Giudice Sentencing POSTPONED Until September!

Well, I think we all saw this coming.

Vicki Hyman of The Star-Ledger is reporting.

The sentencing date for “Real Housewives of New Jersey” stars Joe and Teresa Giudice for fraud has been pushed back from July 8 to Sept. 23, the U.S. Attorney’s Office tells The Star-Ledger, although a spokesperson says the delay is “100 percent not” because of the death Wednesday of Joe Giudice’s father Frank. The federal court moved the date because of an administrative issue, says Rebekah Carmichael of the U.S. Attorney’s Office. “It was not moved because of any other factor.”

EDIT: Thanks Buck Henry for the heads up. I was super busy at that moment and thought it was an email that had disappeared. Found it in moderation so now I can thank you!

Thanks JD I found THREE copies in my WP folder, it seems I mislabeled it. :)

Yeah, I am sure the day after Franco drops dead having the sentencing changed is all one big coinkydink.  By the way I looked everywhere for the Teresa coinkydink gif but could not find it and I am in the middle of a much bigger project at the moment.

Do you guys believe the changing of the sentencing date is all one big coincidence?  Oh well, at least we still have Apollo on July 8th. Maybe.

Here’s a tweet from Gia from last night.

Gia Giudice @TrueGia  ·  18h

this is not really happening right now, this is not real..

Poor thing.

I am glad it’s been postponed for the girls sake, poor Gia my heart breaks for her.

I agree. I think the punishment can just as well be announced a few weeks later. The way this has to be impacting the girls and other family members that have no criminal responsibility, I am glad Joe will be available to them in this time of grief. I just hope he doesn’t spend the time in the bars. It does seem like suspicious timing, but strange coincidences do occur.

      • The next thing will be joe can’t go to jail because he has to take care of his mother. There are a lot of men/women in jail who had to take care of their parents.

That’s probably why they are in jail.

    • It comes with Gods plan.

“administrative issue”…yeah, okay, whatever :( They won’t be able to dodge the bullet forever, so I can be patient. For the kids sake, it’s a mercy.

  3. Gingersnap

That was funny in a bad way, or bad in a funny way, but either way, it was funny!

I don’t know why the Fed keeps postponing the plea deal, they must not be close to an agreement. Also, it gives them more time to see the new footage. I guess Teresa will not be doing any promotionals for RHONJ. What a sad time for the family.

  5. Lindy

Sorry I disagree about postponing being good for the kids. They need to get this over with so they can make whatever adjustments they need to before the school year. The anticipation has to be much worse than knowing what’s happening and getting on with it. Unless of course, this grandparent was going to be responsible for the girls in the event Teresa and Joe both are sent away at the same time. Which I think is unlikely, honestly. I actually do think the change in court date is probably a coincidence.

This has really thrown a wrench in my summer plans. As a housebound person with a very disabling condition, I was counting on this for entertainment this summer. It’s getting difficult in this 7th year to keep myself occupied and happy. Dang! Going through major adjustments now as I seem to have a sudden aversion to all of the Housewives shows and Bravo in general. What am I to do!? I spent the first few years reading books, but can no longer read for long periods of time. Am trying books on tape. Maybe I will lose interest in Teresa and Joe as well. 😉

    • Carol

I agree that this will be bad for the kids. They’re going to have a difficult enough time making adjustments with whatever school transfers might be necessary, and now they’re going to have to do it after the school year starts, plus whatever living arrangement changes there are (if any).

    • Riley

I feel you! I started having the first of 7 back.surgeries, the year OJ Simpson went on trial. I saw it from beginning to end. I couldn’t read a lot due to the medication….but that trial held my interest.

    • Lindy, So sorry you are housebound. I have been there – for large chunks of time – and I can relate to what you are going through. Chin up! Maybe you could get into the BB live feeds, do you knit or crochet? That is what I did, I was on so many pain pills that all I could make were potholders because that did not require reading a pattern, or thinking. I don’t know how disabled you are, but if you are able, maybe you could do volunteer work in your home, like puppy raising for Patriot Paws, or something like that.

I hope you have a good summer and that you get well soon.

    • RI Red

If you are looking for something to entertain you this summer, why not try a series on Netflix. I started with Lost and it kept me occupied all winter. From there I went to Breaking Bad and now am into Orange is the new black,..they recently finished posting their second season. Lots of great series on there can keep you very busy!

TT, in a previous post on the sentencing guidelines made mention of the fact that that the state trial was rescheduled for after the Federal sentencing. This could affect the sentencing guidelines. If he is convicted in state court it will add to the points which the judge will base his federal sentencing on. Not a good tactical move. I don’t think they have the “power” to change dates arbitrarily. No should they want to.
I think TT Will have better insight on the effect on federal sentencing. But as usual, she is way ahead of other bloggers with the update.
    Kudos, Tamara.

    • Yes, I as I said in that post if the sentencing date was moved, Joe’s attorney will be right back in state court requesting a postponement. The death might actually be a good enough reason for that. Now whether they can get is set out beyond the 23rd of September remains to be seen. But Joe’s attorneys are good so it will probably be pushed to November.

      • I can always count on TT for current news, thank you TT ! Your hard work is much appreciated :) !!
I wonder if Juicy’s attorney will be able to continue his Driver’s License trial– is it a trial or just a hearing ?
Whatever the Fed’s explanation for the sentencing postponement, I think it’ll be helpful for Tre & Juicy to have the extra 10 weeks or so to properly grieve and settle whatever arrangements they need to tend to.
However, the postponement will create more anxiety, ether way, things will be tough on them and especially on the girls— particularly on Gia.
Sad, sad, sad in every possible way !

      • And since this has been pushed back, then it’s possible for them to start filming for the next season while this season starts to run. They will be able to get a whole season of this and them dealing with their crimes and even who goes to prison.

      • You think the Bravo cameras made it to the lawn on time to catch the ambulance come pick up Frank? Because it would not surprise me.

My condolences to Mrs. Frank Giudice, the widow, Joe and Theresa, and their daughters.

I would imagine that there were plans that Joe’s father might be the male presence in the home to help raise Joe and Theresa’s girls, while Joe is away, and perhaps Frank planned on offering offer some degree of support beyond that. Then, add the emotional impact of Frank’s very sudden and untimely death on the state of this very close family’s emotional wellbeing, the postponement is a necessity. So, I don’t see ANY shame in that.

Regardless of whether it is a coinkydink or not, they should be on bended knees thanking the good Lord above for miracles.
Soon enough the stars will align and they will get what is meant to be. Until then the mental stress of the unknown has to be a bitch. I am sure the wait is aging Teresa twice as fast as normal and when she looks in the mirror and asks it, in her falalalala voice the mirror mirror on the wall question, she is appalled at the answer. Filling putty won’t be enough to conceal the worry lines on her face.
My condolences to the Giudice family. May they make good use of this time to heal from the death of Joe’s father. They loved him dearly.

  9. Katrina

Did Apollo ever bring his records to court? I thought that was supposed to be June 10, 2014.

  10. Brianna

Court dates being pushed back happen all the time! I wouldn’t be surprised if it gets pushed back multiple times! Some of these things can drag out for awhile!!

  11. Gravlax

Tre’s lawyer should write a book on how to work the system. Between her and Joe, there’s years of delays.

Is it bad that my first thoughts were “She’ll be able to film the reunion!!”

    • Micheal

Well this may be interesting. Theresa has avoided any interviews and press for the new season of NJHW, to avoid any risk to her sentence hearing. I even think that the premiere date of the season may have been slightly modified due to her sentence hearing date. So it may be in Theresa’s best interests legally to ditch the reunion till after the new sentencing date. I guess it depends on what is shown in this season’s episodes and when the reunion will air. If she wants house arrest then she has to appear very sympathetic, and any gloating or ‘why me’ talk in the season/reunion may not help her cause.

      • RHONJ reunion won’t be filmed until October. Probably late October depending on how many episodes were shot.

October? I wonder what Bravo is thinking about this. Maybe an early reunion taping just in case she is ‘unavailable’ in October? I’m actually excited to watch this season of NJHW and hope the reunion is less dark but still fun and bitchy to watch. Without Theresa I may not even bother; depends on the new girls I guess.

      • Bravo was never expecting her at the reunion. She was supposed to be in prison by the premiere date for fuck sake.

        Didn’t mean to offend.

      • You didn’t offend Michael, I was just trying to impart info. :) If she hasn’t been incarcerated by the reunion, EVERYONE will be shocked. I don’t think Bravo expects her to be able to make it. That was all I meant.

  13. Just putting off the inevitable.

  14. Bran

I’m starting to think that they both will not see any jail time

  15. MicroOp

The time in my life where I had the worst migraines and panic attacks was 7-11th grade. Middle school and highschool was just super stressful for me and I’m sure hormonal changes contributed. I think I would’ve completely crumbled if I had to deal with what the guidice girls are going thru. I really hope those girls find strength in this and learn and gain internal motivation to do well in life and provide for themselves in an honest and productive manner.

  16. KReality

They won’t be seeing a jail anytime soon…not at least until 2015. Even after they’re sentenced they will likely not have to report to jail for 3-4 months after the sentencing…..the federal judicial system is extremely lenient when it comes to requests to postpone and continue or drag out a case

  17. DJ

Personally, the stress of this would be killing me… I would want to be sentenced, and have it over with….

i live in Jersey, and the courts are a cluster-ef. So many people in this state, so the postponement does not come as a surprise to me,

I do have mercy for the little girls. I would assume they were planning for Joe’s parents to help take care of the them. Hopefully, the time helps Mrs. Giudice time to heal from her husbands death. I am sure they need her now more than ever.

Just sucks all around… A lesson for all to live the straight and narrow.

  18. Anoneemouse

REALLY? Yes, I am sure the minute he dropped dead, they went to the feds who graciously agreed to postpone to allow time to grieve. They had nothing to do with the postponement.

  19. Valley View

Teresa needs to take a page out of Martha Stewart’s book-get it over with. I wonder if Joe will ask for a travel visa to go to Italy to bury his father? I have no idea where the father is being buried but it would add an interesting twist.

    • Katrina

It looks llke the Fed postponed the hearing. Teresa and Joe know what they agreed to. The judge has to sign off on it.

      • KReality

The judge doesn’t have to sign off on what they agreed to. The sentencing is a reccomendation from the prosecutor as a result of the plea agreement. The judge can reject the agreement but likely he won’t. That’s why they had to wait so long to get sentence, to give the judge time to go over the deal.

  20. Oh good, more time for Joe to not spend with his family. Seem he’d want to get the sentencing over with instead of sweating it out more.

    • I don’t believe the reports that Joe is not spending time with his family. I think those are false internet rumors. There is plenty of evidence to the contrary.
