Today should be very interesting here in the ATL. It seems that Kandi is finally pissed off enough at Kim Zolciak to take her to court for her Tardy for the Party theft. Did I mention that today is the day the reunion is going to be filmed? I was surprised it was today as Andy has been airing WWHL from SXSW all week. Nene flew in yesterday for the filming after wrapping filming for the season on The New Normal and according to her tweets she was not looking forward to spending the day with the RHOA cast. I just read an article Atlien wrote about tea she received from the reunion show and it says that Kandi and Kim were not allowed to speak about the lawsuit. So, for everyone that says its a publicity stunt for the reunion show, what’s the new theory? Makes sense that Bravo wouldn’t air details of the suit because they’re probably going to be forced to get involved. They own all of the footage Kandi needs to prove her case.

Storyline or not the timing is beyond perfect!! The original song had over $100K in sales on iTunes and the remixes have faired pretty well, also!! Does anyone remember DJ Tracey Young from season 3? She remixed the song and her version did pretty well. Because Kandi owns the rights she’ll get paid from ALL versions and use of the song. I’m sure hearing it during the Bravo promos for Kim’s show made the pot sweeter!! Kim has released 2 other singles but neither did as well as DBTFTP so future earnings could be wonderful!!
As for Brielle writing the song, it’s another story from Kim’s vivid imagination. I just watched the episode when she played the track for Nene and SHE explicitly stated that the vocal teacher wrote all of the songs on the disc!! The title is the same; however, the lyrics are completely different so Kim will be ponying up!! Guess it pays to have video footage of both songs!!
Kandi has been nothing but supportive of Kim and probably reached her breaking point when Kim started tweeting about making Kandi take a lie detector test at the reunion. That was the first time I’ve ever seen Kandi respond to anything Kim had to say.

Season 1 is where Kim played Nene a some songs and Nene didn’t like any of them, but she said “Tardy for the Party” was catchy.
Yes Kandi is saying they did the remixes without her consent. I think she gave Kim a copy of the track to perform and she has been using it to keep her music account. Kim also got the music teacher to sign the original song over to Kim. The title was never changed, but Kandi rewrote the song.
I hate to admit it but I have the Season 1 DVD set. LOL!! It was during episode 3. You should be as to watch the episodes on YouTube or Bravo’s website.
I checked Bravo’s website last night, but they don’t seem to have videos available for previous seasons – just short recaps of each episode.

I wonder if Kandi/Kandi’s lawyers are also counting Kim’s titling her spin off show after the song as a derivative work of the original. Or if the music used in the orignial work will be used as a theme song, bumpers, etc. If so, then the timing makes sense, since profits from this derivative work have not yet been accrued, since the show hasn’t aired yet.
Yes, they are using the part of the title and I think they are using the song in the spin-off. I think I read somewhere that Kandi asked for temporary restraining order. In one of Kandi’s bogs she wrote that she had given permission to Bravo to use the song on RHOA only to help Kim with sales. According to Kandi, she did not give permission for it to be used company wide.

The Complaint lists Eric Croone as the other attorney. Croone lists Phaedra Parks as a client of his as to entertainment matters…so I guess she brought him in, as I don’t see her as an intellectual property litigator. I think her experience is in criminal defense of entertainers.

I read somewhere that Kim listed her daughter for songwriting credit which means that she will get a check before Kandi. Well that would piss me off as well. From what we have seen Kandi did most of the work and got nothing in exchange so how does someone’s child who was either at school or at the pool get any writing credit and a check. I’ll bet what has really changed is that while Kandi thought she and Kim were really friends, she has now discovered they were never really friends. Also, like someone else said it is totally possible that even though they were no longer talking about this on air that they have been trying to mediate the situation to no avail.
When I was 20/21 I started doing speaking engagements and poetry readings. So my mentor got a request on my behalf and she asked how much did I want to charge the organization. I said, oh I like what org is doing so I’ll do it for free. My mentor stopped me in my tracks and said something like if you don’t charge people for your talent they will think it has no value. The way she explained it is these people have a budget and they are prepared to pay and I should value my talent enough to charge them. Nothing wrong with giving discounts or donating your services from time to time when asked. When Kandi didn’t put a written agreement in place in advance, she devalued her work and the work of the other professionals involved in Kim’s eyes. Kandi didn’t think it was a big deal to have a verbal agreement and so Kim didn’t think it was a big deal to steal Kandi’s money… I hope Kandi wins…

I’m all for Kandi getting what’s due to her but I find the timing of the filing of the lawsuit is suspect. I don’t think it is a coincidence that the suit was filed the day of the reunion taping when both ladies will be present. This season has been a snoozefest and the reunion would have been as well. This is another Bravo setup to generate a firestorm during the reunion and to provide a story line for Kim next season.

I remember when Kandi said that at the reunion she was choked up and started to cry–it was obvious she felt really betrayed by Kim and wasn’t over it, but was trying to be the bigger person. Phaedra did NOT mess up that case. Sheree wasn’t honest with her attorney. It is well documented that Sheree did a lot of things that even the judge called her out of line in the final court documents in the divorce documents that happened long before Phaedra was involved.
In this instance I am team Kandi all the way; but my question is why do this now? Not years ago when it was relevant? They have both said that this was water under the bridge. Ya got that right! Either publicity stunt or we didn’t see the behind the scenes that were behind the scenes. During that season it appeared Kandi produced the song for Kim who “owned it” somehow and Kim didn’t pay Kandi for producing. I guess there is more to the story.
Think of a song as a bundle of sticks. There’s a copyright for writing the song, copyright for performance of the song, copyright for producing the song, copyright for recording the song, copyright for song arrangement. Kandi owned all of those rights. Kim had a license to perform the song, not a copyright of song performance. So every time Kim performed, she owed Kandi money. The SOL (statute of limitations) hasn’t run out, so by law Kandi still had time to sue and get her money.

Technically Brielle didn’t write the song. The song in and of itself is an old country music song. Kim’s voice teacher obtained the song and Kandi re-wrote the lyrics and produced the song.
So Kandi’s case has some merits. There is also the fact that i-tunes initially removed the song from it’s site over infringement. The song has re-appeared under a new name, “Tardy for the Party” instead of “Don’t be Tardy for the Party”.
