Sheree Whitfield’s Chateau Sheree Hits Another Roadblock

November 4, 2012 Some insulation was delivered on a rainy Sunday.

The mysteries of Sheree Whitfield’s finances continue today as TMZ is reporting that, “Uncle Sam filed a tax lien against Sheree in Georgia for unpaid taxes in the  years 2009 and 2010  to the tune of $41,752.83”  The interesting word to me in that quote is ‘lien’. What the heck does Sheree own that the IRS could put a lien on? Last I checked Sheree only owned Chateau Sheree for the first six months of 2012 after buying it from her mother for a dollar in December of 2011, she sold it for a dollar to her daughter Tierra in June of 2012. So I journey once again over to the public records and it shows no transactions since that time. HOWEVER, up at the tippy top of the record, Sheree is listed as the homeowner. Don’t you just love public records? So is she or isn’t she the owner of the glorious château or not?

It’s hard to tell just by reading the record. I keep changing my mind on what is going on here. Perhaps she recently bought the house back from Tierra and the records are not updated yet? If that is the case why is she listed as the owner on the top of the document. I feel like I am overlooking something. Frankly my brain hurts from trying to figure this out. I can’t see Sheree being dumb enough, okay let me rephrase that, it makes no sense to me that Sheree would have put the house back in her name with her divorce lawyers case going on, or most especially after she lost in court. I’m tired of trying to wrap my brain around this. All I know for sure is Sheree has some serious money problems that selling cheap trinkets on Kitsy Lane is not going to solve.

UPDATE: After talking to a few people the consensus it that the daughter appears to still be the owner of the property. This would suggest that perhaps TMZ meant to say that the IRS levied Sheree’s bank account. That probably still won’t get the IRS much coin since Sheree is unemployed and Bob was sucessful in getting his child support reduced. That last lump sum he paid was probably already grabbed up by the lawyer’s judgement. SMH  Broke. Just Broke.

If it is a true IRS lien, then they probably caught her when she had the title switched out of her mother name. The IRS would have priority over any creditor. I am just wondering why Sheree owes the IRS so much money for those years? Were they making that much on RHOA or was it the money she received from Bob?

If anyone sold the home and had not lived in it for 2 years, wouldn’t they have to pay capital gains taxes off 100%?

No. The property was sold for $1. However, I wonder if the taxes on the property are current? Maybe she has to pay the taxes on estimated value of the property she bought or outstanding property tax? I don’t why she demolished the existing house! I guess Sheree has no common sense. Sheree’s mother probably did not want that property under her name and it is probably because of property taxes. Especially if Sheree was not going to keep them current.

I don’t know about Georgia but in Texas you have to pay property taxes whether the house is occupied or not so she probably was behind on those and has probably gotten her daugter in a jam, as well. Also, doesn’t she still own a couple of used luxury vehicles? Maybe they’ll take those. Either way, looks Neverland will remain incomplete.

i don’t know why you guys keep talking about property taxes. The property taxes have to be up to date because the house has “sold” three times over the past two years. You can’t sell a house if property taxes are not caught up.

The IRS puts a lien on your house for INCOME tax.

Sorry, I wasn’t saying the lien was for property taxes, I was just replying to an earlier post where someone said that the property taxes may have gotten behind after the sale to Tierra. In Tx they just auction your house if the property taxes are behind so if it’s the same in GA she could lose the house too if she gets too far behind. It was beyond stupid to not pay taxes for years where it was publically televised that she was working. But this is Sheree we’re talking about!!

I checked out her Etsy page to see if she was designing. Saw a piece of jury I liked, but just can’t give a housewife my money.

So, that’s got to be her income from Bravo, right? Gawd knows she doesn’t/hasn’t had a job since being on Housewives. Or is that all the money made by She be Sheree! LOL

Yeah the income from 2009 and 2010 was from Bravo. I don’t understand people who think they can just not file taxes. SMH.

She definitely hasnt bought the house back from Tierra (I checked GSCCCA which updates faster than the fulton county tax assessor)…Banks will normally do something called a blanket lien where if the lessor purchases anything during the term of the loan can become collateral (or reposessed) if the loan isnt repaid (regardless of whether or not there is a first lienholder)…im sure the govt has just issued a lien in hopes of getting their hands on something…and I’m sure if they find out that she is committing fraud by putting a home that she intends to be her primary residence in another persons name theyll seize the property anyways.

The taxes last year were based on the specifics of the old torn down house and were only about 4K. As I understand it the property taxes are usually paid as part of the mortgage payment. I get a bill every year because I paid cash for my house. But it would seem hard for someone in GA to get behind on the mortgages.

And thanks Stephanie for checking GSCCCA ! I hate signing up for accounts there. LOL. So I am more inclined to think that TMZ meant a levy on the bank account. They mentioned coming after her bank account in their story. I thought they meant in the broader sense since they used the word lien instead of levy.

At any rate. Sheree’s kids won’t be gettting new blow up mattresses any time soon.

I think you can opt to have your taxes and insurance held in escrow or pay them on your own. Most people have their lenders hold the money in escrow because its easier that way (and a lot of lenders insist because they don’t want their lien position compromised) but I suppose Sheree just wanted to be different!

I work for “Uncle Sam” and part of my job description is to file Notices of Federal Tax Liens.

A Notice of Federal Tax Lien just puts the public on notice that the Federal Government has an interest in any property real or personal that the taxpayer has or will acquire within the next 10 years. The taxpayer doesn’t have to have real property for a lien to be filed. If she has real property and she attempts to sell it, then the govt gets their share after the mortgage company and possibly any other creditors that were owed prior to the assessment of the federal tax. If she doesn’t have real property it will be difficult for her to get any with a lien on file.

If her bank account / wages / investment accounts / life insurance policies were levied, nobody would know but the bank and Sheree – a levy isn’t public information unless she spills it or the financial institution /employer / third party spills the beans.

We don’t automatically have priority over all other creditors either. Depends on several factors which include the type of creditor and when the federal tax was assessed.

Her bank account could very well have been levied though – or it will be soon. Normally the taxpayer is given an opportunity to provide full payment or documentation to verify their financial condition – if they fail to meet the deadline specified by the Service then the first action is usually a levy. If that doesn’t full pay then other enforcement actions can be taken (fraud referrals, civil suits and after every other avenue has been exhausted possible seizure – but Sheree doesn’t have anything so I doubt seizure is an option).

Sheree has ignored everybody else – no reason why the government should be any different

Thanks Valley Girl for the additional information. I always thought the IRS had priority regardless. I guess I will never understand why people choose to ignore these issues instead of asking for help and talking responsibility.
Tamara do you honestly think the child support could be seized? I would think that money would be for the children, regardless of her creditor problems.

I don’t think child support could be seized in general. But the IRS might not concern itself with how the money got into her bank account assuming there is any in there.

You’re right – they don’t care – as long as it is in the bank account and the taxpayer’s name is on it then it is fair game.

However, if the taxpayer can prove that the levy has caused a financial hardship and they are unable to meet BASIC living expenses, then it is the decision of the Revenue Officer as to whether or not they want to release all or a portion the levy.

I work with a specialized program now so I don’t issue levies anymore – I just send a request to a traditional Revenue Officer – but when I was a traditional RO I would usually release the first levy if the taxpayer gave me proof that it caused a Hardship; but if they were hard to contact and never responded to any of my requests then they were up the creek without a paddle

Tamara, I’ll be sure to tell them to keep you off the list – but I’m just a mere govt drone and not a big wig :-).

I don’t know you and I am not affiliated with Sharee but it seems like your going through an awful lot to prove something that the majority of people aleady know. We’ve been known that Sharee is broke, most people know that Bravo strung her along and created storylines for her cause they had nothing. I also would be stressed out drving all over the place and getting access to court documents/public records on a reality star that has no intrest in me or what I do. Your not uncovering a major story abourt Sharee being broke cause most people were able to figure that out in seasons 3 and 4.
