Jodi Arias Trial Day 38: Defense Files Protective Order Against Journalists

There is a whole lot going on this morning at Tamaratattles and I tried to sleep through the whole thing! Thanks to Dede who alerted me to a hearing this morning where the defense team in the Jodi Arias trial is attempting to get a protective order against three journalist (sound familiar?). Jodi’s legal team filed for a protective order from Beth Karas (HLN), Shana Druckerman (ABC) and Paul Matadeen (HLN).  They are holding a hearing at 9:00 am today, but it’s not being heard by the same judge.  The request was filed electronically at 8:00 a.m. local time yesterday, March 26th. EDIT: WE MISREAD THE DOCUMENT. THE FILING WAS THIS MORNING AND THE HEARING IS TOMORROW MORNING AT NINE.

I have not been alert enough this morning (need coffee) to see what if anything HLN is saying about this but the hearing should be going on now. I will update you when I hear something here.

Today, the defense has a domestic violence witness on the stand. I was unaware that there was any proof that Jodi was a victim of domestic violence, but nonetheless that is what is happening.  I formed a snap judgement about this witness yesterday. I look forward to hearing what y’all think in the comments and updates today.

I encourage everyone to comment regardless of opinion. We are a fairly tame bunch here. Usually. Sometimes. 🙂

    Are they for real? Beth Karas? This woman is one of the most professional analysts on news TV! I adore her and the gorgeous Jean Casarez, who I can listen to all day long. Both women, in my opinion, are brilliant in what they do.

      I agree totally. Beth Karas is the most professional and has been a journalist/attorney for decades now. btw, i just met her a couple of weeks ago and she was so friendly and sincere in meeting me.
      Beth would never do anything unethical……..ever

          I was in Phoenix visiting my daughter. We went to the courthouse, but did not join the crazies waiting to get in the courtroom. We did see a lot of the family on both sides outside during the lunch break.
          Our car was parked right in front of the In Session trucks so we got to meet Beth there.
          I have always thought she was and still is the best journalist reporting on cases. She talked with us for quite awhile. Its clear she loves what she does and also appreciates “us”

      I heard on HLN this afternoon, it was regarding talking about how much money the taxpayers are paying for the trial.

      You cannot be on HLN unless you are willing to smirk, criticize, ridicule, slander, call names, roll your eyes and hate the latest target of HLN’s witch hunt or mob lynching.HLN is not a news channel. On real news channels, reporters do not inject their personal opinions into the story or slant their stories against the individual being reported on. HLN is directed towards people on the lower half of the IQ scale. Who else would watch such hate? Beth Karas has gone over to the dark side.

        great, my thoughts exactly. N. Graceless is prosecuting the case. She’s toned down her harpie style, softened her voice to cover up telling the story from the prosecutors viewpoint. No one reporting here, but Ryan Smith and Vinnie are doing some great placebo “trials” on different topics. They are being neutral to some extent and this is a vast improvement

      I feel the same way about all the HLN team as they all are very professional. Why did Jodi & her team feel this necessary? Is it because they don’t want anybody to know what they are making? That should be public since the taxpayers are paying this.

      Me too! I think they have bonded to each other. Who gave Jodi the power to do this? She isn’t paying this as the taxpayers are!! Take Jodi’s money she makes from Ebay to help pay for this.

      I agree absolutely. Beth Karas is without a doubt the most professional, thoughtful, and fair-minded journalist on the HLN network. Jean Casarez is OK, but she seems to miss a lot of the nuances of the proceedings.

    Interesting to hear yesterday how Jodi had such anger issues with her Mother – and that it escalated once she was incarcerated. Hitting/kicking/slapping her Mother? that’s some serious behavioral anger issues…..

    Question… Yesterday the jury was asked to disregard that martinez pointed out that jodi says she left travis a voicemail to cover her filthy tracks while the doctor claims she did it because she was in denial. Why cant that be discussed?? Ive wondered all along why the hell the doctor would suggest that, unless he didnt know jodi admitted to trying to mislead police. He has proven himself to be a hot mess, after all. So why cant the prosecuter point that out??

    As I have recently learned first hand, anyone can file for a TPO for any reason at all. The facts will come out in the hearing. I hope we hear what the judges ruling is.

    I keep thinking to myself–why is there a domestic violence expert up there, droning on and on about cases of legitimate abuse? How is this going to change the nature of the crime that Jodi committed? If this is the defense’s way of trying to demonstrate that Travis was abusing (the linebacker lunge) Jodi prior to the murder, and that she acted in self-defense, where is the evidence that she was physically abused, then or ever? After the murder–which required plenty of physical exertion in itself–she was capable enough to drag his lifeless body around (imagine dragging around a 200 pound sack of weights, ladies), clean up a crime scene, drive to another state and voraciously hook up with another man–the only physical signs that were evident on her body were the cuts on her hand from the bloody knife stabbing.

    I guess the question is– wouldn’t a smallish woman who was felled by a line-backer lunge by a 200 lb man onto a hard bathroom floor show any signs of injury? I’m guessing I would be knocked out, have bruises, broken or sprained bones, a concussion…I mean this story just does not make sense. I am hoping and praying that Martinez focuses on this rather than other irrelevant instances of Jodi’s many lies.

    Also– I do agree that Jodi Arias appeared to be verbally abused by Travis. Actually, to me it seems that they were both intense individuals who verbally abused each other at times. But does verbal abuse qualify an individual for murder? Do you defend verbal abuse with guns and knives?

    The state can only go with clear evidence of things that occurred–we have NO evidence or corroboration of Jodi being physically abused by Travis. So this expert can drone on and on and on about character assassination, but at the end of the day, how does it excuse or soften the act of murder? Sorry if I keep belaboring old points…

      The witness will definitely report that it goes on behind closed doors so no one else knows. That’s what Aries is counting on…that, her lying words and the selected emails, texts, taped phone calls, her phones diary, etc

        So then it comes back again to trusting what JODI says. Which is why Juan did such a great job of building her up as the liar she is.

        This witness can NOT testify to Jodi being abused — she was NOT THERE and has to trust what JA and her defense team told her.

      She’s still in the “qualifying her credentials” stage, I believe. This will take awhile. Typical for this Defense. Usually, I see professional witness state their résumé or vita THEN they begin testimony. Seems this judge is not in control of her courtroom. She’s supposed to outline credentials then move forward with questions PERTINENT TO THE TRIAL. geez. This is frustrating

      YES. Why is the judge allowing this? We don’t need a lecture on domestic violence, or a personal history of someone’s therapy career, tell us what the heck this has to do with Jodi’s murder.

      Ugh I’d actually rather work than listen to this much longer…

    Does anyoe else get shivers thinking this domestic violence woman is actually describing Jodi Arias how abusers threaten to hurt you or THEMSELVES i.e threatneing suiccide repeatedly, or hurt animals as she kicked a dog for shredding the trash?

    She is going through a list that seems to be from her book… and giving examples from her practice. It’s weird that threatening suicide and threatening to kill someone are all things that JODI has done. To me she is describing JODI as the violent partner and Travis as the victim. Am I the only one seeing it this way?

    If the Dr Samuelson and Ms LaV interviewed Jodi Aries, they definitely ask questions with certain words that imply or indicate trauma/memory issues/domestic violence/abuse. The more questions asked, the more she would glean (if she didn’t in fact read all about these issues herself), from their queries. This Defendant is evil. She’s smart and sly. All she has to do is make claims that apply, testify accordingly, then sit back and have these experts do the rest. Just about any kind of acting out, according to Ms LaV, is an indication of abuse. This is just too convenient for JA. THere ARE MANY TRULY ABUSED WOMEN AND MEN in our world today. This is going to DAMAGE true progress in this area.

      To be fair to Ms LaV, I think we’ve all watched enough Lifetime movies to fake being battered if we put our mind to it. I don’t think that she is making things up like the good doctor. Unfortunately, real abuse is often a case of the victim’s word vs the abuser’s. So all she has to go by is Jodi’s words. That is why it is so infuriating because when one person lies about abuse, it cast shade on future victims.
      The lady sounds knowledgeable and even though the defense is trying to get her to hypothetically talk about Travis as an abuser because of the household he grew up in, she is not demonizing him.

    Jodi traveled by car thousands of miles to accomplish this brutal butchering of Travis Alexander. She didn’t live with him, he ended the relationship. I believe the jurors will put it all into context. Oops, my grandson just reminded me of the Casey Anthony verdict! Well, they were sequestered and wanted to go home and I don’t think they did their due diligence. Just hope this group does!

    I listened to Alice this morning with Travis in mind. I have to agree, Alice is describing Jodi to a ‘T’. Including the assassination of character. Remember how Jodi said she didn’t want to affect anyone’s marriage and then promptly said the woman’s full name when describing who Travis was texting to? Like hell she didn’t want to hurt that woman’s marriage. She gleefully did so. From that moment forward, I knew this was Jodi taking whatever shot she could to disparage anyone – anyone – involved in this whole relationship. The problem lies in Jodi – and Alice is proving that point.

    As an aside, no wonder there aren’t any sidebars so far. JW is sure going to let this witness talk as long as she is describing Jodi as the violent one and Travis as the victim. Sometimes you just have to laugh at the defense team. I can’t believe they don’t see the irony in their choice of their closing witness.

    spring cleaning the man cave in the basement today so I’m forced to watch the trial on HLN instead of streaming on my laptop…honestly, the commercial breaks are more interesting than this domestic abuse expert! WHY must we get this tutorial on the subject with no hint of how it might apply to JODI ARIAS?
    I think this judge is as bad as Judge Ito from the OJ trial…

    I’m busy recapping Big Rich Atlanta but I peeked at my TL and someone said that this expert was the SEVENTH one the defense asked to testify with all the others declining. I did not hear that for myself….so take it for what it is.

    I also believe that this domestic violence witness is describing Jodi. Also, I noticed just now (I’m watching the live stream on the internet) that while this woman is testifying, the camera is on Jodi and she has her hand up on the side of her face and her finger is really bent now. Looks to me like she is trying to show the jury “see what Travis did to me?” She claims Travis broke her finger, when it is so obvious that the finger was injured when she was forcefully stabbing Travis.

    I can’t wait for Juan Martinez to get a hold of this witness and bring the truth out!!!!!

    Okay the lunch break was not a long enough break for me. I really don’t have any interest in a lecture about domestic violence. I’m gonna watch something more entertaining for a bit. I had a stressful lunch and this isn’t helping. I’ll read along here though so I will know when Juan is up and come back then. 🙂

    I think this witness is probably the best option Jodi has to maybe escape the death penalty. Yes she is describing Jodi more than Travis but we know that from all the news, the jury has not heard or read as much as we have (BTW I don’t really believe that none of the jurors aren’t following this story on HLN). Since we all know Jodi made up all the BS in her diary we don’t buy her victim story. This witness basically explains why Jodi never told anyone she was a “victim”. It will be interesting to see if the defense uses her to actually testify about Jodi specifically or just has her generally address the topic. Juan can’t jump all over her if her testimony is generic.

    My theory from day one is that this defense has never been about getting Jodi off but about avoiding the DP and by some miracle if she is acquitted well that would be gravy. We all know Jodi is guilty of cold blooded premeditation but I am not sure Juan has proven that. He certainly showed how the bad doctor was no better than Elmer Fudd but his attack of Dr. Fudd didn’t prove premeditation. All it takes is one juror (and that would have to be the only juror who doesn’t watch the news when he/she goes home at night) to buy into Dr. Fudd or the current witness and you have a hung jury.

    Judge Stephens is no better than Judge Ito was. I can’t believe that this is what day 37 and it took almost 90 calendar days to get this far….just ridiculous.

      He can counter her generics and turn them around to fit Jodi just as she made them fit Travis. His text messages of being completely fed up with her antics, her breaking into his house, her refusal to let him go, can all stick to her like glue. Those things can show her as being a bully, abusive, a control freak, etc.

      She just gave a hypothetical – by listening to it – it’s clear she was talking about Travis’ childhood. Well, what about the childhood of a disobedient daughter – fast ass, etc. type daughter? What about a daughter so aggressive, she would hit and kick at her own mother?

      Her testimony is not meaningless, but in this case, it simply doesn’t apply. I suspect the reason they couldn’t get anyone to testify for her is, all the evidence points to her as being the aggressor – not him.

      I am hoping Juan very politely proves that nothing this expert said pertains to Jodi. She seems like a good therapist, and a very caring woman, but she can’t really say with any certainty that Jodi was an abused woman defending herself when she killed Travis. But her testimony could hang this jury if it makes even one person believe it could be a possibility. So far, she hasn’t said anything specific about Jodi, and I’m starting to wondering if she will!

    Susan’s post made me think of something. Whenever I am driving a long distance to see someone, I always call when I am getting close. I guess just to let the person know…a heads up to be ready… If Jodi shut her phone off in AZ then that clearly didn’t happen. In fact it doesn’t look like Jodi and Travis really talked much at all that day. So it seems likely that showing up at 3 am was a surprise. And if it was he may have just let her stay with him because…where else did she have to go. So she slept over, woke him up with a BJ and things happened and then he sent her on her way, she pretended to leave and came back in and killed him.

      They must be watching Dr. Drew. He commented on them dressing alike. It does look creepy when a client accused of MURDER, dresses like his/her attorney(s). It’s juvenile as well. I wish the judge would put an end to this TESTIMONY. It’s crazy to let this woman drone on in abstract. NOTHING she’s said, and I haven’t even heard it all today, applies to Jodi. I almost look forward to the jury trying to nail her down on how this applies to Jodi specifically.
