The image I looked at leaves no question, I wonder why the ME or Juan Martinez didn’t show an image in court…or did they?

          I have a habit of over simplifying things, so, feel free to correct me if I’m wrong.

        I’m going with she startled him in the shower, began stabbing and got enough in fast enough to weaken him so his defense was weak, then slit his throat. Then later came the shot to be sure he was dead. I think the shell being on top of blood and the lack of bleeding puts the shot last. I saw the video of her reaction to the pic of his throat. Her stare and open mouth to me suggest she did not realize how deeply she cut his throat. She was in a rage and panic to clean up and most likely shot him not thinking she had cut so deeply, and she isn’t a doctor, so she was paranoid he’d survive. Cold cold bitch.

          She slit his throat at the end of the hall where he bled out and left that that huge pile of blood. Then she dragged him back to the shower and shot him in the head as an afterthought. I believe it was then she started thinking about setting up her story and thought she could say she shot him first, knowing nothing about how evidence works.

    Personally, I’ve always felt like the gunshot came first. I think she only had ONE bullet. I think she shot him in the shower to minimize the messiness. I don’t think the shot immediately incapacitated him and he probably stumbled to the sink where she started attempting to finish the job with a knife (which she brought, just in case, along with the gun, since she only had ONE bullet). I think she cut his throat while he was standing at the sink (explaining the splatter) and then followed him down the length of the bathroom stabbing him anywhere and everywhere she could land a blow. To me, it’s not even really material which one came first. I believe that she went there with every intention of killing him and I believe she planned to cover her tracks by doing it in the shower and hopefully washing away all of the evidence. What I don’t think she planned on was Travis fighting so hard to stay alive. I hope the jury finds her guilty and that her punishment is swift!

        no way could Travis have crawled down the hall after his throat transection………maybe after the fatal chest blow, but maybe not even for as long as that would take………….it makes me so upset to think of him literally crawling away for his life as she continued to stab and stab and stab………the sink splatter could have come from any of the chest stabwounds that penetrated his lungs………not necessarily from GSW….maybe Jodi used up some of the bullets with a little “premeditated target practice” prior to her arrival at his place. or the gun jammed, or????

        I think they said that the gun may have jammed. Remember when she was telling the story of the two intruders, she said he had the gun to her head, but it jammed. I think in her lies, some of the truth is intertwined, she thought that would be enough to make them believe her crazy story. I think she was going to shoot again, but the gun jammed, she ran to get a knife while he was at the sink, and started stabbing him in the back, and then all the rest.

        May she burn in HELL

          If you listen to Travis’ story the night she was laying in his lap about having the gun to his head and almost dying, he said that the guy’s gun jammed. So, to me, the part of her story that was true was that she copied TA’s story. Her ninja story to Flores is almost exactly like the story Travis told that night. SO CREEPY!

    Here’s my thinking… I think she came at him in the shower with the knife first, he tried to fight her off… At some point she whips out the gun, shoots him, he’s still moving, she then finishes him off slitting the throat…his adrenaline is pumping and he makes his way slowly down the hall where he dies.

      Ive heard someone on Dr. Drew say she washed him off to remove her own blood that dripped on him from the cut on her hand? But idk thats not really convincing because i wouldnt think much of her blood would drip on him anyway?

      also there was a cup in the shower, so she wanted to rinse him off, why ? i dnt know, shes an idiot.

        I truly believe we will eventually find out exactly what happened on and leading up to the day Travis was killed. Jodi loves attention. After her conviction.. and after all her appeals have been denied, she will finish her book; and do as many interviews as she can. Due to our double jeopardy laws, she can tell (the real story), and not have to worry about being charged again. (please correct me if I’m wrong about the law.

        Though she certainly deserves it… my gut tells me she won’t get the death penalty. I believe the borderline personality disorder diagnosis will help save her life.

          Plenty of people on the planet have BPD. It is not normal for people with BPD to kill people. BPD is not insanity and should not be considered in sentencing at ALL. It is cause for understanding why she did what she did. It’s a prosecution point. Not a sentencing mitigating excuse.

      She was trying to erase only the evidence that SHE was there. She washed only the places where she thought she would leave evidence. Remember she is a big TV watcher and probably wanted to get rid of “epithelials/DNA” as a “forensic countermeasure”.-hence putting the sheets in the washer with the Camera. I was mulling over why she bought two tubes of Ban Soleil and two things of facial wash @ Walmart—then I thought “Cancun”. She gave him one last chance to take her to Cancun and when he said the last “no” she went to plan “B”. The sex was to persuade him to take her while he was showering and that’s where we have the last shot of that look on his face saying “I told you over and over” /Plan B- she grabs the knife and the first stabs were the torso in the shower. Also I stumbled on a arias Trial FB page across this youtube of Dr.Geffner on femal domestic abusers @ the 35:00 mark he talks about how women abusers kill with knives and guns!! https://www.youtube.com/embed/yzkoiNQWaFA check it out. This is the DEFENSE’S witness that is testifying in the surrebuttal tomorrow.

        Thanks, Dane. Just watched. Experienced, effective public speaker. Fluent in his specialty; fluid in his presentation (which was genuinely interesting, informative.) A dedicated, likeable guy.

        Ugh.

        In addition to talking abut women abusers killing w/knives & guns, he lists PSYCHOPATHOLOGY & PERSONALITY DISORDERS (on overhead slides no less) as risk factors for perpetrating domestic violence. Somehow, I doubt he’ll be underscoring those factors, much less linking them to Jodi Arias in tomorrow’s lesson.

        So, his obvious task is to cop to DT strategy, stretch criteria (based on lies & deviously taped material taken out of context) to frame Travis as perpetrator… even though, in his OWN PROFESSIONAL CONFERENCE LECTURE, the knives/guns-psychopathology/personality disorder profile (intact, unadulterated) screams off his overhead projector and points to Jodi Arias.

        How is this happening? (Wake me when it’s over… )

      Tamara, I believe JA intended to kill TA in the shower to keep the scene as clean as possible. In her rage she may not have realized how bloody the bathroom was but her mind was locked on killing TA in the shower so she dragged him there. I believe washing him was an after thought when she cut herself. This chick seemed to have a thing for knives. She slashed TA and Lisa’s tires and she had two knives in her bag when she was going camping or running away! I believe she stabbed TA first…up close and personal.

      Did anyone watch HLN’s after dark last night. Vinnie Politan had the report of the call that TA made the second time his tires were slashed. I wonder if JM can bring that up in his closing?

      We don’t know how much Jodi followed ID channel investigations. But there is something called “Locard’s Principle” which dictates that there is always transfer of evidence during the commitment of a crime.

      She used a water glass to wash the dead body off in the shower after the murder. There are pictures of the glass in the evidence photos. that’s why she dragged his body back to the shower where he was found.

    I think she had planned for him to die in the shower. No blood anywhere but down the drain if he stayed in the shower. But, he got out of the shower and fought for his life. That pissed her off. She has to be in control. She has to be the one with the last word, the last action. So, she dragged him back to the shower to show him who was in control, even though he was dead, she just had to have that power over him one last time.

    What was that stupid phrase: two snaps, a crackle and a pop – in regards to Juan calling someone else after the defense! Go Juan!

    Tamara, I am with you on the order of the gun shot! Further, I don’t even see why it matters considering any of his injuries would have disabled him enough for her to get away. The fact that she continued her assault and in such an extreme manner is all that matters. It doesn’t matter if she shot him first, last or sometime in between.

    The wounds to his back and chest were more than enough – to allow her time to – run her whore ass out of the house. People forget that fact…..people only want to concentrate on the order of the gunshot. It doesn’t really matter in the end. Damn.

    Only Jodi sympathizers would care about the order of the gunshot. I sure hope the jury isn’t so narrow minded.

    I’ll never get over all the people who think that buying two tubes of sunscreen points to Cancun. I do think this whole deal was over the Cancun trip, but if I was on the way to church revival or a homicidal rage and I stopped in Walmart in Arizona in June, I would be picking up sunscreen. It’s one of those things you forget you might need on the way to kill some dude in the summertime. It’s not important.

I hope she doesn’t think her IQ results imply she’s some sort of genius b/c she is the dumbest dumb ass to ever go on trial. Let me purchase all this gas, borrow gas cans, turn off my phone, rent a car nearly 100 miles from my house….how she didn’t think all of that would be suspicions is beyond stupid. Coincidences are one thing, but the facts speak for themselves.

      Re: Cancun- It strongly establishes Motive. The Ban Soliel was purchased in Salinas, CA. Cancun is in the 1001 Places to see book that they tried to visit as many places in the book while they were “in love” I think to miss that trip as Travis’s plus one was a huge deal to her. It fits her psychopathology.

    I just read a post where someone was questioning that they heard that Dr. Geffner was “dismissed from University of Texas for ethics violations”.

    Lots of info on his lack of credibility after reading his book reviews on Amazon, but I hope that Juan has this info on the ethics violations in Texas if this is the case!

    Check out mixedbagblogdotcom for information on Robert Geffner. Is the defense serious? This is the guy they want to tear apart Dr. D’s testimony?

    According to Jeffery Evan Gold the defense wants Geffner to rebut Dr. Horne’s testimony about the brain injury, as well.

    Well….since we saw the “Psycho” movie comparison photos, and they were on the money – I was thinking maybe Jo-DIE had convinced Travis to re-enact the movie so she could take photos….and she had the knife just like Anthony Perkins in the movie did, so Travis wasn’t too concerned about it until it turned real…. Just another thought.

      One of the questions was “if you take photographs of everything, did you take photos of the spiderman underwear?”

      Jodi said she did not take photos of the spiderman underwear because “that’s embarassing.” WHAAAAAAAAt? I would think the pic of her vag and bunghole sticking up in the air in a close up photo would be way more embarassing.

      What a liar she is!

    i was watching the Flores interveiw with jodis dad last night and he said the day she was arrested she had packed the rental car to visit Darryl and Matt that she had something for them. I wonder if that is what the other two knives that were in the box of books were for. They BOTH knew she was up to something and helped.

    Reinacted the movie.She had the knife there to take a Picture’s She really stabed him..would on hand defensively wound. He stumbled to sink..shes stabbing his back he tries crawling down the hall.hes dying as she spits his throat..hes dead. Gun shot a cover up somehow played in her head! Drug him to shower to get rid of her Dna…lol thanks Jodi for leaving the camera!!!

    Tori on july 15 she was arrested. She had rented a car and the Yreka police had watched her load stuff in it. They found some clothes and stuff. One box had books in it. In that box was two knives and some 9mm ammo hidden inside. I never found out what kind, ie kitchen or hunting, of knives they were. She also had a glock 9mm pistol hid so good the cops missed it. I was thinking that Darryl and Matt knew stuff about the mesa trip and maybe those knives were for them. That way couldnt talk

    I heard Sky Hughes tonight on Dr. Drew. She and her husband have cleared up the email stuff. She said that the reason she told JA that she wouldn’t let her sister date Travis is because he had committment issues… not that unusual for kids who grow up in bad homes as Travis did. They described a night that they caught JA eavesdropping outside their door as they spoke with Travis twice in one night. Sky also said that JA panicked if TA got out of her sight and got mad if he wouldn’t look deeply into her eyes. They KNEW she was bad news from the beginning. They were afraid for her to be in their house b/c they were afraid she would hurt their children. They are in the process of setting up a non-profit in Travis’ memory to provide books for kids in inner city schools. Oh, and Sky said that the defense had almost 5 years to fine even one of TA’s ex-girlfriends to say something bad about him and If there was one out there we would have seen her in the defense’s case. See you all here tomorrow; I’m expecting fireworks from JM.

    Tomorrow is sure to be an interesting day, I may have to break down and watch the direct feed (I have a limited number of monthly MBs and video eats ’em up quickly)instead of be driven knucking futz by all that “bill-paying” on HLN, or taking the chance that things will spill over into Nancy’s ego-driven hour and she will do her usual blather over the testimony. ~sigh~ As much as this has been a fascinating spectacle, I do look forward to being on the other side of the verdict, and watching interviews with those poor long-suffering jurors. What a sacrifice they have all made.

    Earlier tonight one of the trial shows put that (censored) crotch shot of Jodi in pigtails up and I hit the pause button for closer inspection. I haven’t read anyone’s comment about the look on her face in that photo but, even slightly out of focus, it reeks of animosity. No pleasure, no lust, no soul, just naked seething hatred. That look alone should have alerted poor Mr. Alexander that he needed to watch his back. Neither eyes nor brain in that “other little head,” alas.

    This doctor is well educated and experienced. But, the facts are the facts. Jodi planned the murder, carried it out, admitted it and is now wanting to just go home and draw.

    Yes, she has mental issues, but, her defense wasn’t smart enough to claim that at that upfront.

    So… what is the purpose of this testimony other than an attempt to make Dr. D. look bad. I still don’t think the PTSD won’t fly.

    I feel this surrebuttal is a mistake on the defense’s part. By his own admission, he has never spoken to Jodi or anyone else, or reviewed anything associated to the case. It comes across as a desperate attempt by the defense and indicates that they will hire any hack to save their client. It also casts shade on their own previous experts.

    Think I got part of what the defense is doing. Lots of media people said that JM made JA sympathetic when Dr. D diagnosed her as BPD, but i did not think so. Maybe the defense is going with the media and trying to show JA has mental problems in hopes of saving her life. Almost all of the experts, for and against JA, say that saving her life is a victory for the defense.

      peachteach, Aren’t you glad you aren’t giving the CRCT this week? I saw on the news some principal showed up to work drunk and was arrested in the parking lot. I automatically assumed she was the Ass Prince in charge of testing. So Stressful. The last year I gave the test we were told to list all of our students as Hispanic. I pointed out that was deceptive and the Ass Prince said that is how the new rules say to do it… SMH. Sorry for offtopic rant. I’m having CRCT flashback and palpitations…

          Peachteachr- I knew for some reason that I had an affinity for you. I am a retired Elem. teacher who missed most of the No Child Left Behind crap- Thank the Lord. My district was Meade 46-1,SD not flush with money so slow putting into effect. Retired in 2001 for medical reason.

    Anyone hear the blonde “human lie detector”‘s take on the judge last night on Dr. Drew? Sry, forget her name. She thinks due to body language and how many things Judge Sherry has allowed JA and defense team to get away with in court, that she could be on JA’s side at least slightly? Glad it’s the jury deciding JA’s fate! I like the Judge, but she could have held control of the courtroom better. JA and her team do whatever the eff they want, slump in their chairs like children in detention, touch each others faces/hair to comfort, color & scribble, write and rewrite manifestos, it’s appalling. Any thoughts on her opinion? I’m on the fence.

      I do not like that lady on Dr. Drew (the human lie detector). She always makes everything about herself. She had to tell how she was a da victim. The question about JA dying her hair … She had to relate it to herself and her changing her hair color frequently. Watch her and see if you agree. I can’t take too much of her. And I don’t agree about the judge being partial to defense. She almost has to be very careful when dealing with defense because they will appeal almost anything. I thought she almost could not hide her disgust towards JA when asking jurors’ questions.

    Hendershott v Westphal:

    Quote:

    On February 28, 2009, Dr. Robert Geffner, a Licensed Psychologist, reviewed Dr. Silverman’s report and completed a forensics consultation. Dr. Geffner noted that Dr. Silverman’s report failed to account for the children’s problematic behavior before or after visits with Jesse or Jesse’s difficulty managing his anger. Dr. Geffner also noted many red flags for potential abuse, including power and control issues he claimed were disregarded by Dr. Silverman. Dr. Geffner concluded Heidi displayed many behaviors and traits of an abused woman and recommended Jesse undergo psychotherapy with an abuse specialist.

    The court reviewed the opinions of the trial witnesses and stated, “[t]he Court finds that Dr. Silverman was the only professional person who performed and completed a parenting evaluation and that his final evaluation followed accepted standards which support his conclusions and recommendations.”

    The court tossed Geffner’s testimony because it was incomplete.

    O’Rourke v O’Rourke:

    In this case, Geffner attacked other psychologists for using the MMPI in a family violence case. The court ripped Geffner up. See pgs 8-10and 15. Dr. DeMarte used the MMPI-II and other psychological tests to evaluate JA. Dr. Geffner will try to shred Dr. DeMarte’s competence and credibility. He will not succeed.

    In his affidavits, as well as during nearly a full day of trial testimony, Dr. Geffner challenged the use of the MMPI and other psychological tests by Drs. Bernet and Walker. He stated that questions of domestic abuse and family violence implicated a specialized area of psychological practice which required a totally different testing regimen. He testified that he himself was an expert in the area of family violence and abuse, as shown by numerous publications he had authored and by his participation in professional societies that focus on those areas. These included the Natural Resource Center on Family Violence and Sexual Assault, an organization he had founded and in which served as president.

    Dr. Geffner testified that none of the other psychiatrists or psychologists involved in this case possessed credentials similar to his, and
    he declared that the lack of such credentials rendered any opinions they might have as to the relative fitness of Father and Mother for parenting responsibilities suspect at best. He also stated that when a mental health professional conducts an evaluation outside that professional’s expertise, it raises serious ethical issues. He accordingly recommended that Mother file ethics complaints with Vanderbilt and the State Licensing Boards against the other mental health professionals involved in the case. What a narcissist!

    The court likewise excluded Dr. Geffner’s testimony in Hawaii v. French, 129 P.3d 581 (Hawaii 2006), which involved allegations of child sexual abuse. In State v. Supulvado, 655 So.2d 623 (La. App. 1995), the court limited Dr. Geffner’s testimony because he mostly relied upon information supplied by the defendant and because although he is not a medical doctor, he tried to testify about the effects of brain damage on emotional functioning. Dr. Geffner acknowledged that he has testified in a great number of cases, but stated that he did not remember very much about the facts of those particular cases.

    Turning to the testimony of Dr. Geffner, the court declared that he had adopted Mother’s “scorched earth” tactics by not only attacking the conclusions of Dr. Bernet and Dr. Walker, but also their ethics. The court stated that Dr. Geffner’s testimony was “. . . completely without merit and that he truly fits the definition of a ‘hired gun.’” In light of Mother’s “relentless attempts to convey her bad opinion of their father to these children,” the court concluded that the only possible way for the children to have a relationship with both parents would be for them to be with Father.

    I cannot find evidence that the Natural Resource Center on Family Violence and Sexual Assault ever had an online presence. Very odd.

    In O’Rourke, Geffner admitted that he only does expert testimony; he no longer sees clients.

    Clark v Collins:

    Quote:

    18 Clark alleges that he was deprived of his sixth amendment right to effective assistance of counsel because his trial counsel unreasonably failed to conduct an investigation of his mental condition at the time of his offense. Clark contends that a reasonable investigation and evaluation of his mental condition at the time he committed the murders would have produced a compelling defense to the first special issue, whether Clark acted deliberately, and would have precluded imposition of the death penalty. This claim was raised in Clark’s first federal habeas petition, and resolved against him. He now re-asserts the claim, supplementing it with the results of a psychological evaluation of Clark conducted five years after the murders, and an affidavit of Dr. Robert Geffner, which relies heavily upon hearsay information supplied by Clark’s attorneys.

    22 The state trial court found that Dr. Geffner’s affidavit lacked credibility for three reasons: (1) the evaluation, which makes conclusions as to Clark’s conduct in 1987, was conducted five years later, in 1992; (2) Dr. Geffner did not review the court records or a transcript of the trial testimony; and (3) Dr. Geffner relied upon records from Clark’s childhood in Pennsylvania, with no records since 1976, and upon hearsay information supplied by Clark’s attorneys, with no independent verification of the information, and interviews with Clark. The state court further found that, even if credible, Dr. Geffner’s affidavit does not support a conclusion that Clark was either incompetent or insane at the time of the murders, or that he did not act deliberately within the meaning of the first special issue. The state court noted that Clark testified that he had not taken any drugs on the day of the murders, and found that Clark’s trial counsel had no indication that Clark was suffering from drug withdrawal at the time of the murders. Moreover, the state court pointed out that, in any event, evidence that Clark was acting under a drug-induced delusion when he committed the murders would have been immaterial to an insanity defense and “would not have conflicted with the overwhelming evidence of deliberateness.”

He admitted that he was not a medical doctor and that “it was not clear to [him] if at the time [of the offense] she really did not know that what she was doing was wrong.”Dr. Geffner relied on information provided mostly by the defendant.

    In rebuttal, Dr. Seiden, the state’s expert, disagreed with Dr. Geffner’s statement that a person with a battered woman syndrome cannot make a decision. According to Dr. Seiden, a person with such a disorder may be afraid to make a decision, but that is different from not being able to make decisions. Dr. Seiden also testified that a battered woman usually will stay and let herself be subjected to abuse, but will make a decision to leave when she sees her child is in danger. He said, in the instant case, the defendant was making decisions constantly because a decision not to do something is a decision.

    Again, the Dr. G didn’t meet with Jodi, or review all the documents…. so his opinion doesn’t matter to me.

    I would give him a lot more credibility if he was completely thorough in his review. My guess is, the budget would not allow it, and the judge would not extend the trial. Therefore, he simply couldn’t get up to speed on everything. So., he is talking out of his a… rear end.

    I can’t wait til Juan brings up his past testimonies in court. He is passing them off as not really a big deal and that he was never impeached for his shoddy testimony.

    Also, I was watching Jodi when the camera was on her. She is definitely not writing any words. It looks like she is just making little sketches or doodles. By the way her pencil skips around on the page, she is just trying to keep the crazy in!

    This is just so much sloppiness by the defense. Why did they waste everybody’s time, yours and mine included, with testimony from Dr. Fog and LavaLamp? Why wasn’t Dr. Gaff the main witness for PTSD etc? Oh wait a minute, it’s because he didn’t actually administer any tests or talk to La Arias.

    If I were on this jury, I would be starting to feel very resentful about having to hear about ALL of this crap again. I thought the surrebuttal witnesses were suppose to only have a narrow focus in their testimony? Now the defense is using up the whole day with their usual tactic of stall, delay, and bore everyone, leaving little time for Juan Martinez and his cross of this guy and then to present his own surrebuttal witness.

So say I got shot by a bullet today, or a nail gun, who would I want to see me at the hospital? A doctor of psychology or a medical doctor? Ummm, I think I’ll go with medical doctor.

    I’m watching HLN so I’m viewing it in lag-time… but has anyone been WATCHING Jodi’s body language ???? I’ve been fast forwarding it @ i speed up and she has been using sexual touching on her LEFT jury-side since it trial started. She’s had her eyes on somebody (likely male) across, over and upwards JM desk. Caressing her neck, face, touching her glasses, flipping her hair, and doing alot of those gross tongue rolling in her mouth things, etc… At one point, she has angled her chair that direction. Her eyes and head keeps turning left so much at one point she had to get around her computer screen. !!! SHE’S ZERO-ING IN ON A JUROR. Especially when attorneys go up to bench. Whoever it is must have stopped looking back – ’cause she paused and pouted for right after lunch – but she’s at it again. ~ Watch !!! – I think Skye spotted it too. Anyone seeing this ?

      I am watching live feed and when they were just at sidebar, the camera was on Jodi the whole time, she stuck her hand under her shirt and was maybe adjusting her bra strap or something.

      I hope whoever this male juror is knows exactly what she’s trying to do, and anyhow, he wouldn’t be able to “enjoy Jodi’s charms so to speak” because she will be either on death row or life behind bars. I hope he is too smart to fall for her tactics!

        ALV would never back up from claiming JA suffered domestic abuse, she said Dr. Samuels’ testing procedures were within reason, and just generally made a fool of herself regarding TA. Dr. today is agreeing with JM when he is backed into the corner. I feel that he has harmed the case today and certainly not helped it.

    This expert is not license in Arizona, do they have to pay him? Is’t he breaking the law? Perhaps the staff writing out checks need to consult with counsel, it sounds like secondary gain to me. Get the sheriff Joe involved, he will deal some Justice western style.

    This is not fair to the experts who follow the rules.

    Dr. G is using the word “exaggeration” when Juan is asking him if something is a lie. He is not saying it’s a lie, he is saying exaggeration (same thing if ya ask me).

    Then, Juan asks him “Did you go to the Alyce LaViolette school of…” then Wilmott objected. The look on Jodi and Wilmott’s faces were PRICELESS!!!!!!

Her chair is almost on the floor, she is whispering to JW constantly, in fact she appears uneasy if JW is not at the table with her, she is turning around in her low slung chair and almost smiling at someone, and she had to cover her mouth to keep from laughing out in court a few minutes ago during JM’s last cross.

    When they had the picture of Travis’s brain up there, this was the first time I saw any kind of emotion from Jodi’s mom that wasn’t smirking, smiling, laughing.
    She actually looked like she was upset and crying. Maybe this is hitting home for her finally.

      watching livestream…………not so much that useful, just Juan dotting i’s and crossing t’s…….for whatever reason for me right now, i just feel like i need to see this through……..but, NO, no big revelations, couple Juan funnies and Jodi weirdies, but defense made no dent, IMHO

    Dr. Hayes just said that Dr. Demarte was right in administering the reading test to Jodi. This is in contrast to Dr. Gaffner saying it wasn’t necessary and LaViolette and Samuels did not run this test.

    Dr. Hayes is very credible and highly credentialed. And once again, Wilmott is making an ass of herself with her questions.

      so, as a veterinarian, my argument for not using a new drug or vaccine is that i want to wait to see how other peoples’ patients do on it first………..my rule is wait 2 years b4……..let another vet’s patients show us how effective the new RX is……

    How many times does Wilmott have to be told that a traumatic attack by a tiger is different than an attack by a bear!

    Dr. Hayes is explaining why they are different and Wilmott is not getting it! Dr. is talking about a seminole (sp?) event. Saying that you would have no objective data to make sure it is authentic.

    Listening to Willmott babble about the brain is mind numbing. I am in nursing school, and I can tell you that even after I memorized every part of the body and it’s function, I still had no true concept of it until I saw a cadaver. You do NOT know from diagrams and articles what it really looks like until you SEE it. Until you work with it you can not testify to it. I think I will listen to the examiner, who looks at bullet damage to brains all day every day.

    OOOOH! JW is digging a deep deep hole for JA. The blonde doctor just said if someone lies once on a subjective test how do you ever believe them. Bet the jury heard that! She is really driving home the problem with believing a liar. Earlier today I thought JW had a hard on for Dr. D, but now it appears she has a problem with JM’s psychologists period. Appears she wishes she was a psychologist or thinks she is as good as one. Bad day for JA.

    Jury instructions and closing arguments start tomorrow at 9:15 Phoenix time…..the end is near….in more ways than one. It’s great testimony, but I don’t think it’s good enough to stay up for – you can see the good parts on the recap shows….or just read about it here.

    A poster in another forum said that Dr. Gaffner and Wilmott lied when they said that the Judge in the case in which Gaffner testified and Judge threw out his testimony had resigned after that case. The poster said they researched and the Judge did not resign and is sitting on the bench in the court of appeals.

    Couldn’t Juan impeach Gaffner for this lie? I hope Juan also checked on this and takes this info to Judge Stephens.

    Highlights, anyone? I’m really just curious if Jodi kept staring at her boyfriend juror (in her mind) and caressing herself for him or was she throwing visual digs at Sky and Chris Hughes? Did her demeanor change with the pics of the brain up for the courtroom? Did they show much of Travis’ family and their 3 rows against Jodi? I am fascinated at how this woman, (eh hem…MONSTER) is cracking here at the end. She is cunning and self-professed genius, She really has been putting on a terrible act from the start. I feel like she thinks her goose is cooked, she has heard even her own witness’ use the word “psychopath and deviant”. I feel like she is highly pissed when they throw those words in, even by accident, because they are trigger words to what JA really is. The jury knows..it’s not a secret, JA!

    I’m going to have to watch the forensic psychologist’s testimony today & Dr. Horn because I passed out as soon as my butt hit the bed. Working all day and court’n all night, whew! Props to those of you who endured last night. Closing arguments are within reach! I hope Obi-Juan reminds the jury about the brutality of it all, this was no simple death sentence she gave him for having feelings for another woman, TA tried his hardest to escape her murdering rage.
