Usher is Awarded Primary Custody in Court Battle with Tameka Foster

August 24, 2012 by tamaratattles 20 Comments

Tameka Foster has lost primary custody of her two sons that she shares with Usher. The singer was awarded primary custody of four-year-old Usher Raymond V and three-year-old Naviyd after a ruling by Judge Lane in Fulton Superior Court today.  According to Cherrise Boone, spokeswoman for the Fulton Superior Court Clerk’s office,   “Both parties will have joint legal custody, but Usher will have primary physical custody.” It is unclear what sort of visitation will be allowed with Tameka.

Judge Lane stated in her ruling:

The father shall have final decision-making authority with respect to all matters concerning the children, including but not limited to education, religion, extracurricular activities, health and mental well-being, but he shall first discuss any major decisions relating to such matters with the mother.

In addition, the judge ruled that the parents must attend monthly meetings with a co-parenting coordinator to mediate any issues that arise with regard to parenting decisions.

I’m a bit surprised. I would have expected the court to side with the mother in this case despite the fact that both parties have their share of issues. I’m not a fan of either party, but I can’t help but feel compassion for Tameka. It has barely been a month since Kile’s funeral and now she is losing primary custody of her two youngest boys. I don’t know how she is going to handle this.  I’ll post more when I know more.

Thoughts?

When I first heard this my heart just sank for Tameka. Those boys will now be raised by nannies! IMO this is about money…

Keep Tameka in prayer. She’s under siege; a war is being waged against her. When it comes to these custody matters, money makes a huge difference. I just won a custody battle and it wasn’t cheap. If you can pay for it, victory is easy

She’s been hurt beyond most folks’ imagination. And the weight of it all has to be a strain. I hope that she feels loved and supported and trusts that this situation will change

It is sad Tameka lost primary custody. This seems to happen a lot in Georgia, when high profile males are involved. Deon Sanders will try and do the same thing in Texas.

Some of these judges are star struck. It will be interesting to see how Halle Berry’s situation turns out. I really believe that Tameka didn’t have enough money to fight back. Since she lost, this puts her in a horrible space because the judge may not require Usher to pay her attorney fees. Also, the child support will be limited, which makes it difficult to provide the children with a similar lifestyle shared with the father.

Judges don’t get it always right. It’s not a good thing for a child to become alienated from one parent unless that parent is a danger to the child’s well-being. I look forward to reading the order, because what’s been publicly disclosed doesn’t justify this decision.

A lot of women are losing custody of their kids these days. Most are unfit mothers, didn’t want to mother in the first place, or was just using the kids as a means to an end. I know a girl like this who had a child around 16 or 17 years old, dropped out of high school, married the child’s father when she 17 or 18, divorced that husband, got remarried, became a housewife, had 3 more kids, got divorced, then lost custody when she didn’t have a way to support the kids due to a lack of education and work skills. Others believe she must have been drinking or on drugs to lose her kids, but she was never really into that kind of lifestyle so I didn’t think it was that. I believe she was having all those kids thinking she would get big hefty child support checks if she ever got divorced thinking she would automatically get the kids since she’s the mother.

I agree with you, Tam… While I’m no fan of Tameka or Usher, my heart goes out to her, geez… Money does buy injustice, the children better love their nannies, so sad.

I appreciate the way this blog was written more than STFA..it was so biased.

Im not siding with either parent, but I dont believe this is just about who had the most money nor do i believe that Usher is primarily going to allow his children to be raised by nannies. I think that was one of the issues he stated was a problem with Tameka. He has a mother, grandmother and an aunt? i believe, and they all help.
I do read STFA usually a lot too and when Usher had that big stalker issue, even the stalker herself said when shen went to his house, the kids were being attended to by his mother, aunt, grandmother and himself.

I feel bad for Tameka for losing her son, however this ruling does not mean she has completely lost her sons. It said Usher has primary custody, not that Tameka lost all contact with her sons. Pay attention. They will most likely have an arrangement.

Let’s not talk negatively about any other blogs please. Especially SFTA who is someone I think highly of. SFTA went to much of the court proceedings and has way more info than I do on this topic. Be sure to go read her!

I agree with most of the comments here, though that particular blogger got “inside scoop” by going there, her blogs are usually very biased and come off very evil spirited. Not trying to knock your words Tam, but though blogs should address your personal feelings it’s a very thin line between that and just being completely insensitive.

But to reply here I’m Team Kids. Te children will be taken care of, however they will be taken care of. Whose to say that Tameka would not of hired help? That makes her a fit mother bc she’s around? And also not wanting to play devil’s advocate but anyone ever think that maybe the incident with Kile may of played a part in this decision too? Of course it’s not her fault what happened but the fact that he was left in supervision with someone who was neligent in watching after him properly… I’m not saying that’s what happened but I would like to know what made Usher get that extra edge over her.

I have to agree with Janice, it is the way she wrought the blog. I read her blogs and actually like her as well, but there is a way to write a blog and choose your side but do it in a manner that is pleasing as you did in yours. I am not a fan of neither Usher or Tamaka and my heart goes out to Tameka just losing her son and now custody of her two boys. I do wish she would have asked for a postponement to get her time to grieve just because the case does not go in her favor (which happened)

Just keep them all in prayer…

Funny thing about bloggers. We blog the way we want to blog, not the way our readers tell us too. And we all have opinions.

I guess I missed something. I recall there was a time when the blogs was anti Tameka. Now it seems the tides have turned. Now it seems the blogs are poor Tameka. I don’t know her to give my opinion of her. But I do have a question what is wrong with Usher seeking as well being granted primary custody of his two sons? You constantly hear about dead beat fathers and not wanting to pay child support. He stepped up and filed for custody. My next question I read some where on the net about Usher will be going on tour soon. So he will have nannies while out on tour. How is that any different from when mothers and fathers drop the children off at child care when they have to go to work?

I’ve never been anti-Tameka or anyone else. I have read lots of blogs that are. I don’t know enough about her to have an opinion. As far as Usher, he is on the road a lot. Being gone for months out of the kids lives is way different from kids being in day care while you work a 9-5. I would think that a full-time mother would be a better choice. Unless something is really wrong in Tameka’s household. If there is, I wonder why it wasn’t brought out in court more.

Since I know absolutely nothing about the case, i know my comments will be so valuable to this discussion 🙂
I don’t think the decision had anything to do with money and I can almost guarantee the judge wasn’t “starstruck”. I believe whole heartily that the judge reviewed all the facts in the case and made a decision as to what would be in the best interest of the children. Urrrrsherrr has a strong support system of friends and family in the area and he probably showed the judge he can provide the most stability to the children.
It’s sad that her older son died, but i think it would be so irresponsible for a judge to award custody because they feel sorry for her.
