Today the Jodi Arias trial resumes with an evidentiary hearing. It was supposed to happen last Friday, but one of the attorneys had some sort of emergency and so once again we are going to delay testimony. I have never seen anything like this case. Over the weekend, on a Saturday and Sunday the Ohio juvenile court wrapped up a high-profile rape case in Stuebenville. The verdict came on a Sunday. It was not a jury trial. The judge actually worked the weekend to get things done. Meanwhile in Arizona, I’ll be surprised if we get any testimony at all today.
The hearing is about what exactly the defense’s expert witness can testify to. He wants to talk about two kinds of murder in a way that might lead the jury away from premeditation and a first degree murder conviction. Juan is not going to allow that if he can stop it. Unfortunately, because this is a death penalty case, the judge is more likely to err on the side of letting things in rather than leaving things out of the defense’s case. Allegedly, the hearing will begin at 1:15 EST. We will be recapping and discussing the day in comments. Please join us!
Does anybody have any idea if Jodi has access to TV, and the news shows showing her trial and their evaluations? Is she aware of what we are seeing on TV every night, i.e. her handstands, singing, etc.? Do her attorneys inform her of these things? I’m just wondering…

off topic but TMZ has a live camera in the Lilo courtroom this morning. She was almost an hour late. It’s got the Seal of California right now, but it might be fun to watch. I am trying not to get my hopes up that she will do time. Because, you know how they do in Cali…

It was an even bigger waste of time than we thought because the defense changed their mind and dropped their request for a hearing. The jury was not told to show up until 2 so now we just wait AGAIN to start.

He also said he formed his opinion based on her diaries, her tv & police interviews, talking to her, etc. In other words, he based his diagnosis based on a liar and the lies she told. Pathetic.

Poor Jodi… What a tragic life she’s led. First a series of boyfriends who cheated on her and introduced her to anal sex. Then meeting Travis, who who made her a victim of domestic violence, and continued to force her into anal sex as well as other extreme sexual practices. Then to top it all off poor innocent Jodi, had to endure a long journey, smelling gas fumes in the heat of the desert just to visit Travis. Then she has to stab Travis 29 times, shoot him in the head and slit his throat! Poor innocent victim Jodi, because of Travis she now has to suffer from PTSD and loss of memory. Poor Jodi just can’t catch a break!

Maybe not clearly enough… Off topic question: If Travis HAD loaded the gun, would he have been irresponsible enough to leave it on a shelf in his closet knowing that Jodi would be cleaning those shelves? That gun could have gone off accidentally. I don’t think he would have been so careless. We know that most likely he did not own a gun, but if he did he wouldn’t have left it loaded on the shelf.
I don’t think Jodi was so much a closet cleaner as a closet (and everything else) snooper.

I thought I heard that closing arguments are estimated to start March 25th.
Knowing that Juan would bring it up, the defense brings up the fine and judgement against him in NJ.

Lindsay trial is on now on TMZ. She is pleading and going to get 90 days of locked rehab. 30 days community labor, 18 months of psychotherapy. Fines etc. Back on probation

It’s funny you mention cost. I wonder how much the good citizens of Az are paying for this bullshit testimony. She wasn’t abused, he was. She didn’t have PTSD, he did from dealing with her ass. This is a mockery of a great profession.
How can this Dr. possibly not be aware of the state of New Jersey changing its rule about bartering — which directly affects his profession? I would imagine that Juan will clearly dissect him on this.

I was in phoenix last week. Went to the courthouse , but there were 30 or so people waiting since 6 a.m. to get in around lunchtime. i had no desire to join them.
But, my daughter and i had a nice talk with an employee in the know about the trial right outside the courtroom.
we talked to him outside too when i guess he was taking his break. very nice guy, but the only gossipy thing he parted with was that nancy grace is never in court. probably has an assistant do that for her.
we decided to wait outside on a bench directly in front of the door everyone comes out of. meanwhile a bum sits nexts to us on the bench. the bum turned out to be a court watcher we saw on tv later that night…..lol
so, we saw jodi’s mom and her twin sister exiting laughing…..we saw travis’ brother who is short and walks funny. we also saw the sister , the one who doesnt wear a pound of makeup leaving.
we met beth karas in front of the insession trucks before we left. she is 100% genuine and so friendly. much prettier in person and very tiny. i got to tell her how much i admire her and her work.
it was a lot of fun and im sure my daughter is happy im gone as she doesnt have to watch or hear about the trial anymore.

Court is back in session and her lawyer is asking her about the “nothing noteworthy” entry….and about the “there is something off with that boy” entry. He’s saying she would only write things that are positive and he doesn’t remember seeing anything negative about him! Hello!!!!

I ‘ve been watching this witness with amusement since he took the stand. I am a legal nurse consultant. My job incorporates researching and hiring professional witnesses, such as medical doctors, nurses, psychologists, etc., for the purpose of testifying at trial, or evaluating trial information, for presentation at trial as a case is presented. This witness has not presented any legitimate references, observations, or documentation that should be considered as fact in the consideration of this case. This is smoke and mirrors at worst, or incompetence at best. I would be interested to view his patient documentation ( notes) on each of his evaluations. JM can request and present this info, although I don’t think it is worth the time, as I predict he has already determined how he will discredit this witness. This is a ploy to keep the clock running and attention focused on Jodi, which could run in favor of jury sympathy for Jodi. This is empty testimony.
I have to agree. Thus far all he has produced is a few articles – at best. And, even those sound like they were written about a 1st yr. grad student.

Her attorneys are claiming her 6th admen. rights will be violated if Juan asks about any sort of treatment she may or may not have had – b/c the state should know that he didn’t treat her, he only examined her. They are still arguing out of the presence of the jury.
Cross examination of the good Doctor!!!
Juan just asked the witness if he tries to hurt or help the people he examines. He said of course he tries to help them. Juan asked him if he tried to treat Jodi and now we have a side bar. And that was all of 30 seconds.
Trial is back in session! Juan is asking about a book the doctor provided to Jodi about depression and self-help. Oh God, I can’t watch this anymore. Talk about a train wreck. The book cost 9.00 and he ordered and paid for it on his own. He says the book was not a gift. Holly crap Juan is aggressive as a pit-bull. Juan asked him if he purchased the book b/c he liked her. He said he doesn’t like her…..
The doctor says he spent 25-30 hrs with Jodi. Apparently there’s a code of ethics prevents the doctor from purchasing gifts. He keeps saying it wasn’t a gift and he only purchased it b/c she was suicidal. Voices are raised b/w Juan and the good doctor.
This is mildly amusing. Her lawyers just asked for another side bar. Apparently there’s a psych on duty that could have dealt with her suicidal tendencies. I think Juan is trying to get to the point that this doctor was under the spell of this man-killing harpie.

He’s calling him out on having to read from the book so much. He’s telling him many of the diagnosis don’t even relate to what he said. He’s called him out on his barter issue. He’s insinuating Jodi lied to him and the guy is to stupid to know the difference…and on how he graded her test….He just called him out on the type of doctor he is and the fact that he’s not a MD and can’t prescribe meds….

Oh you’re missing something funny, yet tragic. This poor man’s career will not fare well after this.
Samuels is supposed to give an unbiased review of Jodi’s mental state. However, a relationship was sufficiently established that he is buying her a book and being called to talk her out of her depression even though there is a psychiatrist on duty who could have handled it. I get that Martinez is trying to say that that relationship could skew his diagnosis in Jodi’s favor especially since it is based on what she tells him.
I thought it was interesting that he uses the same words to describe her amnesia that she does i.e. fog etc.
However, Martinez’s confrontational tone is distracting and creating implications that are just unecessary. I don’t think he is trying to say that Jodi and the good doctor had something going on but he sometimes focuses on tiny details and loses sight of the bigger picture.
I think so too. That’s why I’m sitting here thinking tone it down. He’s making his points, he just needs to calm the hell down.

I do think Juan is aggressive. But I think it’s warranted with this doctor and with Jodi. I just wish he’d tone it down. When people are constantly crunk and loud ppl don’t typically hear a thing being said. In fact, ppl will tune out. I know I do. So, my issue is I don’t want him to turn the jury off being so abrasive and crunked (hyped & loud) up. I do get a good laugh from Juan though. Seriously, when he goes into the
‘did I ask you that? I didn’t ask you that did I?’ and so forth, I laugh like crazy. Especially when he was talking to Jodi.
I agree TT. On My first visit to this site I mentioned what a riot I thought TeeCee was even if we disagreed. I actually miss her (a teeny bit!) when she doesn’t post. That may be why I don’t mind Juan. As a non-criminal lawyer, I have had my share of epithets thrown at me by others behind my back. Reminds me of a t-shirt I always wished I had bought: “You call me a bitch like that’s a bad thing.” 🙂
I’ve noticed even here among us that some people are way more conflict averse than others. For example, for some all TC has to say is boo and some people flee never to return, while other either ignore her, argue with her or confront her. I’m using her as an example because I know she won’t care, there are others here that can be confrontational myself included.
To me, I don’t find Juan to be overly confrontational at all. I think he is very direct and argumentative at times. His style would not effect my deliberation at all. I barely notice it and wouldn’t notice it at all if there weren’t so many people constantly pointing it out.
But I guess we do have to be concerned about the possibility of shrinking violets in the jury box. However, based on their questions, I doubt there are many of them.
I agree 100, Tamara! I grew up with three brothers and married an extremely vocal man (wish I had marriage amnesia, will have to consult Samuels… maybe not :/ ) I don’t notice JM’s volume until pointed out to me. I do see his passion and feel there is a reason they chose this Prosecutor for a reason. His style is one in which delivers and i likey!!! #winjuan

If this comment is meant for me I could articulate my response a bit more for you. JM’s style is basically pounding the answers from the defense verbally. Will he get loud? Of course. Would a defense have researched his previous work and been prepared for his style of prosecution? Again, of course. We all have varying characteristics that make us good at what we do. He prosecutes and his element of aggression is how he works. BTW he is extremely good at it. Sorry may have confused one with a snarky remark about loud men being in my life. May have thrown you off. My point is I don’t notice his becoming loud for that is his form of getting answers. A thing he does well in my eyes and I will continue to be a fan. Clearer?

I honestly dont know how he stays so calm! Its infuriating! I mean first Jodi was a hostile defendant and now this numb nuts. As soon as this guys opened his mouth I knew they were in trouble! Uck! They probably had a hard time finding someone willing to tarnish their good reputation when there is just no way to work wih a liar like Jodi , so they had to settle on someone who is less than above board. Its no doubt that the defense has always had their work cut out for them with this nightmare of a client. I dont find Juan too aggressive at all, given the circumstance. I think Martinez is extremely skilled in his cross examination. He listens attentively and is always after the most direct, concise response — he will not allow freelance editorializations, so to speak, as this confounds. To get those concise, direct responses he often has to continue to hammer the point. In addition, the fact that he is in constant movement and gestures frequentlyl, uses his voice as a tool — inflections, tone, decibel level — he commands attention. As opposed to Nurmi, who speaks in a soft, slow monotone. A trial, any trial, is often a tedious experience for those who sit on the jury.
I enjoy watching how Martinez flourishes his knowledge (the key points) of the witnesses to derive the most precision in responses. Through him, I am teaching myself to be a much more attentive listener. In conversation, many of us tend to listen halfway, thinking instead of what we want to say next. Martinez is teaching me that I don’t have to do that, but to give my full attention to my conversation partner and in meetings.
I don’t find Mattinez to be overly aggressive. I think he’s doing his job. I mean I can only imagine how you might come off if you had to do his job. He’s listening to a cold hearted liar blow off the fact that she brutally slaughtered someone. then she’s allowed to get on the stand and make up horrible stories about him in front of his poor family. Then you have a “expert” witness trying to convince people of how damaged she is and how we should all feel sorry for her. I can imagine you’d get argumentative with them too. If I was the victim’s family this is exactly how I would want someone to fight for me. Because essentially, that is exactly what Martinez is doing. He is speaking for justice for Travis and his family.
Curious if anyone has questioned the shell casing in blood on the floor. I noticed it is over the grout actually and not on the tile itself. Could the blood have run under the casing rather than falling onto an already bloodied floor?
