Today the Jodi Arias trial resumes with an evidentiary hearing. It was supposed to happen last Friday, but one of the attorneys had some sort of emergency and so once again we are going to delay testimony. I have never seen anything like this case. Over the weekend, on a Saturday and Sunday the Ohio juvenile court wrapped up a high-profile rape case in Stuebenville. The verdict came on a Sunday. It was not a jury trial. The judge actually worked the weekend to get things done. Meanwhile in Arizona, I’ll be surprised if we get any testimony at all today.
The hearing is about what exactly the defense’s expert witness can testify to. He wants to talk about two kinds of murder in a way that might lead the jury away from premeditation and a first degree murder conviction. Juan is not going to allow that if he can stop it. Unfortunately, because this is a death penalty case, the judge is more likely to err on the side of letting things in rather than leaving things out of the defense’s case.
